A Local Resident Is Blocking Public Road Parking

Hi OzB enlighteners.

I noticed that a resident on public street is consistently blocking a public road parking space—either by placing objects or using their red cone to reserve the spot. Since this is a public road, I’m wondering if this is legal. Do local laws allow residents to claim public parking spaces in this way?

I went ahead and parked and got a notice from the resident on my windshield. He/she is advising me not to park there. What annoys me is that resident put red cones on both sides of the corner.

FYI this is close to the Metro station if that makes it any more legal.

I would appreciate any insights or advice.

    Crowd fund some cheap cars with a few months of rego left, park them and leave them there until rego expires.
    like <$1k cars if those still exist.

    Write a return note saying, if they need extra car spaces, get a better job to buy a bigger house with more garage space.

    I'd be buying the ugliest junker of a car I could find and parking it in the spot and then taking the cones and putting them in the closest dumpster I could find. (profanity) whoever left you that note!

  • we leave cones in front of our business so that semi trailers can back in. It's a bit of a different scenario as its a business.

    at home i guess our neighbourhood has an unspoken agreement you can park in front of your house. It will be even more of a shit show once everyone's kids hit 18 and start having their own cars.

  • Think you need to 'borrow' a cpuple of no stopping signs and install them at the end of where the cones are. Then call council if someone parks in the no stopping zone.

    Well, the note is very polite and explains why.
    Perhaps approaching them if you "need" to park there too will help.

    Perhaps serious family issues of some value and importance (illness, no garage, elderly, whatever) justify their request.

    No, it is not legal (their request for exclusive parking space) and probably illegal to put cones on a public road. And probably also using "stolen" cones … perhaps.

  • If they don't want you to park in front of their house, I wonder how they would feel about you parking on their footpath. Especially if you do some decent forward and reverse in the same spot squashing her lawn and exposing the dirt ruts?

    Kidnap the cones and then take them to a bunch of different locations, take photos of them and post the photos.

      Not at all, it makes you a good person for picking up litter that others have illegally dumped on the road.

  • Take the cones to the local police station as lost property. You can cite the $100M economic impacts mentioned above. Just being a responsible citizen looking out for lost property and road safety

    If it’s one off for delivery or a couple of days for tradies to come over and do reno, it’s okay.

    If it’s an ongoing thing…. fk ‘em! Remove the cone and park. Throw the note in the bin.

    You can also notify your local Council and the Transport-Engineering team can send them a letter or Local Laws can issue a notice to comply for ‘placing an object on council land without a valid permit.’

      yeah heard abt this app recently. Does it cover all the councils ?

      • As far as I know it covered most of councils, utility companies and even Woolies, Coles, Aldi. If you report an abandoned Woolies trolley, the owner will be notified to pick it up. My experience with Snap Send Solve is positive. Even my shitty council response the request very fast. I think this is a very measurable KPI they dont want to miss out.

  • Take photos. Bring to police and make a complaint. Park where you wish, but having made the complaint makes it bad if the cone person retaliates. Got cams?

    What's with the sudden influx of people recommending to use some creepy dibber dobbers app in the last 24 hours? OP doesn't need to involve fourth parties (creepy 'sMaRt ciTy' app people), or even third parties (council) at this point.
    Ignore the cones, ignore the notes. Carry on as normal.

    OP should simply continue parking there. They have indicated they have done this already.

      Driver should keep the note and just put it back on his car each day. This would send the message that they will continue to park where they are legally entitled to !

  • I don't mean to hijack this post, but I'm dealing with a similar situation. Instead of cones, they're using their wheelie bins to block the parking spot in front of their house. When they leave, they place them there and move them when they return. They even have a driveway, but they park their minivan on the street because they say it's "difficult" to park it in the driveway. Any advice on how to handle this?

      Move their bin? That's what people do with my bin when I haven't already brought it in before I get home on the day the garbage is collected. Just don't obstruct their driveway because that would be rude. Put it on the nature strip next to their driveway if its already empty.

  • i love that they wrote the first part all in caps. So passive aggressive.

  • To protect yourself, take all evidence and log with police. Then, if something happens, you can go back to them.
    However, let the residents know that you've spoken to police about it. That will get them up think twice before doing anything.

  • Set up a mobile coffee cart complete with big screens showing public how every one is behaving.

    No need for it to record or breach any rules.
