I was browsing the website yesterday and came across this. It's probably a mistake, but it might be worth a shot.

  • If this ends up being a fizzle and they don't go through with it they should atleast give an equivelent at the same price, ALL OZBARGINERS RING AND COMPLAIN IF YOU GET CANCELLED! :)

      As far as I'm concerned, I have a tax invoice saying we have entered into a contract of sale. They have accepted my payment, and they now need to provide the goods promised, or equivalent. I don't see any mention of price errors in their T&Cs.

      • Me too but they said they can't supply it they have no stock. Offerred a similar product at 'reduced price', but he said not at $3.90 per pack. Will have to do some haggling when I go in to collect I guess.

        • So people are still Gonna go in and collect, even after being told they're getting a refund? I might go in and see if they have it on the shelf, and if they do ill tell them I'm collecting it.

      • I just collected mine. They had six cans waiting for me. After showing them my invoice and a screenshot of the website, she asked if she could take my phone for a second, walked away and either called someone or checked something on her phone, then came back with six 4 packs. Easy done, no arguments. Balga, WA.

    They phoned me up and said due to website error it's for single cans not packs so they can't honor it. I have a printed receipt for 4 "packs" paid by paypal click and collect. I'll speak to a manager when I go in to collect. What technically are our rights with a paid tax invoice in a case like this?

    • I think it would be a breach of contract. Maybe mention the Australian Consumer Law it covers stuff like this.

        I think i'd feel like too much of a dick standing in the store arguing consumer law over a $15 order.. but i'll atleast waive my receipt around and try to get a decent discount on something else.

          They are also within their rights to provide a full refund via the original payment method if they are unable to honor the deal.

    I got a text from DM saying mine way ready for collection. So far all sorts of inconsistencies with everyone's experiences. Will see what happens when I pick up tonight.

    If you are going in to collect, their stock order is for single cans, and so it may help to have the website capture to show you purchased 'packs' of 4.

  • Got a txt saying ready for collection (Balga WA).
    Sent a friend down to collect and the manager is saying they're for single cans. I sent through the invoice etc but still no go.
    I paid via Paypal but they've now refunded the money into my friends bank account.

    • What?? I am literally in the carpack at Balga after just collecting my six 4 packs. They only had 6 cans waiting for me, but after showing them my invoice and a screenshot of the website, they gave me a carton. No arguements.

      • If you are going to argue it, it might help to mention that I dealt with Vikram at the Click and Collect counter, and a (large) lady with blond hair that authorised it (manager?).

    • Got to DM and they had 3 cans put aside for me. Said i ordered 3 packs but they said it is obviously a mistake and that i had to ring customer service for a refund.

        I think maybe, just maybe, the suggestion is that Dan Murphys is acting like one Gerry Harvey not that Gerry Harvey is responsible - hence the humerous moniker 'Gerry Murphy'

  • just received call from Camberwell store, Melbourne that order has been cancelled due to out of stock.
    called them that i have received confirmation text and email that my order has been accepted and can collect it ; thats sucks… told them will escalate matter cos' my order was accepted, you cant cancel it regardless out of stock.. but they just offer me refund…Ruined my weekend :(

    Got my email/sms conformation to pick up my 6 * 4packs from Pakenham, Victoria. Went to pick up (with copy of kingsville's screenshot) and they would not honour it. They called the "online" customer care and I spoek to them, pricing error, blah blah and my refund will be processed in 42 hours…WT?

    Lucky for those that managed to get it.

    Tuggeranong store would not honour it. Some [mod: removed language] ordered 12 4 packs and another ordered 24 4 packs (I saw the papers on the shelf).

    They were delivery too, the store are sending out singles not the 4 packs rofl.

  • Yeah looks like no luck. It's a shame, I needed them for a party on the weekend. I'm Gonna buy my party booze from somewhere other than Dan's now just to spite them.

    Tried to pick up my click and collect 10 packs they only had 10 cans ready for me.

    I showed the tax invoice and a snapshot of the online store showing packs and he agreed that I did order packs.

    He refunded me all my money and sold me 2 packs for $3.90 each.

    I was happy with that.

    Other collectors had not yet arrived.

  • I mangaged to get 10 4 packs in total through click and collect. Through a grumpy manager. Was the last of the store stock apparently.

    Seriously, is no one arguing this?? There is nothing about pricing errors mentioned in their T&Cs. They agreed to supply you with a 4 pack at $3.90. Their website entered into a contract of sale with you. It accepted your payment; and is now required to uphold its side of the contract.

    Fair enough it was an error, but they need to learn from their mistakes, change their T&Cs, and handle it better. Someone called to confirm, and was told it was accurate. They took hours to fix the error, even after becoming aware of it. They sent SMSes to people saying their items are ready for collection, so who knows how many people wasted their time and money driving there.

    Ordered 7 packs click and collect from frankston and they honoured it. Told me it was a pricing error when i picked it up and originally were going to give me 7 cans.

    Ordered 5 packs earlier today via Click & Collect (paid with Paypal). Went to collect in-store but was given 5 cans. Told Counter-Lady1 that I ordered 5 packs, not 5 cans. She said that it's the price per can, not price for 4-pack. I asked if I can cancel the order, she said "a bit too late".

    Left the store with my order. Initially thought "what the heck, just enjoy the booze". Drove around a bit and felt a bit cheated, drove back to store. Grabbed a can off the shelf and asked Counter-Lady2 to check price for single can. $3.90. Told her I ordered 5 packs earlier but got 5 cans. Was told there was someone else today who had the same issue. Was also told I can get a refund. So I got a refund for my 5 cans. She was also extremely apologetic.

    2 things I've learned from this.
    1. DM will not always honor website orders (and prices).
    2. Counter-lady2 is much better than counter-lady1.

      You probably needed to make her know it's YOU doing HER the favor by even debating getting a refund, because the supposed "price error" was theirs.

      You were completely entitled for the 5 4-packs you purchased, under protection of the consumer law. I stepped back and got mine refunded when they served me up single cans simply because i'm at my local often and they usually look after me well.

  • I tried to collect my order 1 hour ago at DM Richmond. Same story, it was an error in processing and only showed unit as per can instead of box on their system. As they honoured the previous orders they run out of stock. Apparently it is a discontinued item which cannot be ordered again.

    It is probably the made up story by their Head Office, so they don't have to honour their mistake.

    I find this really ridiculous and we would not get away with this in my industry.

    I had txt and email confirmation and tax invoice. I have not even been notified by email/txt or phone that it was cancelled.

    I never buy anything again at Dan Murphy's.

  • My dan murphys showed me their order for my 10 packs of 4-cans.

    It showed an order of 6 then an order of 4 cans.

    I don't think it is fair to blame individual dan murphys of any deliberate deception as it appears they are getting orders for single cans.

    Hey All,

    Similar story here.

    The manager at the QV store (Melbourne CBD) is very friendly and was pretty relaxed about it. Didn't get tense at all.

    Their system showed six cans not six*four=24. All stock they have there is claimed for Click and Collect, but he ended up giving me the six set aside for me, plus two that I'm guessing someone before me left there, then refunded me $15 (the four orders they couldn't fill).

    Poor guy still has 20 cans set aside over multiple orders and knows he's going to have to deal with this all night.

    He said to take it up with the call centre and was not assigning blame to me. I think this is a win win, I still got 8 cans for under $8! I just wish I had ordered 24 cases and got to leave with 24 cans!

    • I should mention he also offered to refund the while thing, but while worse than six, two is better than zero!

  • Got the voicemail (missed the call). They're cancelling it.. Thank goodness I don't want to force myself to bourbon and cola. I'm a beer guy, but when the alcohol's cheap why give it a miss?

    Just came back from the Mona Vale store, and the store system showed cans instead of packs.

    The manager also showed me a message on their system, which states that it was indeed a pricing error, stores are to either make a full refund, or sell one 4 pack at $3.90, and then refund the rest.

    I seriously don't understand the kind of behaviour that online retailers engage in. If someone makes a pricing error in a bricks and mortar store for example once I have paid for the goods I go home and then don't have them calling me up asking for the good back or a refund. Why should it be any different online? If you take someones money for goods at a certain price you should honour it. The only decent excuse is if you are out of stock and you can't possibly buy any more to supply the customer.

    Would it be legal for jbhifi for example to sell someone a TV at $300 (pricing error) when it's a $3,000 TV and then try to take the TV back from the customer's home when they realise 2 days later? I'd be really interested to know if this is legal and could be done.

      This is why most online stores have something in their terms and conditions regarding price errors. It becomes a condition of the contract of sale that if the price was in error, they do not have to honour it. There is no such condition on the DM website.

      • I've studied a bit of consumer law but I'm not 100% on this:

        If you have ordered and paid for the goods, they are supposed to supply it. If they can't keep their side of the contract, all they have to do is refund you.

        As far as I know, they sold every single unit of this product in Australia at the cheap price advertised. There wasn't enough for all of us, but many of us did get ahold of it (I didn't).

        Everyone who didn't get one will get a 100% refund.

        I know it's annoying, but they haven't done anything illegal. They did sell out their stock at the reduced price, rather than blanket cancelling every order, so at least that was good of them.

          Not quite.
          Firstly they have not run out of stock. Plenty of stories where people are getting refused when there is stock on the shelf.
          But even if they had truly run out then they over-sold. This is illegal as its false advertising. Kinda similar to bait and switch..

          If I owned a retail shop I would gladly sell brand new Samsung Galaxys for $10. Then say oh its a pricing mistake I will refund your money - but while you are here in my shop do you wish to buy a kilo of bananas?

        • It might have changed since the move to Australian Consumer Law, but when I last checked (http://www.ozbargain.com.au/node/9213), the consumer did not have to accept a refund (in WA at least). The consumer is entitled to the goods they paid for, or equivalent goods at the same price. DM entered into a contract, and has to uphold their side of the contract. The contract does not include any conditions regarding DM's ability to exit the contract due to price errors.

          I think that's only true if they're being intentionally misleading.

    • I was thinking about this too. Infact, many bricks & mortar stores (eg Woolies) give you a full refund if they mess the price up - and you get to keep the product.

      • That's a voluntary code that supermarkets agree to go by. If you are overcharged, you get the first one free and the rest at the lower cost.

          So unfair! He also got a full refund to his card from DM HQ for $39, despite the local store already giving him a $31.20 refund. So he managed to get paid $31.20 to take 12 cans of bourbon and cola off their hands.

          Now my 24 cans for $23.40 seems like a rip off.

    Too late to the party and didn't get any. For anyone who did, these are pretty tasty drinks. Taste quite different to Woodstocks or other bourbon and cokes. Nice though :)

  • Forest Hill VIC didn't even offer a refund! "7 cans (I Paypal-ed 7 packs), that's it, nothing I can do". Complaint lodged.

    • It clearly says packs on the email/tax invoice/confirmation etc, so provided you have that on you I can't see any reasonable excuse not to offer a refund at the very least.

  • I popped into Nerang dm after ordering 3 x 4 packs. They were overly nice and since they had only 3 old crow cans in stock they have me 2 x Nelson country instead. They did at first say it was only 3 cans but once the manager came over everything happened quickly and easy no fighting needed
