    As per everyone else Dan Murphys contacted me to tell me the money would be refunded in 72 hours which isn't good enough. So i went instore and spoke to the friendly manager who rang there office who confirmed my order was cancelled. THe manager then gave me 2 four packs as an apology free of charge.

      Wow that is awesome! I wish more managers believed in customer service. Just recently I had to deal with a very rude manager at HN City Cross who was super defensive and refused to honour my fair and reasonable request.

      The whole time I am thinking people just like being difficult on purpose. I run a small business and if one of my customers has an issue I do everything I can to make it right for them.

    No luck for me. The DM manager told me they had'nt had stock for months and gave me refund. Soooo jealous of those who scored as everyone knows that $1 Ozbargain bourbons taste so much better than any other bourbon. Enjoy for me.

    I went in with my order for 6 and my order for 4. They were apologetic and explained that it was a price error. The guy grabbed every can he could find left in the store and came up with 17 cans. That fulfilled my order for 4 and he tossed in the extra one, then refunded my on my order for 6.

    I can't complain. Mistakes happen and I'm not going to make a fuss about something I'm not technically entitled to. They were apologetic and gave me what they could, so I'm happy. Having one now - not too bad, especially at that price :-)

    I placed a click and collect- only to receive a call that someone 5 minutes ago had taken all the store stock :(.

    The guy I spoke too was really great- called me back 3 times and arranged 9 packs (of 4) at a store a little further away to be held. Really good service cause they really have no legal responsibility to honor the deal.

    The manager at the store I picked it up from said that they sent through a memo to stop honoring the deal- but my order had already been on hold before, so they accepted it.

    Sad not everyone got the right price :(, but some good people at Dan Murphys out there.

          Multiple pricing. They have to honour the lower price or correct it immediately. Most people think if a item is mispriced that by law they have to honor it… some places just do it out of goodwill.

          They choose to correct it…

          Actual information is probably more helpful than a meme from an enraged ozbargainer.

        • No one is arguing about honoring an advertised price. We actually purchased the item and paid our money and received a receipt. We are arguing that they have to honor that!

          and I doubt puffinfresh is outraged. I think he got all his order.

          wbeer: Thank you for your 'actual information'. May I suggest you read the Competition and Consumer Act 2010? Specifically, Volume 3, Schedule 2, Chapter 3, Part 3-1, Division 1, Clause 36 - Wrongly Accepting Payment.

          The most relevant being 36.4:
          A person who, in trade or commerce, accepts payment or other consideration for goods or services must supply all the goods or services:

          Note:          A pecuniary penalty may be imposed for a contravention of this subsection.

          36.5 and 36.6 go on to detail cases of when 36.4 does not apply.
          - If the failure to supply is not due to DM's actions (not the case)
          - If DM took reasonable precautions to avoid failure (not the case - no T&Cs regarding price errors, calls to them confirmed the price, and they took considerable time to correct it even after they started calling people)
          - If DM offers different goods as a replacement and the customer agrees.

          Here are the terms and conditions of the 'contract' you enter in to regarding content on website, not trying to be harsh- but this is pretty standard stuff.

          It would be incredibly easy to prove that DM "took reasonable precautions and exercised due diligence to avoid the failure".

          until you take this to the ACCC and get a decision on behalf of some of these people, I'm proven right- so "lawyer me" or sit down….

        • Yes, the T&Cs form part of the sales contract, as you agree to them when placing the order. Where in the T&Cs does it say that price errors will not be honoured?

          I've given examples of how DM did not take reasonable precautions. The erroneous price was not removed anywhere near as quick as it could have been and there were reports that DM HQ confirmed the price over the phone. They also sent people messages saying orders were ready to be picked up in full knowledge that the price was erroneous.

          Oh, but the lack of a formal decision by the relevant authority, either for or against our arguments, "proves" you right. Ok.

          It was only a mistake over the word case/ instead of can. I don't think stores knew this.
          Honest mistake, not to mislead… unfair to extort a business over this.

        • That is not enough to cover them. They don't warrant the accuracy etc of the site, so if you walked into the store without a previously accepted order, they are under no obligation to provide the goods at that price; the site was not accurate. Their T&Cs do not provide the ability for them to terminate a contract of sale.

          "Dan Murphy's does not warrant… at this Site" - I have a tax invoice in my email. Last I checked, my email does not form part of their site.

          You want clear cut? Have a look at DSE or HN's T&Cs; they actually provide the seller with protection against price errors.

          Some ozbargainers need to protect themselves from price errors… maybe by reading the OPs post, or knowing that $3.90 for a 4pack is 99% a price error.

  • Got 2 pack of 6 extra dry instead of this , paid $7.90 at Holland park west , shift manger was so nice he apologized and gave me decent deal on beers..:)

    This is despite me ringing at about 5pm this arvo and quoting my order number and the DM operator telling me that I will get refunded.

    Just got my call with "we cancelled your online order it wasn't supposed to be for sale" then fun buzz words like "Glitch" "System Error" you would think they would take some responsibility for this mess. Well off to the ACCC yeehaw!

  • got the dispatch notification at 9pm last night, and a voicemail around 6:30pm saying they are sending 6 packs (1 slab?) of the 10 packs ordered and will refund the balance.

    there was a note on the process steps
    "Return Case to Dan Murphy's Marion"

    so the "out of stock - discontinued - unable to supply" cock and bull story was a complete sham…

  • Dan Murphy just called - "If you've collected the 7 cans, that's okay, we will still give you a full refund". Thing is, I didn't accept the 7 cans last nite (in place for my 7 packs). Oh well, move on, next Ozbargain offer pls …

    I'm one of the lucky ones to get the 4 packs. I purchased 8 x 4 packs and got to the store yesterday to find that there were only 8 cans set aside for me. The girl got the manager and they showed me the order form, which looked like 6 @ $3.90 and 2 @ $3.90. The girl thought I was receiving 8 four packs for $7.80!!! I said that I would have purchased the whole store stock if that were the case and informed her that I'd already paid using PayPal and it was a bit more expensive than that :). Thankfully I had taken a photo on my mobile of my monitor showing kingsville's screenshot (thanks very much!) however, I photographed the image from the $3.90 per pack downwards (I'm in NSW so the Melbourne part wouldn't have helped my case). Anyway, the manager honoured the deal and even placed the cans in a couple of boxes for me - very happy with his service in honouring the deal.

    Most are in the fridge now for tonight & the fridge is quite happy:

    This afternoon I received a call from Dan Murphy's on 02 9333 8000 to see if I had collected my online order and I said "Yep, already collected mate; picked it up yesterday" - he was 'just checking'.

    Thanks again to the OP for the bargain and kingsville for the screenshot. I hope a few of you had similar experiences like mine :)

      Score, nice work! I would have been happy to at least try picking them up from my local Dan's if I hadn't had them cancelled before I went there. I am curious to see how they would have responded.

  • I too was able to pick up 5x4 packs. I got a call the next day asking if i picked them up. I said that I did. I should have also told him that they taste great, especially at that price :)

    I rang them up and the guy said he has cans written on the order not packs.

    I told him I had a tax invoice with packs on it.

    And asked him if he can see it.

    He did not reply.

    He said he is going to pass my details onto customer care.

    Not happy.

        I would ask for a refund… you only received 1/4 of what you ordered

  • Not happy here. I also got the phone call saying my order was cancelled. paid by paypal. Got a sms order cancellation confirmation also.
    Was lied too about we have no stock. I said my mate just went to the store and you guys had plenty of stock there. He changed his tune to say network price glitch.
    Asked him about my credit card charges I will receive from using my credit card through paypal and he said bad luck we wont pay that.
    Then after 5 days of not receiving my paypal refund I called them again and was told there was a glitch in my refund and she has just put it through again!!

  • wow been a week and still no refund, so much for a 'rushed refund'

  • Just got an email telling me I have been refunded.

    This means I ordered 10 packs pickup got 2 packs at 3.90ea and refunded $31.20.
    And I ordered delivered 10 packs and got 10 cans and a full refund.

    This means I ended up getting 18 cans for 7.80 which is 43 cents per can.

    • just got a full refund here too, so got 6 cans delivered for 0.00 which is 0 cents per can ;) but would of preferred 40 cans for $39..

  • both of my refunds have had a hold put on them. one has now had the hold cleared, but they have not removed the hold on the other one…. anyone else had this?

  • i bought 10 packs for delivery and paid by paypal. they rang and said they had cancelled my order. my gripe is that they did not refund my $46 dollars. i have emailed customer service off the website for two days in a row and..nothing. i feel a bit exasperated. it seems dan murphies have simply stolen my money. anybody out there have any idea what i can do?

        • A gift card arrived in the mail yesterday for the refund amount. Finally resolved, phew!

    • lodge a PayPal dispute, I did the same and was refunded in around 2 hours.

  • I received a call the day after my order saying it was a mistake and it would be refunded ASAP. I didn't care much and just shrugged it off.

    Few days later, I just got my 6 cans (not packs) delivered after the above phone call. Wondering if I'm gonna get my refund? Might call them tomorrow or shoot through an email. Hoping to keep the cans and get the refund!! Haven't opened any cans yet in case they wanna pick them up or something :/
