They can't go back and dispatch any quicker for example, its come and gone, so its impossible for them to rectify, but they were wrong and didn't meet what they claimed would occur. I have said about this before, not rehashing it all in this reply. I can still say about how bad they were.

    I'm feeling almost sorry for QQQ and Cotd because of ZeroSydney. Unfortunately there are people like that out there, having not much more to do than this. I hope and pray I'll never come across someone like him in my businesses.

    Personally I made very good experiences with CotD and the voting of this deal speaks for itself.

      Well you wouldn't have to worry about someone like me if you ran your business properly. So you don't mind ripping people off and then hope they don't complain? If you don't then why wouldn't you want a customer, you'd only have to worry if your business practices were unsound. The fact that you don't wont someone like me means in my reasoning that you must do something thats against consumer rights (and the law) as otherwise there would be no problem.
      Well I have taken companies and have always won at the NSW Consumer, Trader & Tenancy Tribunal (CTTT) and even went to court and won. I don't start action against a company unless I know I am right (both morally & legally). I haven't taken COTD to the Victorian Civil and Administrative Tribunal (VCAT) as I am not in Victoria (though I have had won a disputes with COTD via Paypal), if I was in Victoria I am certain I would win against COTD.

      Name me your company and I'll be a mystery shopper and "road test" it. Lets see how you really are. Are you up for it (that's its assuming its something I would like to purchase or a service I would need)?
      I'd even inform you of the outcome before I make it public.

      Most people vote BEFORE their item arrives. People can vote even if they never partake in the offer.
      Not every one who has purchased one is happy.
      The amount of positive votes doesn't really mean much sometimes, look at the Coles Chicken Breast Fillets voting, 51 to 1, even though it was a misprint (see http://www.ozbargain.com.au/node/13939).

      Castom8 if you look I am not all negative, I have said positive things about multiple merchants (both in Australia and abroad), COTD just hasn't deserved positive comments from me due to their behaviour.

    I can say also that I have a different experience to Zero Sydney. When I got my $99 PS2, it arrived within 2 days after I ordered and I'm in the West. That speedy delivery impressed me. Yes, delivery was slow some time back, but I think they are trying their best to improve.

    And I think he's more vocal about the EEE PC mishaps (when he didn't even purchase one) than customers who actually purchased one. To be fair, I think those that have not gotten what was advertised should be given the option of a full return/refund.

    Yes I know a missing bag and quick start guide don't seem like a big deal to most but it's the point of not receiving what was advertised.
    I also purchased the item before I realised it had no webcam - I stupidly went by the picture which clearly showed a webcam. It wasn't until people mentioned it didn't come with one that I realised it was different.

    The bag was mentioned in the specs - it's now been removed from the specs on the small fish. I'm convinced COTD did little research before advertising the item - they didn't even use their own pictures - they copied them from somewhere else not realising they were using a picture of a different product.

    So it's an 'insanely good bargain' according to the customer service supervisor - but really to me it feels like a bit less of a bargain now.

      Correctly advertisng the current small fish is OK, but trying to change history so people can't complain that something is missing is wrong.

      So COTD knew that the product they were selling was different to previous offers they had, they just decided to mislead (potential) customers.

    The advertisement had a mistake.

    The sleeve and quickstart guide are missing.

    Would love to supply, unfortunately its not available separately from our supplier. Anyone who is not satisfied can immediately request a reply paid refund, at no cost to you.

    As per usual, and I say this with full confidence in the customer service team, they will look after you. They have a mandate to keep everyone happy. Its not a matter of principle, but policy, try speaking with them instead of brewing conspiracy with Zero Sydney :D

      There is no conspiracy, the company you work for COTD, just isn't very good.
      Your company still lies about "one product even 24 hours" (as shown in the logo and also elsewhere on the website).
      Some may like a refund, I'd expect most would like to get what they were shown in the advertisement (with no more cost to them). If your company has to buy 1450 inner bags and quick start guides somehow to rectify a problem your company created then so be it. It doesn't worry me if you go and buy 1450 complete new ones with the items in the box and have to post them out. Maybe you can reimburse customers who do buy a sleeve/inner bag from a 3rd party. If you loose money then bad luck, maybe your company may start being honest if you're ripping off customers ends up costing your company money. I can't imgaine you actually paying customers to put them in a situation that they should have been in as it will cost your company money.

      Remember your company sent me the wrong product and didn't want to take it back as it would cost your company money. Yes your a business, but a business that is SHONKY. I'd imagine anyone who does take up the offer of a refund will be given the run around and who knows when they may actually get the refund.

        Why didn't QQQ "offer" this a week ago?

        With the email you got stewartedin they seem to have known that they were offering a different product to their previous sales so would be cheaper (just didn't tell buyers it was different). Seems that COTD really wanted to shift their inventory and not mattering with correct descriptions or consumer rights.

      Can someone tell me please is there supposed to be a sleeve/bag in the box for the netbook? I thought they came with some sort of little bag or sleeve. And the specs on the COTD website said this:"
      Send it back that way, in an open bag! Of COTD wont like that and you would probably fail in any dispute resolution procedures even that is they way you got it.
      If you do use extra packaging, don't forget to charge them for it. Also if you did pay P&H when you brought it, then charge them some handling fees also, they seem to like to overcharge for their P&H (when Paypal isn't paying for it).

      If you still want one (a better and cheaper one) ring David Jones Parramatta, and ask to speak to Jeff (or Geoff) in the home office section,and see if they will transfer a new 701SD to a store near you (if there is a store near you). They only had pink left by Monday afternoon.

      COTD caused this problem through a misleading advertisement, so a consumer shouldn't be made to incur ANY costs in their offer to rectify it.

        Will COTD be emailing all customers now to notify them all of the problem that was created by COTD and the recourse to the solution you now state is available? Or is the solution be kept hash from ripped off customers (as same may not even realise that they have been ripped off) which would cause COTD even more problems/bad P.R. and of cause more cost to COTD? Maybe COTD should put on their home page a recall notice and the solution to the problem which was caused by COTD! Now that does deserve a smiley :) as I know COTD wont do it, as COTD seems to think they are good and wouldn't want general (potential) customers to know that they mislead and stuff things up.

          Well done QQQ for your calm responses. And you have admitted the error and offered a good solution to anyone who genuinely feels they were unhappy with the original deal.

    The NSW CTTT doesn't allow "class actions". The NSW Office of Fair Trading can take your problem up in a manner that handles more then 1 complainant (but don't expect too much). If you want to hire counsel then go for it. I haven't posted in this deal for you to be impressed by me. Seem COTD have ripped me off I am allowed to post (and discuss elsewhere) about how bad COTD are. Even if I wanted to do something about the "Dell for the MX Revolution Mouse pricing debacle", I wouldn't be publicly involved; you may notice that Zero Sydney isn't probably my real legal title, and that is the way it should remain.

    Even if COTD did post (what seemed like) a good deal, its not a good deal if they have slack customer service standards etc, it should be the end to end deal that is looked at (or overall if you prefer), and COTD would fail.

    See AntMan76 not everyone loves or is "fanboy" of COTD. Thats one more non customer for COTD.

    Yes word of mouth can be a powerfull marketing tool, well its being used against them at present. They can claim as much as they like about how good they are, when people do buy and are let down by them then they are known for what they really are, which isn't something good.

    COTD has made claims that still fail.

    I didn't see any reply by COTD about their packinging standards.

      I think by now everybody knows you won't ever be satisfied with the past, and any sensible person will accept that the past is the past. The only way to improve things FOR THE FUTURE is to show them what they did wrong and let them address your concerns. I have already said this a few times already in this thread but you are unable to accept it.

        COTD hasn't improved in packaging, QQQ hasn't even mentioned anything about that. As someone posted their bag come OPENED.

        Help ha, well the COTD staff should have done that when they had a chance, not QQQ coming in after the event and claiming he wants to help.

        Can he help deliver what has been delivered late/slow? NO.

        QQQ CAN learn some things from other merchants as I have suggested, he never replied to that nor that COTD would improve in those areas.

        Where is the ACTUAL HELP FROM QQQ? I am not providing QQQ with my order details. I have seen COTD change their website after they (and QQQ today admitted) advertised goods that they weren't going to deliver (the inner bag and quick start guide). COTD lie and then try to cover it up. Offering to "help" after the event is useless.

        COTD can't turn back time.

      COTD still lie about one product every 24 hours and the so called improvements (even though I had ordered in the time frame he claims COTD had improved).

    It would have been good PR to offer to drop-ship an aftermarket bag ($3 from DX) to any complainers, since no ASUS ones available.
    It was clearly a genuine mistake, if a little careless.
    The offer to refund sounds a bit dangerous. Lots of people tend to find the 701 a bit limiting after buying it and want to upgrade to a 9".

    How are people finding it?
    I'm a bit worried after finding it has no SoDIMM slot. So you can't upgrade the RAM like other 701s.
    512MB is OK for now though. I'm running ubuntu netbook remix, and prefer it to the Xandros supplied.

    And the CPU is 800MHz BTW, faster than the 633MHz in older Eee-PCs. The SSD is very fast.
    The tiny touchpad is awful. Why can't they put touchpoints in them? (like on Thinkpads)
