Car Accident over The Weekend

Mate had an accident over the weekend.Can someone advise on who’s at fault? The dash cam car or the other party. He’s claiming the bus blocked his view.
His claim: “As evident from the footage, I was exiting the mall, with a bus parked to my right . I slowed nearing the exit. The other party was speeding , changed her lane just past the bus, without even having the indicators on.”

    Can someone advise on who’s at fault?

    One of those cars failed to give way to traffic when entering the road…… That is the one is the at fault. If they can't 'see' because of the bus, then they shouldn't be entering the road blindly. But looking at the street view map link posted above, the bus was in a parking bay, so not sure how much of the road it was really blocking.

    The bus stop just in front of the exit was a really bad idea. I doubt this was the first accident there.

      Did you check the street view link above? While I agree having a bus stop there is not ideal, the bus bay is set back from the kerb line and allows the exiting (dashcam) driver to pull right up to the road to see what’s coming. In any case, if you can’t see, you shouldn’t be moving.

          Good thing you're not an insurance assessor Tleyx.

          Clear cut case of failure to give way, and likely not doing their due diligence in checking before pulling out. The other driver had 100% right of way as they were already on Kiora Rd.

          Obviously we don't know if the other driver didn't indicate but nor does the insurance company, so they have to act in accordance with the evidence they have and the road rules that apply, which suggests that ion5678 Cough I mean the 'mate' is at fault.

              (1) A driver entering a road from a road related area, or adjacent land, without traffic lights or a stop sign, stop line, give way sign or give way line must give way to
              (a) any vehicle travelling on the road or turning into the road (except a vehicle turning right into the road from a road related area or adjacent land), and

          • The red car didn’t change lanes. Doesn’t matter even if they did, dash cam car still needs to give way (ARR#74)
          • The red car didn’t need to indicate the whole time even if they were moving lanes. You only need to signal your intention to move lanes before you move lanes. (ARR#46)
          • The red car was not speeding as worked out above.
          • The dash cam car ran into their side, so what “due care” does the red car have? Here is a list of all traffic offences and associated fines for NSW. Please find the one that says “driving without due care”.
          • There is absolutely no way that the red car contributed anything to this collision.

    It is really frightening how wrong, and aggressively wrong people can be about right of way. That these people are on the road fully confident in their mistaken belief that they are driving correctly. I once encountered a driver who I almost t-boned as they were performing a U-turn. He pulled up next to me at the next light angry at why I honked, repeatedly yelling "There was no sign that said no u-turn".
    1. You don't u-turn when there are cars coming
    2. You don't u-turn after a blind corner
    3. Double white lines…means no u-turn…

    It is somewhat comforting that the poll indicates a majority here have sense, but scary that some do not and could one day kill you on the road.

      All you have to do is watch a few Dash Cam Australia or Scotty's Camera videos on Youtube and you will quickly lose faith in the driving ability of a lot of people on our roads. I have 2 dashcam videos from within the past 24 hours (one is an absolute doozy) that I'm debating whether I provide to one of them to feature in their video.

      Also this is a another good example of how stupid people are on our roads.

        marked foot crossings
        pedestrian crossings"
        Otherwise you can do them at intersections without traffic lights or at breaks in the centre island of the road as long as there is no sign forbidding it.

    Drove into oncoming traffic. There's no exceptions if you can't see that traffic, you're supposed to slow down and prepare to stop just in case there is traffic.

    Stupid people are everywhere including the roads. The other day I saw a van with the rear window completely blocked off and driving on the road. Wonder how the driver sees anything from the rear view mirror.

    • Vans don’t need to be able to see via rear window. Just like trucks. They manage with side mirrors - although reverse cameras are often added now in place of the centre mirror.

      • Cool. I didn't know. I just thought that the way things were piled up in the van, it would have made it hard to see via the rvm.

        • It’s the same in a car. More than a few times I’ve had a load in the back of the car that makes using the mirror impossible. Try to avoid it, but there’s other mirrors.

          To help you out:

          • The bus is in a bay. There's zero evidence that the red car changed lane at all apart from what OP OP's friend states.
          • The OP OP's friend also claims they slowed near the exit when they came blasting out like a moron.
          • Regardless of any lane changes, which almost certainly didn't happen anyway, OP OP's friend has to give way when entering a road to EVERYTHING that is already on that road.

          Yes, that is a good defensive move, but hard to do if you’re about to turn left. It’s also usually better to be in the left lane because there’s less blind spot on your right for cars overtaking.

    "Your mate" should watch the video to see how the vehicle in front of them handled the situation. They drove right up and paused while they checked if there was traffic. "Your mate" just kept on driving into the side of another vehicle.

    Lol yea definitely blame the stationary bus & other driver who was already on the road. They didn't even try to edge out, just drove straight into the side of the other car.

    Maybe advise them to do some more driver training via NRMA etc. after paying their 'at fault' excess.

    The only thing I can't fathom is what you expected to get out of this post? obviously your mate is a really bad driver, the only thing I can say is don't show the footage to the insurance people or he is guaranteed to be the losing party, really he probably should receive some driving offense tickets for that moronic act as well.

    When I learnt to drive, my instructor told me that if I needed to merge to avoid an obstruction, I. E a bus pulled over or a parked car, I only need to indicate to enter the new lane, and if I return to the previously occupied lane due to having a past the obstruction, I didn't need to indicate.

    Translated… indicate to partially pop over into new lane, than no indicators required to return to original lane.

      This is incorrect. If you move from one lane or line of traffic to another, you must use your indicator. (Road Rules, Division 1, Change of Direction Signals, #44~51)

      That being said, if you had to move suddenly to avoid hitting something, it would be fair defence to say that you only had enough time to react to the emergency and not enough time to indicate. But if by avoiding the obstruction you had to fully go into the next lane, you most certainly do have to give a change of direction signal to get back to your original lane, as you are moving from one lane/line of traffic to another as you are no longer avoiding an obstruction.

      So, maybe they were right, but you got the signals arse about. Emergency avoidance, no indicator. Coming back to your original lane after a maneuver, need indicator.

    Your friend should have just taken the car a bit further and see if the road is clear. Rather than that, your friend wanted to follow the car in front.

    1. DC car didn't even slow down before entering the road which suggests they didn't look the other way.
    2. The bus seems to be parked in its own lane and not the main road. I think the red car was already IN the lane and DC just didn't even look for oncoming traffic.

      Bus is in a bay. OP just had to slow down and look for traffic before turning. This is the basics that you need to know to get your learners permit.

        OP (or OP's friend) did slow down and you can't assume he did not check the incoming traffic on the right (you can check, drive and still hit the red car). He did take the risk of turning left without waiting the for the bus but … in Sydney traffic, I saw many people doing that (i.e. turning left into the main road on the inner lane and cars keep coming from the right in the outer lane). This is normal in Sydney.

        The bus will park there forever, it's unlikely it will move anytime soon. OP might be at fault but the red car is an idiot, why would she switch lane after overtaking the bus?

          Of course I can assume he did not check for oncoming traffic, if he did he would not have crashed in to the oncoming traffic. The bus is stopped in the bay, he didn't take a risk by not waiting for the bus.. he just needed to look for traffic before turning. If he stopped and waited for the bus he would be a different kind of silly.

          Please just watch the video again. I think you just didn't see that the bus is parked in the bay when you watched the video originally. The red car did not overtake the bus.
