116 Metres - Will I Get a Speeding Fine?

Turned off a main road into a side street tonight with a 50km/h limit. I reviewed my dash cam footage when I got home, the period in which I exceeded the speed limit, and then briefly reached a top speed of 58km/h (per the GPS on my dashcam) before returning to a speed under the limit lasted 5 seconds.

The point at which I reached a speed below the limit was approximately 116 metres from the camera van (distance measured on Google Maps)

So, will I receive a fine?

EDIT: 4/7 - it's now been 1 week and I've received nothing in the post yet.

EDIT: 12/7 - it's now been 2 weeks and I've still not received a fine in the mail. At this stage I'm prepared to call it good and suggest that at 116m away the van didn't snipe me. YMMV.

    If you had been speeding in the cameras detection area, yes….. If not, no.

      Hahaha therein lies the million dollar question , was I in the zone? Google's AI answer indicated the cameras are "most effective" within the 50-100m range, but it is still possible to detect speeding vehicles outside of that range. 16m isn't much at the end of the day.

        Your error rate for measuring distance from the camera would be more than 16m, so honestly no one is going to know but you in a few weeks time.

        No one can say if you had been caught or your hadn't based on the facts you have provided.

        • Used Google Maps to measure the distance from where my speed dipped below the limit to where the van was. Ruler said 116 metres. You're right though, could be a few metres either way.

          I wouldn't call 58 ripping given the speed limit used to be 60kmh not that long ago. And people used to do 10 above back then.

          Now everyone drive 10 below and it's infuriating.

    The cruise control on my x-cross will let me go a few km over the speed limit when going over a small hill, and when going down a hill it'll just keep going faster and faster. So if I set the cruise to exactly 60 and I go up a slight incline and at the top of the incline there is a speed camera, I'll be going like 64 instead of exactly 60. It's very annoying.

    • My tucson is exactly like this too, it can end up going 9km/h over the set cruise when going down hill before it even thinks about engine breaking.

      Then it can't decide what gear it would like when going up hill (or slight incline) will finally decide to drop a gear and do 3-4krpm and just simply speed.

      My old 91 ford EB2, the cruise was great; set and forget and was more fuel economic. This 2017 tucson I don't even use the cruise absolute garbage.

    Keep in mind the GPS on a dash cam has a time lag and you were probably going faster than 60km/h.

    Request a review first if you do get sent a "fine". There are guides about how to do this effectively.

    You can request a second review if you have additional information that was not provided the first time.

    You can also request to go to court, initially or after a review is not in your favour.

    Chances are it will still be dropped before you get to court because it's expensive for them even if you lose and have to pay legal costs. The costs awarded won't actually cover the time and staffing they expend on it. They are also short staffed so they will be reluctant to allocate someone to go to court to deal with a speeding fine for someone decelerating and going at most but possibly less than 8 km/h over the limit.

    If you opt to accept the fine or lose the court case you can apply for a work and development order (for example you could attend online training seminars, instead of paying the fine) or apply to have the debt written off, or request a fine reduction.

    Another option is to nominate someone else and then get them to nominate you in return. If you're up for a bit of fun they can nominate a third person who can nominate a fourth person and so on as many people as you can with the final person nominating you again. Then it will be up to the authoritays to prove it was you or them. Check the image first.

            @tenpercent: Dude, I didnt neg you or your reply. I was totally with you with those steps, right up till you started suggesting that you should just play nomination ping pong with it.

            Falsely nominating a driver who wasn't driving is an offence in and of itself and may even verge on being a criminal offence. It is from 50 up to 200 penalty units for this offence ($125.46 per penalty unit).

            As for your "going to court" reference, there is a very high possibility that if you nominate to "take it to court", they will take it to court. It's more of a game of chicken to see who gives out first. I once tried this approach for an $86 parking ticket thinking it was going to cost more to take it to court. they didnt give a shit and I was 100% taken to court. They dont care how much it costs because they give it to a prosecutor who will have 100 tickets to try that day, your's is just another one they have do the paperwork on.

            And court is for fines that are ambiguous or you are innocent. If you are guilty, you will need to plead guilty and they will just make you pay the fine, plus court costs and then stick you on a good behaviour bond IF you are lucky. Added to that, you may have to go to the court house and sit there and basically just wait. You may have to sit there for the whole day, and if your time is worth less than a $120 ticket, good for you.

            If you plead not guilty, you dont finish up there. It will then be set down for trial. The magistrate wont give a fudge on the day what you have, they will just set it for trial, so you come back another day and that time you will need a lawyer with you, so MORE cost.

            Added to all of this is your "work development order", because a lot of the time, this will not be granted if they can prove you have the means and the assets to pay for this fine + costs.

            So, yeah, elgrand makes a very valid point below. About the only "bunk" idea you didnt suggest, was to play the "sovereign citizen" defence, which would be equally as pointless as that nomination musical chairs suggestion.

  • It's all Lidar these days, I thought. If the laser can hit you, it takes less than a second for the read, that could be from 300 meters away.
    You need laser jammers to block the Lidar reading your speed and then slow down, but unfortunately that's technology is banned in Australia because we need the revenue money.

    you in NSW? If so, you have to be within 25m (maybe 18m like oscargamer says). The cam op doesn't even put the warning sign up until it is within 50m.

    • Warning signs are meant to be:
      First one is 250 metres before the vehicle
      Second one 50 metres before the vehicle
      Third one on the vehicle
      Fourth one after you have passed the vehicle

      Actual range of the LIDAR exceeds the signs, so the unit will be tracking you and when within optimal focal range will snap the picture.

    They don't trigger till about +4 kmh over the limit, so that might significantly reduce your dwell time in the danger zone (WA, other states might be different). I have tested this extensively, deliberately doing +4 through multiple cameras and never been flashed. Using GPS, and then calibrating my cars Speedo.

    The +4 is a +-2 for the possible measurement error and the other +-2 is for something else that I can't recall. Maybe just to reduce ambiguous speeding fines that could be contested in courts. A very welcome but uncharacteristic piece of common sense in Australian revenue raising.

  • It depends on whether the camera van used radar or lidar.

    Older radar systems send a beam out across the road with a specific beam angle width and at a specific angle, which if I recollect correctly, is 22.5 degrees. So you can determine where the beam intersects the lane you are in with geometric certainty by how far off the road the camera van is. Your speed is measured as you pass through the beam. With radar you would still have been outside the beam at 100+ metres.

    Newer systems use lidar. Lidar can reach and measure considerably further down the road. You are probably out of luck if that's the case.

    under 10kmph you can ask for forgiveness if no other fine in 2 years in vic

  • If you haven't had a previous fine in the last ten years, you can apply for an automatic reduction to caution (no points or $$$) unless it was in a school zone

    • I wonder if that applies in SA? Might have to look into that, pretty sure I haven't had a fine in at least that long.

      • Google can't find any reference to anything like that in SA. But I just might not be asking the right question. In fact accordingly to google SA police don't even issue warnings for minor offences, they issue a ticket no matter how good your driving record is.

        • NSW still issue however if you go on to the State Revenue (or whatever it says on back of infringement notice) there is the ability to appeal and it is one of the options listed.
