I Tried to Return a Product and I've Got a Life Threat

Recently, I bought a Lifeproof case for my Samsung S8, from Dr. Boom store, located on Bourke St, on Melbourne CBD.
I didn’t try the case in the store, because you are not allowed to do that (I should’ve left the store right there, but instead I purchased the $100 case). I tried the case at home, only to realize it wasn’t a good fit for my phone, the edges where inaccessible, and it felt wobbly inside the case.

Due to work obligations I had to postpone my visit to the CBD to return the case for a few weeks. But I put it back in the original packaging, which is in as new condition.

Before returning to the store, I called the number on the receipt, to ensure an expediated service upon arrival, I explained my situation, they said no problem and connected me to the store, so I could talk directly with them.

Immediately the store clerk said they have a 14-day return policy, I replied Australian law grants 90 day. She said that is a rule of the store and is only 14 days. Short story she wouldn’t budge so I called head office again. After a short conversation they said they will call me in a few minutes.

I receive a call from another store clerk saying no problem, if the product is still in the package and you have the receipt you can return it, I agreed and attend the store after work.

At the store, I was received by both clerks, one of them was quick to say she wouldn’t return the product because it is store policy, again a lot of back and forth, I pointed out, even the receipt says: Store policies can’t contravene Australian laws. One of the clerks concluded: there is nothing we can do, that is Head Office’s order. While the other had the nerve to say You and your laws mean nothing to me. Kind of frustrated and tired of the argument I left the store and called head office again. Explained my situation again.

After an hour of me waiting outside the store I received a call from a Service Manager, who didn’t give me his name.

He made the point that maybe the case is defective, and he could send it back to Lifeproof, to be checked. I wasn’t happy with the solution because it would take an enormous amount of time, so I told him I will reluctantly agree on sending it to the factory, but I will rate his service and describe the treatment I’ve received from the staff at the Bourke St. store, on many forums on internet. He said with these exact words:

“If you say one word about my store online, I have your details, I will find your house and I will go and brake both your arms, if you say anything of this on the Internet I will put you in a bag”.

He then proceeded to hang up on me, I tried to call back to get his name, but now the operator refuses to give me those details.

      • My experiences with MSY were pretty good tbh. IJK on the other hand were quite poor. Had a warranty issue and they demanded I pay for posting it to their distributor. Every time I followed up they just hung up on me. Really disappointing.

    It's not the first time Dr Bam Bam has lost it on ozbargain.
    A guy makes a measured post, not saying the name of the retailer until he 100% finds out they were selling a fake and then a month later an affiliate with Dr Boom tells them off and makes excuses that OP later proves to be bullshit. That and tries to get OP to tell him his private details and stop posting in anonymity. Absolute butters.

    The response from them has been unprofessional and extreme. He has obviously lost his temper and not thought through the implications of doing so. I think it demonstrates the past alleged behaviour of making threats to the customer. It's actually quite scary to see… unhinged :(.

      me too just saw someone left 1 start review without anyword, but this Dr guy wrote like 10 sentences long and got fired up and saying bad stuffs about that reviewer. gee whats wrong with his brain i think he is addicted to violence.

        He's trying to defend his business, but he's going about it completely wrong way and is only causing more harm to his business himself.
        He would've been better off politely responding to the initial complaint and disputing it WITHOUT emotion, then leaving it there.
        But to go on the attack like this on the net? It's a very bad look.

        Especially when that behaviour has been demonstrated over and over on ANY negative review of his business. Like really? His business is perfect and has never stuffed up? Over 500 5 star reviews on Product Review mainly made by users who've been created on the same date as the review and then never posted again… not once. It beggars belief that a business (any business) can have such a high proportion of 5 star reviews, when sites like Product Review are typically frequented by people with mostly negative things to say (to warn others). It's not credible, and when questioned by a reviewer the reply from Dr Boom isn't denial, it's "blame Product Review procedures" (paraphrased).

        Sorting the reviews to "negative only" shows no nice response ever. The one from user "Mon" on 14th Feb 2017 is particularly telling. Contradicting comments by Dr Boom that ignores the points raised quite reasonably in the review. Sounds like a legitimate review by someone who's reviewed other products, and isn't unreasonable since the opportunity WAS given to rectify the problem prior to publishing the review. Resolution was only possible AFTER the review.

        But looking at Dr Boom's website, there's more than one store (Australia wide).
        Surely the other store owners/managers would be concerned with all this? This guy is very clearly speaking "for and behalf of" this company, and I can't imagine all of them supporting such reckless open communication?

        I feel sorry for them too :(.

          So bottom line is… that you have not bought from us, which is your right, however as such you have no right to comment on our service, products or our prices, but if it makes you happy we can withdraw our sponsorship of the local community sports teams that we support, we can close our store, we can terminate or 6 local loyal and hard working employees and they can all have you to thank

    Just saw in the older ozb post that Dr Boom already resorted to posting fake reviews right here on ozb and got caught out. Guess that solves all those 'questionable' reviews on productreviews and Google reviews then.

    Educate me if I am wrong, but 'change of mind' is not covered under consumer law. If it was faulty, then yes, a refund, exchange or repair would be considered. It's up to the company and their ethical process to refund it, if it can be resold.

    Either way, what details does he have? Nothing? Take it up with the police and get a refund.

    Also everyone go on Dr.boom website and everyone leave negative comments lol…. joking… or am i?

          The poor fit was a result of a defect which was resolved by LifeProof sending OP a new version of the case which fixed the issues.

    What a read..! @RicardoAlonso, very sorry to hear that you had to deal with the threats. Thanks for sharing. It seems quite unbelievable at first until I read the responses from Dr Boom himself from the google reviews! All this defensive and histrionic behaviour from management over what seems like legitimate negative reviews. I can't believe businesses like this exist and are still operating. I have never heard of Dr Boom before, but I will never step foot in their stores. Their replies to comments and negative review are completely insane. It is clear from the replies to negative feedback, that the "owner" or whoever is posting the replies have a complete lack of insight or judgement.
    At the end of the day, although it is only over a $100 product and the whole situation is very petty (on the company side)….business owners that behave like this should not be allowed to be in business and should be prosecuted to the fullest extent of the law. Please keep us posted on the outcomes.

    That would be a threat of physical violence, probably internally recorded - call the police. Threats are not legal and nor would destroying evidence of criminal activity be.

    PS, if you are unaware, the store has posted your full name on their Google product review page - I'm pretty certain that is something for which you can sue them. Contact me if you need the screenshot in case they remove it.

    There are forums for consumer complaints to be heard and social media or the internet is not one of them

    Our Bourke Street Google Review page has been bombarded by a spate of 1 star reviews instigated by a Mr Ricardo Cuevas.

    Mr Cuevas is a Cyber Bully, a liar and an extortionist he was declined a refund and didn't like it so threatened our office in writing with this very conduct and made up fanciful unsubstantiated stories if he didn't get his way, this was after he verbally threatened and abused our young female staff member in store.

    If you are a legitimate Dr Boom Customer then please post your receipt number onto this review, email us your contact details through our web contact page and we will arrange for $100.00 to be deposited into your nominated account within 24 hours with our thanks and sincere apologies and if you do not or can not then you are just another Cyber Bully with a pack mentality like Mr Ricardo Cuevas, have clearly never even shopped at our store and are as much a liar as your friend and hope you don't set this type of example to your children or young acquaintances or in your workplace because it's Cyber Bullying whichever way you want to justify it and it should not be tolerated.

  • Don't worry, It's a franchise. Complain to Dr boom head office directly. This threat shouldn't be taken lightly, if Dr Boom doesn't do anything, FCA (Franchise Council of Australia) will bring hell fire to the business along with the ACCC. I push for the cease of franchise license.

    • Jack IS the franchisor so those calls and complaints will probably just go directly to him. If he did have some franchisees under him they have to band together and raise a formal complaint about the damage to the brand.
      Each franchisee paid an inital cost + yearly ongoing costs for goodwill and marketing. Both of which continue to be flushed down the toilet with someone like Jack at the helm.

          Most franchisees aren't happy full stop.

          1. 80% are a scam - you pay an exorbitant fee to get in the door, which goes directly to paying for a new boat or holiday house for the franchisor
          2. you get to "use and benefit" from their brand image and IP, which is usually worth nothing (who had even heard of Dr Boom before this thread??)
          3. forced to buy stock from the franchisor (who take a percentage cut)
          4. have to operate under the franchisors rules which means essentially you still have a boss (even tho they probably bought into a franchise for the dream of "being your own boss")
          5. if the business is doing well, the franchisor gets a nice hefty percentage of any profit you make
          6. if things go pear shaped and you have to close the business, the franchisor kicks you out and "sells" the franchise to another unlucky punter for another $75k (or more), which goes directly to paying for another new boat or second holiday house, and on and on the cycle goes. It actually BENEFITS the franchisor if you shut shop and move on!

      We're aware of the current drama surrounding Dr Boom and are conducting our own internal investigation. Our knee-jerk reaction is not to instantly remove all reviews at the first suggestions of something being amiss, as much as people on this forum may think it should be. Any reviews that don't meet our standards or guidelines will be removed as we uncover more information.

      Just because an account has only submitted a single review (either positive or negative) does not automatically mean it is dodgy or non-genuine. Many reviewers come to our site through an invitation to review a service provided by a business. Unfortunately, a lot of them also do not continue to regularly write more reviews. I'm sure many of you have bought something and later received an email asking you to review what you purchased. Please consider that many reviewers (especially those reviewing businesses) arrive at our site in this manner, and we even offer services to facilitate this process.

      We absolutely do not remove reviews based on their star rating. Not only is this against ACCC policy, it's frankly a bad business model. For more information, I would encourage anyone to read our Trust Centre.
      The reason you say we are 'removing' negative reviews is because you have submitted several spam reviews yourself. A review like "Went to their Bourke Street store. No Doctors available. Spoke to the manager and he said none of their employees are certified by Australian Health Practitioner Regulation Agency." is clearly of no help to anybody and obviously does not deserve to be posted on our site.

      This brings me to my next point: please do not spam negative reviews to the page of a business you have not purchased from. I understand that you may believe they have been acting dishonestly and wish to adjust their rating and warn other potential customers. This is not the way to go about it, and only makes a business' claims they are being 'attacked' by spam reviewers look legitimate.

        You guys are so full of it and your site is disingenuous and propagates unethical business behavior. Here's a classic case, you guys supported and allowed hundreds of fake positive reviews for Acquire Learning disregarding their bad press in the media and widely documented illegal behaviour:

        They were fined heavily and went into voluntary administration eventually but your site supported their unethical behaviour by ignoring highly detailed negative reviews that should have been investigated and taken more seriously, providing more weight and casting a bigger spotlight on the businesses' reputation on your site.

        Point is, a quick glance at their page still paints them in a very good light for those unaware of their corrupt business practices. If you really cared about providing the Australia public with accurate, unbiased and realistic reviews of Australian businesses, you would have noted their negative press on sites such as these, all over Google news and more importantly their Google reviews (much more accurate depiction of a business than your site). Its so obvious when you look at how many likes the negative reviews got, in comparison the likes the positive reviews got, similar to Dr Booms Google reviews at the moment, as well as the information in this thread. Why not give negative reviews with more "likes" more weighting in your rating system? Or at least highlight them over positive reviews? Wouldn't that make more sense?

        Product Review responses like the above gives off the impression that you guys are simply lazy and your support of Acquire Learning above by allowing their page to continue to be active for so long, with fake positive reviews added daily, violated all your objectives:
        Our objectives
        To provide unbiased user opinions so Australians can make better informed shopping choices.
        To provide the platform where consumers can share their personal experiences using a product, service or shop.
        Drive public opinion to influence retailers and manufacturers to provide higher quality products and better service.

        You guys need to take a good hard look at yourselves before you start accusing the OzBargain community of not doing the right thing by uncovering the real truth behind a businesses reputation and dodgy practices. All the information in this thread and Google reviews should be prompting you to start questioning the validity of the reviews on your site. Don't point the finger at us, point the finger at the mirror please. Use the case of Acquire Learning as experience and learn from your mistakes (or continue misrepresenting the true nature of Australian businesses like you currently are).

        Under ACCC regulations ProductReview is in breach of CCA 2010 if you do not remove fake positive reviews. You are also in breach if you knowingly allow positive reviews posted due to receiving incentives "hint hint the big text saying send in your docket for a prize!"

        BTW I confirm there are no doctors at that store. More fact and truth that the other positive reviews!

        As someone who makes a living off selling a 5 star reviews or as I prefer to refer to it as a "premium review experience" for a number of websites including productreview.com.au I can ensure you that our good friend nsta8487 the product review rep only partially telling the truth.

        You may as why I am posting about this, while yes what I do for a living is arguably not right (Everyone's got a mortgage to pay. The Yuppie Nuremberg defence.) I am not a fan of companies lying outright. Now we can continue this discussion in the kitchen with a pot and a kettle if you would would feel more comfortable.

        However it is first and foremost its simply not in our good friends the review pages (yelp, productreview, womo, amazon, trustpilot etc) best interests to have bad ratings! People like sunshine and rainbows, not bad reviews.

        When I started this job (self employed after a motorcycle accident, boo hoo sad story) I learned very very quickly that there is a lot of work and not much money in providing fake 1 star reviews as the review sites quickly cotton on and remove them, leading to a bad customer experience for my customers (oh the irony)

        However even in my very infancy selling reviews I would simply (via automation) sign up and create 100's of positive reviews, from throw away accounts, names sourced from a public generator with a mix of 4's or 5s, or just 5's if thats what the customer ordered, all from the same IP address, from the same user agent, one after another… At the time I simply didn't know better. To this day 80% or so of those reviews are still there,

        They simply do not care, and why should they?

        The one star reviews I sold? All but gone. Although there is roughly three times the money in negative reviews its just not worth the effort or the time as most neg's are taken down within the month, as this is where the money is for me, this is where they focus. You can't really blame them..

        TL;DR, I'm not proud at all of what I do for a living, no one cares about fake 5 star reviews, everyone cares about fake 1 star's.

        Thanks for your contribution. I hope you are taking a good look at the reviews for Dr Boom Communications as there seems to be a deliberate attempt to "game" your reviews. There is a obvious trend to the reviews in that they are single reviews, always 5 stars, usually mention a staff member by name. There is also a huge number of reviews far more than most businesses, all following that pattern. Dr Boom Communications also seem to have a very poor reaction any 1 star review (initially it wasn't too bad but they seem to have gotten very bad recently). I would suggest you need to protect your sites reputation by taking action to not only remove what seem like obviously fabricated reviews but also to ensure that this cannot continue in other areas.

        I have been a long time user of product review and I have found this obvious "gaming" to be quite disturbing and makes me question the all the product reviews you have.

        Well, if you want your fake reviews to sound genuine, detailed and unfake, spend a little more effort and think like a normal person.

        How often do you remember the name of the people that serve you (excuse me) unless they really impress you. Here we have got reviews that can list the names of 3 different people just to make it feel like spectacular services have been given haha.

          And can you really have THAT GOOD an experience buying a small item or walking around a store that it requires an urgent 5 star review to be submitted as soon as you get home? How above and beyond can a phone repair store go to have 600+ 5 star reviews!? Do they give happy endings as well or something? Jesus Christ these guys are idiots, expecting us to believe this tripe.

        Yet they have accepted ~7 obviously fake positive reviews since YESTERDAY. EVERY single one of those reviews name at least 1 or 2 supposed staff members. LOL.

          Maybe we can add a 5 star rating though a 1 star review… Get creative with some comments. Either that or beat them at their own game. Name some random people who served us, really went the extra mile, customer is always right attitude, gave free gifts, took 50% off for mentioning ozbargain etc

        Cant really go after ProductReview, but the evidence in this thread and the one from 2015 with fake iPhone covers should be more than enough to open a strong case against Dr Boom I would hope.         Product review seems very dodgy now. I used to trust them like tripadvisor but not so sure now.

      force sign in with Facebook. When will people learn that this is unacceptable. Then again these are the people that give out books filled with everyones private information
