Car Accident over The Weekend

Mate had an accident over the weekend.Can someone advise on who’s at fault? The dash cam car or the other party. He’s claiming the bus blocked his view.
His claim: “As evident from the footage, I was exiting the mall, with a bus parked to my right . I slowed nearing the exit. The other party was speeding , changed her lane just past the bus, without even having the indicators on.”

            @Aureus: Ok, I checked the street view and there is a park bay for the bus and cars coming out of shopping centre can still see traffic on the right if they look hard enough.

            In this case, it's the dashcam car is at fault.

      Hahaha… talk about clutching at straws.

      In the video, the bus is in a parking bay and all the lights are off, so the 40km/h doesn’t apply.

      It was also worked out before, that the speed at which the red car was going was around 16km/h.

      Best part is, even if the red car was speeding, it doesn’t absolve OP of their obligations under the road rules to give way to any car already on the road.

      OP has no leg to stand on at all in this situation. None.

    • The 40km/hr passing rule for buses only applies when the when the lights are flashing, as described on the back of every of every bus in Sydney. And the lights wouldn't be flashing as nobody would be crossing the road there. The bus is already parked inside it's bus bay, there's no overtaking.

      The dashcam car did do the right thing and turned slowly, but doesn't watch road so misses the oncoming car. Didn't even slow down until after the crash, at those speeds the dashcam car should be able to stop on a dime.

      The Google Street View images of that road (Kiora Rd) luckily also has a bus parked in that same bay, and you can see how even with a bus in the bus bay its possible to see far enough down the road.

    From the video evidence it is clear cut, dash cam car did not give way to vehicles on their right side.

    It is the simplest, most fundamental road rule, yet so many drivers do not comprehend it.

      I think OP is the driver. To have two people not know who is at the fault is really unlikely.

    Dashcam defo at fault. You cant just roll on out like you own the road bud. You must have slow reflexes or weren't even looking in the only direction that any traffic would've been coming from as you rolled out

      You're also supposed to stop (or at least slow down and practically when coming to a turn like that then look both ways), not drive out of Westfield Miranda without slowing down like the 'friend'
