      They could just leave a comment on Ozbargain explaining things as the competition was running - same way most others do it. They obviously been reading this thread.

      I think the issue here stems from a number of factors:

      1. They are a bog standard affiliate directory with a unique structure based on Black Friday Deals. Nothing wrong with this, actually the Click Frenzy concept is genius, they just go about it in a completely negative way and this is probably based on a lack of experience.
      2. Their choice of Content management systems and basic administration highlights a lack of Web development skill. Shopify has instructions available to to remove the issues they are complaining about.
      3. They are part of power retail, a bog standard SEO marketing manipulation splog.
      4. They have incredible negative rankings and feedback on social networks and review sites - this would take its toll on even the most hardened marketer.
      5. They treat users with contempt, probably related to point no 4.

      What can they do about this? Just get over it, acknowledge Ozbargain exists and they stuffed up not disabling the RSS and search pages on their Shopify install.

    To that clickfrenzy admin guy who is watching
    I know you have a difficult job but attacking and accusing people is not the right way to go about it, fine accuse me of being a hacker or whatever but don't punish everyone on this site for whatever actions you believe I took to game the system. This site is mostly if not all talk and we talk absolute rubbish sometimes and that can be taken out of context. Me saying "I found a method" was infact a broken part of your site which I believed was where the banner would come up, so I was mistaken and that was taken out of context.
    I'm going to say sorry for what you may think I have done but there is no need to be power hungry for the sake of being an alpha.
    I am sorry to everyone who is punished for this because of a few comments relating to "code" or "methods" and i'll watch what i say in the future because i thought I was free to say whatever I wished without being scrutinised
    Please accept my deepest sympathies for all who are being called hackers or gaming the system

      I joined the site after the competition finished trying to find more info on the whole thing, as it was severely lacking on the CF website I'm not running RSS feed so have I been deemed a fraud because I joined this site, not bothered who answers including the admin guy from CF

      But if that's all they have to stand on then I'm quite happy to send all my logs to the news including the conversations here I'm sure channel 9 would have a field day they don't like being embarrassed when they have hosted a shonky operator in good faith

      Still no reply from any of my emails to CF and yes they took my money from my CC

      So riddle me this I also don't have Facebook which is how most people were communicating so have they cancelled all the orders of those people who accessed live feeds too

      Actually if it's guilt by association then does that mean they hacked this site to obtain the email addresses of people

      If so some questions needed to be seriously asked ?????

      • If you didn't sign up to the website until after the sale I can not see how they can claim you "hacked" plus using a publicly available page on the website that smart people who do online shopping use called a "search" page I can't see how they consider that hacking.

        Pretty sure the ACCC may ask some questions of their handling in this situation as Im sure they are getting plenty of complaints.

    I can't believe the conduct by ClickFrenzy. They made some mistakes during promotions which could have easily been apologised for with a promise for them to better themselves for next time, but the aftermath has been phenomenally badly handled.

    To everyone whom have NOT had your order(s) cancelled:
    Is your payment still pending or has it been accepted?

    I'm almost starting to think they will just cancel the whole thing at this stage.

    Please be clear that we did nothing wrong. And here's why, according to Section 11.1 of Click Frenzy's own terms and conditions:

    "11. Entire Agreement
    1. Except as provided for in clause 1.3 (which is actually missing from their terms and conditions), these Terms and Conditions constitute the entire agreement between you and CF with respect to this Site, and the Terms and Conditions replace all prior or contemporaneous understandings or agreements, written or oral, regarding the Site."

    In there own words, any information or perceived instructions contained in emails sent by Click Frenzy have no bearing on purchases made from clickfrenzystore.com. Our agreement, as outlined above, is limited to the terms and conditions listed on the site where we made the purchases. More to the point, these terms and conditions do not restrict our access to the site directly, to its search function, or to its RSS feed.

    So please be assured that you did not have to click on any banner on some other website for your purchase to be considered valid.

    Also, yesterday someone posted a response they received from Click Frenzy in which the retailer attempted to justify their actions by quoting a section of their terms and conditions. Specifically, they highlighted the section which outlines their right to restrict our access to the site. And yes, they do reserve that right, but they did not restrict our access to the site. We all completed purchases and, by law, we have a binding contract the moment they accepted payment. If you received an email order confirmation, please know you have a binding contract with Click Frenzy.

    Don't be intimidated by any accusations of fraud or wrong doing.

      This is actually not true of online orders. The contract is generally binding upon order fulfilment (ie when they ship it). This is in part to protect a company if, for example, they don't have live levels of stock on their website and someone orders a million shirts. Payment will be accepted but they can't fulfil the order, so they are under no obligation to do so. They are within their rights to cancel orders even if payment has been accepted (provided, of course, that they offer a full refund). Additionally, it protects the company from any incorrect pricing. So if a company accidentally listed a PS4 for 10c and they only received one order, they are not obliged to send it even if they do have the stock. However, if they do post the PS4 and then contact the buyer and say "sorry mate, it was meant to be $500" that's when consumer rights kick in and they can't do that as shipment of goods has created the contract of purchase.

      • The result of a recent NCAT hearing suggests otherwise. Just last month an online jeweller was ordered to fulfil an order for a +$30,000 diamond ring they had mistakenly listed on their website for under $1,500. Not only did the tribunal find that accepting payment constituted a contract for the sale of goods, as per the Sale of Goods Act 1923, but they were also ordered to cover the customer's legal fees.

    And as explained I found a broken page of their site and thought that was the secret
    And so he basically threw accusations against me for that and just seemed more like a jerk and not a customer service rep at all
    I was done with him because this whole thing was a farce and a lie, none of us have the ability to speak freely without accusations. Furthermore, the best course of action is to boycott click frenzy forever, tell everyone you know to boycott click frenzy and let's hit them where hurts, reputation

      That is a basic website address extension that I think people with a fair bit of online shopping experience would be well versed in using.

      I used the search page for items which I can't see anything wrong with as it could accessed easily by just typing the address in.

      • Accessing a publicly available page does not constitute a violation of their terms and conditions. The search page is available to anyone who types that address in to a web browser. Again, you are only bound to the terms and conditions listed on the site from which you purchased the goods - and those terms and conditions do not restrict such usage.

      They kept the banner up for at least 5-10 minutes, what have they got to say about that?

      I think this may be another reason why they labelled us as a fraud, I mean for those who bought more than one item. They clearly haven't described it properly, is it one item per user per category or one item for all categories?

      Really does not make any sense…

        The one item per user is said in the context of clicking the banner when it appears, at which point only 1 category exists. Although ambiguous, I can't see how that sentence is supposed to mean that you are only allowed to buy 1 item across all categories.

        But even though that's not what they wrote, let's assume that's what they meant. Then logically, if they are unable to configure the system to stop you, they should simply let you pick which item you wanted. No one committed fraud by buying 2 items, especially since it wasn't even in the terms and conditions.

    I've just been informed that some people have started to received shipment confirmations with tracking IDs. Not a scam after all.

    We should all make a direct complain to fair trading.

    They have made a contract with us and they can not just get out of it like this. I called these dumb CF people yesterday and they threatheneed me to send my details to police and I said f off.
    He kept saying our terms and conditions and he couldn't even refer to what terms.

          PayPal pending for me as well. So they don't seem to know they have to accept. You'll get an email today saying the order has been shipping with a tracking ID for the couriers. Some people received this email yesterday, some today - so it could come through anytime.

          Yeh it was saying Unfullfilled. The best way to check is to click on the blue button in the confirmation email to go to your order page on shopify. You will see the line "Your order is confirmed" change to "Your shipment is confirmed" with a tracking ID in the latter case.

    Just got an email saying that they are waiting on a shipment of stock tomorrow in order to send out purchases. Will hopefully get shipping info by the end of the week. Can't wait!

    Lol I purchased one of the 'fake' ps4s and it obviously got cancelled. They messaged me say that they cancelled it and will be refunding, but when I check paypal, they only took my money, and never refunded it back.

    Beware guys, make sure they don't take your money! These guys don't deserve a single cent. scumbags of the earth.

        Who would have thought they'd find a way who "cheated" the system. Somebody's loss, someone else's gain. A mate got an email and because of the above, himnbeing next in the queue, got himself a free dyson. Happy times for him!

  • PlayStation has been shipped.

    We never managed to get any answer in regards to whether it's the pro version as per picture. The order status page still has a picture of the pro version. Anyway, I guess we'll see.

    I'd be incredibly surprised if we do get it, but less likely things have happened. Such as winning it in the first place. Very slack that they haven't fixed the mistake (either the text or photo as they are contradictive) or at least sent an email to clarify, but not really surprising based on their after-promotion behavior.

        • Cheers. That's a shame although not unexpected. Since it was so prevalent (and still not fixed!) a different company might have honored what we now know was a mistake, but oh well. Also looks like our playstation has been lost in the mail, trying to get them to chase it up now but both parties blame each other and no one is taking responsibility. Good times.

      they were the ones who cheated among other things one day you will get to smile about this

      not only did they do everything they accused you of they actually broke multiple laws (Confirmed)

      I'd love to get my hands on the T&C's they set up with the supposed sponsors / Vendors as there actually wasn't any bargains that weren't already there a simple google search gave you the same results at best they price matched existing offers from everything that i looked at that i actually had a need or want for and all websites i went to didn't require CF subscription the code came as a pop up or they had a quick search

      the whole thing was a sham

    Anyone with the cancellation email get their refund yet? My Paypal balance still shows as them having taken the money but not refunded it…

    • You will have to request for a refund, the guys at clickfrenzy will happily send you a cancellation but won't bother with actually refunding you unless you request it.

      • I put in a PayPal dispute. Is that enough or did I have to email them directly?
