Product Not Delivered - What Steps Should I Take?

The short of it is I have paid for product and it has not been delivered.

I have been waiting 2 years and 4 months. The last update was 7 months ago claiming to have the product in manufacturing. I do not believe this to be true and regardless, it has been 7 months since that update.

What are the options to take? I know I can make an ACCC complaint but that does nothing for me right now since it's just a complaint.

It looks like I can try NCAT (in NSW) or small claims court. This does cost and it's probably not worth it for the amount i'm out (about half a grand).

Is there anything else to try?

And between NCAT and small claims, what are the major differences? It looks like NCAT is more of an online process and cheaper.

    If you can't even tell us what the product is no one can help you.

    Is this on kickstarter? Is it Australian company? Where is it getting manufactured? Was any legal contract signed? Did you use paypal? Credit card charge back?

    • The product is injection moulded keycaps. The legal contract is the purchase of the product. I didn't use paypal or credit card and the window for a dispute/chargeback is well passed.

    Oh wow! Please tell us that this isn't a Crowd-Sourcing related product investment (eg. Kickstarter)

    You probably should have pulled your money out a while ago!

    • No it was not. This was a pre-order product that gets manufactured overseas, which can take some time (which i'm aware of). The original timeline was several months. A year is strecthing it, 2 years is ridiculous and I do not wish to wait for the 3 year mark or beyond.

      I'll be sending an email to NCAT to see what they think. I'm worried that the seller will just say it's "in production" and lose the case, and the fee along with it.

      Surely there is some kind of cut off point. In my non-legal opinion, 26 months since purchase and 7 months since last update is unreasonable. I don't care what the actual status of the product is.

        Is your purchase a GMK keycap set or from an independent manufacturer? Try contacting the manufacturer/company/retailer because most of the COVID delays should have been done with as production has mostly gotten back to speed(geekhack/discord/email etc). A delay like this should be communicated with retailers so customers can have a reason to wait longer and longer until eventually it is delivered.

        Also proceed with a refund if possible as its the least you can do even though you will be unhappy that it was not delivered.

    • Nope, not a motor vehicle. What's the situation with the Rav4 hybrid?

            @pjetson: Yeah that was the time it ballooned out to during the scamdemic, toyota are aiming to get it down to 6 months this year.

    Where is the company based? NSW or overseas?

    • I'm in NSW, they are in VIC.

    • Yes. Reply will take ages based on other people's feedback and they will offer a store credit, which I will not accept.

    GMK sets have a long wait time. Example. I also received an order that was made in 2021 a few months ago.

    What other steps have you taken?

    • have you contacted the seller?
    • checked the project page for updates?
    • did you read the terms and conditions?

    Also, what's with not just telling us what the product is? Are you trying to steer the community's response in your favour?

      It's the OzBargain forums. Posters don't want advice, they want validation of their preconceived notions.

    • Not GMK. I'm aware of how they work, this was keycap sets from Rama. I am waiting for their support team to reply and offer a credit, which I will not accept.

      Last updated was 7 months ago as I said in the original post.

      There was also talk about factory reps trying to sell those sets because they haven't been paid for - just unconfirmed rumours but falls in line with their other shady practices (not paying suppliers).
