I Tried to Return a Product and I've Got a Life Threat

Recently, I bought a Lifeproof case for my Samsung S8, from Dr. Boom store, located on Bourke St, on Melbourne CBD.
I didn’t try the case in the store, because you are not allowed to do that (I should’ve left the store right there, but instead I purchased the $100 case). I tried the case at home, only to realize it wasn’t a good fit for my phone, the edges where inaccessible, and it felt wobbly inside the case.

Due to work obligations I had to postpone my visit to the CBD to return the case for a few weeks. But I put it back in the original packaging, which is in as new condition.

Before returning to the store, I called the number on the receipt, to ensure an expediated service upon arrival, I explained my situation, they said no problem and connected me to the store, so I could talk directly with them.

Immediately the store clerk said they have a 14-day return policy, I replied Australian law grants 90 day. She said that is a rule of the store and is only 14 days. Short story she wouldn’t budge so I called head office again. After a short conversation they said they will call me in a few minutes.

I receive a call from another store clerk saying no problem, if the product is still in the package and you have the receipt you can return it, I agreed and attend the store after work.

At the store, I was received by both clerks, one of them was quick to say she wouldn’t return the product because it is store policy, again a lot of back and forth, I pointed out, even the receipt says: Store policies can’t contravene Australian laws. One of the clerks concluded: there is nothing we can do, that is Head Office’s order. While the other had the nerve to say You and your laws mean nothing to me. Kind of frustrated and tired of the argument I left the store and called head office again. Explained my situation again.

After an hour of me waiting outside the store I received a call from a Service Manager, who didn’t give me his name.

He made the point that maybe the case is defective, and he could send it back to Lifeproof, to be checked. I wasn’t happy with the solution because it would take an enormous amount of time, so I told him I will reluctantly agree on sending it to the factory, but I will rate his service and describe the treatment I’ve received from the staff at the Bourke St. store, on many forums on internet. He said with these exact words:

“If you say one word about my store online, I have your details, I will find your house and I will go and brake both your arms, if you say anything of this on the Internet I will put you in a bag”.

He then proceeded to hang up on me, I tried to call back to get his name, but now the operator refuses to give me those details.

    Mr Cuevas is a Cyber Bully, a liar and an extortionist he was declined a refund and didn't like it so threatened our office in writing with this very conduct and made up fanciful unsubstantiated stories if he didn't get his way, this was after he verbally threatened and abused our young female staff member in store.

    If you are a legitimate Dr Boom Customer then please post your receipt number onto this review, email us your contact details through our web contact page and we will arrange for $100.00 to be deposited into your nominated account within 24 hours with our thanks and sincere apologies and if you do not or can not then you are just another Cyber Bully with a pack mentality like Mr Ricardo Cuevas, have clearly never even shopped at our store and are as much a liar as your friend and hope you don't set this type of example to your children or young acquaintances or in your workplace because it's Cyber Bullying whichever way you want to justify it and it should not be tolerated.

    Dr Boom seems like one of those little kiosks they normally have at shopping centres where everything is worth 10 cents but sells for $10, straight out of dads garage.

  • Contact the police. Bullies like this need to be dealt with by the law to make them stop.
    A friend of mine had similar threats made against her, although they were in a text so there was evidence. She contacted the Police. The person making the threats was swiftly arrested and charged, then it went through the courts.
    An interim AVO was also issued from the point of the arrest.
    Needless to say there were no more threats after that.

    This was in NSW.

    But seriously, now that you have posted the threat on the internet you should lodge a complaint with the police at least. And at least tell non-anonymous family and friends.

  • Ok that's an insane response by the store manager and I will never shop there ever after reading your story.

    BUT consumer law does not support refund for change of mind. Only faulty goods. So the burden is really on the buyer to do their research before purchasing - especially from independent stores. That is why if I'm ever unsure, I always buy from a big brand store I can trust like Myer or DJs.

    If the case listed your phone model as being suited then you may have a case for faulty merchandise and can take up a case with consumer affairs.

      Which reason matches Ricardo's situation?

      • Unless the packaging specified his phone model type, the store could still argue it's a functioning case that is fit for purpose. It's not black and white unless the item is actually faulty.

          Have you bought a phone case before? They all specify phone model on the package. Especially so for Galaxy S8 which has a unique shape and aspect ratio.

    If you go onto productreview notice how everyone who gave them 5 stars most of the accounts were created same day and have only left one review on their page only… The real customers who left one star were replied by saying that they were in the wrong and they went "above and beyond" hopefull this company is banned from ozbargain for not following acl

      That is seriously poor form leaving negative feedback for a situation you know nothing about. There are many holes in the OPs story and it is very doubtful events occurred as described.

    • This is the right move, just looking at their reviews in productreview (legit ones obviously) and then Google, they are crooks. This is like 1 out of 100 similar issues that you can find, and their product review page is littered with false reviews. And if anyone puts a legit review with 1 star they start threatning them, they should be crushed into a mountain of single review. At least to balance out the amount of false reviews they have purchased :)

      Dr Boom has retaliated with a spate of fake reviews.

      His response is extremely flawed. He tries to play the victim but failed to first admit he refused a refund and make a threat. His illegal actions precipitated a response he deemed as undeserved and disproportionate.

      Being the victim of one's own stupidity isn't cyber bullying, however he justifies it.

    I have emailed Product review about their fake reviews :

    You have a company Dr Boom Communications which is creating up to 1-3 fake profiles a day and submitting fake reviews most of the reviews have only reviewed them and always given 5 stars about 500+ accounts. Surely you log I.P address of accounts and see how many are posting to bump up fake reviews or notice that people are using 10 minute mail like this https://10minutemail.com/10MinuteMail/index.html?dswid=-5625 to create accounts and spam bad businesses.

    I'll bite, report to his head office and ask to send case and copy of receipt directly to them. Tell them you decided not to press charges because its a waste of time. Can they assist you directly. Also maybe not a good idea to post the location of the store. You know defamation and all that. Assuming the facts are correct and giving benefit of the doubt. Cool story bro.

    If the case is genuinely defective you can get an exchange through LifeProof warranty. If it’s change of mind (which it sounds) like then you are outside of the return period.

    • He said it doesn't fit, a common issue with LifeProof cases (I had one and had minor fit issues too). Online customers often required several exhanges to get a workable one. Once you get a good one, it is a good case.

      Dr Boom trades under the ACCC. The business is required to replace or solicit a remedy from the manufacturer on the customers behalf. It is improper to suggest the customer deals directly with the manufacturer. These are the written rules of the game. The business has consented to these rules.

      A representative of said business takes their improper actions one step further and makes physical threats of violence.

      Technical indiscretion is poor form but one can argue it doesn't deserve a harsh sentence. Violent threats should not be tolerated. The business representative should be fired and offered for investigation.

      Ps. If this is OPs real name, OP shouldn't surrender any further personal information that can be used to identify himself. You did not consent to have your identity published and this is defamation. Save all these review sites as proof said defamation has occurred.

      • So if you bought an Apple phone from them and had a warranty issue would you take it back to the no name store or you know just get it replaced directly under warranty from an Apple store?

        LifeProof (and OtterBox) are marketed as premium products and come with premium customer service and warranty. I had an issue and they expressed posted me a replacement next business day no questions asked. Didn’t ask for the faulty one to be returned either.

        The OP has a choice to deal with a store who is being difficult or just pickup the phone and get it sorted in 5 minutes.

        • It's up to the customer. The customer has the choice of approaching the manufacturer and/or distributor direct if the manufacturer/distributor is mutually agreeable. If the manufacturer/distributor is not agreeable to dealing with the end user, the retailer is obliged to facilitate the warranty claim with the manufacturer/distributor on the customer's behalf.

    • While it's good to be able to contact the manufacturer directly, we shouldn't have to.

      I expect the store I bought from to manage the repair and replacement so they should be chasing up LifeProof.

      OR make it clear from the first contact that this situation would be better dealt with buy LifeProof. Looks like the store stuffed him around a couple of times first. I'd feel the same as Ricardo does.

    Clicked on about 10 of the last reviews and all have only 1 review (being drboom) and some even personally mentioning specific employees.

    Actually really pisses me off thinking that people might look up reviews for this place and come across all these fake review and get fooled to purchase from these dropkicks

        Read reviews. This isn't a simple 1 bad experience and everyone jumping on. Same issues with refunding problematic items from cases to phone screens.

        There are issues of
        -fake reviews
        -threats
        -posting consumers names online
        -blame shifting
        -refusing refunds
        All highly questioning the integrity and business model of this company

          I'm near parra where there is a store. The reviews online correlate with my experiences.

          So don't assume I don't know there business. I know it first hand and that's why I'm pushing.

          The parra store reviews are just as bad and the fake reviews on Product review is for the company as a whole. The number OP probably called to escalate it was their generic 1800 number. Cross examine the reviews from all stores and you'll see patterns and the morals of the store as a whole. Same business model across the board

          So yes! It is silly of you, very silly of you.

          You seem to be trying (and failing) awfully hard to back up this company as a whole so either you're an employee, a completely oblivious moron or DrBoom himself.

    Even if we approach the story with a healthy dose of skepticism, the PR (and response management) shown by DrBoom on both Google Reviews (https://goo.gl/rhxnNT) and ProductReviews (https://goo.gl/9wAZrc) is atrocious. It's obvious they have no idea how to handle complaints.

    You should really get that call recording app, just in case.

    Get call recording app definitely and record any calls from private number or numbers you dont know.
    Report to police. Also report to fair trading. I think Fair trading could take their rights to trade away, for this type of misconduct.
    From an investigative aspect, it could only be a very limited number of people who would have motive to make such a threat. Ie. Owner of bussiness, family of owner of bussiness that work with him maybe, owner of the store you complained against.
    Therefore, if you can identify voice, police should be able to get them.
    Make note of time and date when you received call, and be sure its noted in pilice report. If anything were to happen, phone records could be accessed.
    If you manage to get a recording of them threatening you, or sufficient evidence otherwise for civil case, I would sue also . Then they can for many lifeproof cases for you, and a new phone :)
