Speeding Fine - Requesting The Alleged Speed Be Reduced by 1KM/H

Hi everyone,

Does anyone know if it's possible to request the alleged speed on the fine be reduced by a small amount - in this case 1KM/H.

My fine is for driving 100KM/H in a 80KM/H zone.

This puts me in the exceeding the limit by 20-29KM/H bracket - which is $400 and 3 demerit points.

Where as if the alleged speed was 1KM/H less, I'd be in the 10-19KM/H bracket - which is $200 and 2 demerit points.

Has anyone had any experience making this type of request in the past, or does anyone know if this is possible or not?

It's worth noting I'm in WA if it makes a difference.

UPDATE:

Sad news friends.

In WA the recorded speed is reduced by 1KM/H for speeds between 0-100KM/H and 2KM/H for speeds over 100KM/H.

Meaning my detected speed was actually 102KM/H and not on the border between the two brackets like I thought.

It's also it's worth noting all infringement penalties and allocated demerit points are set by legislation, and therefore, cannot be altered. WA Police have no authority to alter or override this legislation.

    What possible, logical argument could you feasibly present to justify your request?

      If I got it reduced all the way to 0, I'd get just fined for parking on the freeway.

      That's what I'm thinking (along side being a total reckless jerk).
      Obeying the speed limit isn't just accepting the whole road safety crap. Some speed limits are a joke, but 20 over is equally a joke, and thinking that anyone would even entertain this request is on a whole other level of joke.

      Why would you expect anyone let alone the authorities to read past the first sentence of any appeal?!

    Been there done that.
    Was doing 65 in 40 Road work zone. Got $500, 4 Demerit Points and a 1-month suspension. 1KM less speed would have saved my suspension….but done the mistake. learnt from this… Chin up and pay. Learn from mistakes and don't do next time..ever…..

    • i contested this camera pinged me in a section of roadworks before the speed change set for construction speed when they asked how i could prove it i replied with the date time and description of the 2 coppers 50M further in front in the same area checking people were complying with speed drop. they recalled all fines issued, by that camera.

    • This happen to be ages ago, cop did the negotiation (I put you in lower speed, which reduce a lot) and put me as lower price bracket.
      I didn't even haggle!
      I pay the fine move on :)

    There should be zero tolerance on these sorts of dangerous traffic offences with immediate license suspensions in place for people who are so wreckless (remove the demerit system in place of immediate suspension).

        Dude… I could go outside now and within 5 minutes take photos of 10 cars crossing reds, queueing across intersections and queueing across pedestrian walks in the city.

        If you venture outside your "aussie", Tracy Grimshaw ruled suburban bubble to other parts of the world you will see pedestrians, cyclists and motorists can co-exist in peace; Check London, Paris, Amsterdam anywhere in Southeast Asia. People casually jaywalking , cyclists overflowing on the roads. Cars moving much slower; driving is a utility and not some great "freedom" that people seem to think it is.

        Everyone in Australia is secretly (profanity) the petrol holes of their "pride and joy" believing it is some kind of miracle machine that is a necessity of life. People literally flip their (profanity) shit if the paint on their shitty (profanity) commodore is smudged. People somehow believe, despite our countries alcohol problems and road rage incidents where people get out of the car and clobber each-other, that Australians are mentally equipped to be able to surpass our speed limits.

        On a 60km journey, going 20km/h over the speed limit may only get you to your destination 5 minutes faster. One collision could cost you an hour or more of time. Then will cost all the other drivers who had to slow down to pass you an hour. If you accounted the time one single M4 collision could cause in total man-hours of delays it could be days, just because someone wanted to get home 5minutes faster.

      The OP got fined in an 80 zone (not a 60 zone) so the road is most likely rated for 100-110km/h anyway, which is well within the OP's speed, car handling and expertise assuming he is an average driver.

        He should get on the phone now to the police, the RTA, the experts, the politicians. Just like… call them all up at once and say "you guys are wrong… ummm… in Australia we can actually drive really fast like racecar drivers… but we dont need to wear helmets".

    normally it depends on the officer who pulled you over, if they're in a good mood or if you were nice to them they will do it on the spot then and there.

    i got pulled over during the xmas break, the cop asked me when the last time i got done was, i said about 7 years ago, and he said well i'll drop you down to save you some money.

    thanked the officer and drove away happily

    your speedometer may be inaccurate. our vehicle may shows us travelling at 100km/h, but the a119s shows our speed as 95km/h.

      There is suppose to be about an 8% leeway due to cars being allow to be 8% out (From my Mazda training guide 2010).
      My RIO says 100 and GPS is around 96km also

        yeah this is true but the moral of the story is the speedo can't read more than actual so if you know it's under the tolerance was 10% plus or minus 4k's so it's possible to be doing 86 when your speedo reads 100 but just because you believe it to be under is no defence

        Manufacturers can get away with this as long as the moving speed or actual is equal to or less than reading on speedo.

        if your speed read 80 on speedo but actual was 82 the manufacturer would face fines. provided you hadn't modified car i.e. putting larger rims and tyres increasing rolling diameter.

        The onus is actually on the owner of the car though which sucks but as technology progresses and the margins become smaller and more accurate the speedo's are going to have to reflect true.

        mazda speedos are the WORST…. doing 100 by the speedo, 92 by the GPS.

        and its not law, toyota can get right, 100 on the speed, 98 by the GPS.

        Yes thanks for taking the time to reply, it was a while ago and we have moved on now, a speeding driver on their mobile took her out crossing the road . Just learn a lesson and don't speed. Well too much you understand.

          If it helps to hear, I never drink and drive, use a phone or any other device while driving, or intentionally speed, etc. I take my responsibility as a driver seriously. When driving my attention is 100% on the road and my general surroundings. When it comes to my speed, I aim to drive within the speed limit, but every now and then I go over because my eyes are on the road, not the speedo. And even then this generally only happens on high speed roads like freeways or highways, as opposed to suburban streets.

          The purpose of this thread was simply to gauge the likelihood of being able to pay a smaller fine, rather than a larger one, given I was right on the line between the two. I don't feel I'm undeserving of a fine, or that road safety is something to be taken lightly.

          Given your situation, I understand it has to be distressing to think there's someone out there driving around not giving a stuff about anyone but themselves, so I hope in writing this I've been able to ease your mind a bit.

        • My rule of thumb is - Is it safe to look away from the road for a second? If it is, I'll glance at my speedo, but if not I'll wait until it is.

      A few other people have mentioned this as well, but is this something they really do, or just an urban myth?

      When the flash went off I remember looking at my speedo and it was more or less bang on 100, it could have been a 1-2 over or under, and it's possible my speedo is calibrated incorrectly, but from what I can tell, the alleged speed on the fine is the actual speed I was travelling at.

        Some states do some states don't, it will be clear on your paperwork if they have reduced it as they will have a "recorded speed" and then a 2-3km/h lower "alleged speed" that the fine is actually calculated on.

          In this case my original post just says I got caught speeding and want to reduce my fine. So without any additional information, a percentage of people will take the black and white approach and assume I'm one of those people who drives around like an idiot and doesn't think about anyone but themselves.

    100 zone with 2 quick drops 80 then 60 he passed the 60 sign at 105 free night in jail luckily they didn't take cars off you at the time for being a hoon.

    If it's a new car your internal instruments can argue for you if you just need the 1 k drop remember the yellow lambo that the police impounded and destroyed the computer so they couldn't dispute the speed

    Since your from WA you might remember the carry on with that one.

    • That wasn't true in 2012 - I was pinged 62km/h over (incorrectly signed roadworks, no "end of roadworks" sign, 110 section of highway) and they let me keep my bike and drop it off at the impound later. This was a cop in a highway patrol car.
      Has it changed recently?

      I think this is something that will be built into cars eventually. Although perhaps it wont be necessary as we'll have self-driving cars by then :)

  • I am sure your speedo meter must be showing closer to 110 when you got this speeding ticket, you already get -3km relaxation from your actual speed.

    I was in similar situation last year, accepted my mistake and paid my fine.

    Were you issued the fine by the police or was this a fixed speeding camera?

    Police issued fine - way harder to appeal however you could have sweet talked to the officer at the time and asked for a reduction
    Camera - give it a shot, but it is unlikely.

    I have received a speeding fine in the past before (camera related), and tried to appeal to the SDRO (NSW body responsible for collecting fines). It is very very hard to succesfully appeal (technically it is called a review with the SDRO). The appeal grounds are black and white.

    Ideally you need a sob story to ask for a reduction. If you don't and your reason is purely to pay a lesser fine and cop 1 less demerit point, it does not look good for you to ask.

    Got book once in WA, my bad trying to overtake a friggin truck. That was long truck nothing I seen in NSW freeway :)

    The Cop was nice to me didn't give me any demerit point just a pay cheque of $200.

    They already knock 3kph off, which means you were doing 103kph, you're speedo probably read 108kph, in an 80 zone.
    Just be glad you didn't kill someone, pay up and don't be a retard next time.

    where is this discount 3kph theory come from? Is this fact?

    • For some states, it seems infringements are sent out with both a detected and alleged speed. e.g. detected 103KM/H alleged 100KM/H.

      However where this isn't printed on the infringement, which is the case here in WA, I've seen no evidence one way or the other.

  • Read the fine carefully. It'll have the speed they got you at and then the fine is for alledged speed which is 2kmh less

    Second hand story and it may depend on the situation but definitely used to be possible in Qld - no idea if still an option.

    I'm an accountant but had a client of mine two years ago clocked in the low 100's in a 70 zone on a handheld. The bracket was going to cause a loss of licence.

    Incidentally he later worked out the cop averaged 140 or so to pull him over where he did which meant speeds in excess of that from a standing start and slow down upon catching up.

    He went with a lawyer to court, and plead guilty to a lower speed. His first attempt was rejected but the lawyer suggested they try again either later in the day or possibly the next day with someone else on duty and he was successful on second attempt.

    Probably not in the Ozbargain spirit, but if you're just trying to reduce the fine I wouldn't have thought it worth the hassle. Call around a few suburban lawyers though and see if any are willing to provide some guidance.
