I Tried to Return a Product and I've Got a Life Threat

Recently, I bought a Lifeproof case for my Samsung S8, from Dr. Boom store, located on Bourke St, on Melbourne CBD.
I didn’t try the case in the store, because you are not allowed to do that (I should’ve left the store right there, but instead I purchased the $100 case). I tried the case at home, only to realize it wasn’t a good fit for my phone, the edges where inaccessible, and it felt wobbly inside the case.

Due to work obligations I had to postpone my visit to the CBD to return the case for a few weeks. But I put it back in the original packaging, which is in as new condition.

Before returning to the store, I called the number on the receipt, to ensure an expediated service upon arrival, I explained my situation, they said no problem and connected me to the store, so I could talk directly with them.

Immediately the store clerk said they have a 14-day return policy, I replied Australian law grants 90 day. She said that is a rule of the store and is only 14 days. Short story she wouldn’t budge so I called head office again. After a short conversation they said they will call me in a few minutes.

I receive a call from another store clerk saying no problem, if the product is still in the package and you have the receipt you can return it, I agreed and attend the store after work.

At the store, I was received by both clerks, one of them was quick to say she wouldn’t return the product because it is store policy, again a lot of back and forth, I pointed out, even the receipt says: Store policies can’t contravene Australian laws. One of the clerks concluded: there is nothing we can do, that is Head Office’s order. While the other had the nerve to say You and your laws mean nothing to me. Kind of frustrated and tired of the argument I left the store and called head office again. Explained my situation again.

After an hour of me waiting outside the store I received a call from a Service Manager, who didn’t give me his name.

He made the point that maybe the case is defective, and he could send it back to Lifeproof, to be checked. I wasn’t happy with the solution because it would take an enormous amount of time, so I told him I will reluctantly agree on sending it to the factory, but I will rate his service and describe the treatment I’ve received from the staff at the Bourke St. store, on many forums on internet. He said with these exact words:

“If you say one word about my store online, I have your details, I will find your house and I will go and brake both your arms, if you say anything of this on the Internet I will put you in a bag”.

He then proceeded to hang up on me, I tried to call back to get his name, but now the operator refuses to give me those details.

    It's bit of a shame non customers are slamming them with negative reviews on Google. On the flip side they're clearly pretty thick with response accusing people of cyber bullying after themselves being accused of threatening violence and death.

    They could take hold of the situation and address it before they get totally shit canned… but probably not smart enough for that.

    funny how they know OP's name, i guess they dont put that threat to everyone ey. I had a simillar issue with the Bondi Junction branch about 2 years ago. wife bought a phone case for her samsung which didnt fit, and they refuse to refund. not only that they were so rude and insulting.

  • I'd be more concerned about Dr Boom sueing Ricardo for ruining his business than any actual physical violence.

    There is no proof that he threatened him, but there is proof that Ricardo posted a very negative review that has since snowballed into many others casting 1 star reviews.

    I'd be going to the police in the morning and filling in a report based on the threat to ensure its in writing for if you have to go to court.

      He posted a negative review of his experience which just happened to snow ball. Many many MANY more examples years prior to OP post of basically the same case . Doubt they have anything on him really, not to mention they posted his full name online about 50times hahah

    How are they allowed to write fake reviews on productreview.com.au? So many reviews left by people who have created the account on the same day and only have one review. I have put a complaint in to profuctreview.com.au - you should too.

      1) a 5 star ass kissing to Dr boom
      2) a 1 star thrashing of a mobile phone accessory company within the same vicinity of Dr boom.

  • I got a life proof case thrown in at Harvey Norman for iPhone 8. The silent switch doesn't work on the case as its damaged on the inside(since new). I have to take it back but have been too lazy (been 3 months now since purchase). Will post if any death threats are given.

    To be fair Lifeproof cases have wrappings and stickers on the inside and once you open it you can't pack it in "As New" condition. Hell, I wouldn't buy a resealed one especially if I'm paying $100. If it was unopened then it would have been another story.

  • Consumer law doesn't grant 90 days that I know of, but it does guarantee the product is fit for purpose. In this case the product is literally not fit for purpose and you've explained you wouldn't have bought the product in the first place if you had of known this (or its a major fault). In this case you're entitled to a full refund.

    If they're anything like shoppingexpress you may need to seek assistance, but boy are they quick refunding one you do. They know it's illegal, they just try to stuff you around as much as they can't without being fined for it.

    In the future, abuse the 14-day guarantee. Purchase it, open it right away in store and try it then return it if it's not as you wanted.

        Also as someone above said, I'm assuming the OP got a old lifeproof s8 case (or ?fake) from Dr Boom with the known issues which life proof has addressed.

      They're very aggressive and have no issue with posting the real names of customers who give them a bad review.

      I believe the OP's story based because of the responses they're giving out.

      If OP had to create a throw away account here, it was out of fear of these gangsters associating his real OzBargain account with his real name.

        edit: Especially when reviewer only have one review and no other activities on that account and with really stock looking pictures…. I mean some of these account was created years ago and only one review???

        I smell something fishy here…

        I mean even good retailers don't have perfect track record …

    Fake or misleading reviews:
    Businesses and review platforms that do not remove reviews that they know to be fake risk breaching the Competition and Consumer Act 2010.

    Can't we get ProductReview done in for letting these fake reviews persist?

    • Just put a complaint to the ACCC. That's what I did. There is already similar precedent and fake reviews are highly important on the consumer watchdog as of recent years.

      Fake reviews on product reviews. When a negative comment is left the owner responds with "we have over 500 5 star positive rating " to try and push aside the actual issue that has arised.

    Death threats are unacceptable and you should report it to the police.

    But I also just want to point out that Australian law doesn't grant 90 day returns, they grant that the shop will replace, repair, or refund (their choice) a product if it's unfit for purpose. - e.g. it's faulty or falsely advertised. You have no right to change of mind returns, it's just something some shops choose to do. Maybe you're trying to argue that the case was so bad it was unfit for purpose, but it sounds like you just think it's a bad product, in which case you don't have any right to a refund.

    Hi guys,

    OP here, sorry I was very busy at work I couldn't respond earlier.
    I want to make some points clear, so everybody knows where what this really is.
    First, I want to tell Lifeproof customer service is exceptional, they replied promptly, and they will replace my case with the new version. They acknowledge it was a version out there that doesn’t fit the phone properly (Dr. Boom stores it). All this with no cost.

    So, to make things clear, I didn’t change my mind about the case, it wasn’t fit for purpose, and anyone can go to Consumer affairs website and read what are the rules about it. When I went to return the case to the store, everything came down to the fact that I opened the box, and store policies are to not replace anything that has been opened.
    I recognized this was my fault, right when they didn’t let me try the case I should’ve walked out of the store, but I didn’t my mistake. I thought to be a physical store, I shouldn't have a problem.

    What piss me of the most is the staff at Dr Boom, seem trained to do the same with every customer and I can bet 99% of people with a problem will just walk out and loose their money. At the end nobody wants to go through trouble for $100 or less. (Not me for sure)

    Yesterday I received a few emails from Jack Zervos, telling me I can’t prove anything and he will sue me and bla, bla , bla. Obviously is the kind of person that won’t do half of the things he says.

    I went to the cops and filed a report, together with the Consumer Affairs report, and I solicited the chargeback from my bank. Also, the cops told me to create an additional report in ACORN, because it classifies as Cybercrime.

    I notice some people don’t believe this guy could say something like that on the phone. Well, you are not alone, I couldn’t believe it myself. No, I don’t record my calls because I am not the kind of person who gets death threats every week, and I don't need to record the conversations I have with family and friends (that would be weird).

    I want to say thank you, to whom took the time to read through and do something, I can’t imagine the number of people with problems with this store, and the obvious choice is just to walk away.
    I was about to just let it go also, after I visited the shop in person on Tuesday, I was going to walk away because I thought it wasn’t worth it. That before I talk to the ones who run the show, and I decided I must do something, or this will happen again and again.

      You should call Mills Oakley to see if they are indeed representing Dr Boom. They will tell you if they are.

      Only an idiot will send a letter before their solicitor does, and in this case, only an idiot will pretend they've solicited a solicitor and it was never advised that he should have no further direct contact with you.

      Besides, printing your face and details isn't legal. Going out of his way to print 10,000 fliers is most definitely malicious intent.

          The OP has alleged a threat, the owner of the store has alleged a threat. Neither of them have shown any evidence.

          At what point do you abandon critical thinking because you find the story alluring?

      This guy is batshit crazy! I pray to God he goes ahead with that 10,000 printed fliers threat (which would cost him more than the refund the OP wanted) so we can see the social media meltdown afterwards!

      And don't you love how their first 5 star review for the Bourke St store on Google is from a 'Jordan Zervos' and even uses the Dr Boom avatar? Like, is that a fake review? Hmm…

    • Thanks for the update OP. It’s really disappointing when people choose to bully and intimidate rather then providing a fair service. Reading the comments it looks like it’s not even about the money given they could have just asked Lifeproof for an exchange. They just don’t care about their customers enough to make the exchange.

      You should also let Lifeproof know about this atrocious service and just link them to this thread. I don’t think that any premium brand would want a reseller like this.

        i don't know if it's ethical but you should ring them up and install a call recorder app and ask them why they are making 'false accusations' against you. maybe the owner will slip up and accidentally admit it

      Its breaking ACL if a company tells you to directly deal with the manufacturer and not them as first point of contact within the first 1-2 years..

      Get familiar with ACCC. The customer doesn't need to contact the manufacturer or distributor themselves. It is not tough shit for the customer, it is tough shit for the business.

      If you don't like the rules, change it or quit. Don't make your own set of make belief rules.

          If it is a major fault, the customer has the right to a refund and may legally decline an exchange.

          The definition of a major fault is also available on the ACCC.

          In this case, it is a major fault. If the phone doesn't fit, the water seal may be compromised. The reason why this case cost several times more than another branded case is the waterproofing.

          Lifeproof would have just let the buyer keep the case and he would been sent a new one if they made a claim.

          I'm sure both the op and this store will be dreading over the situation this weekend, it's so unhealthy and unnecessary.

          But if the store honestly threatened the buyer… oh well, nothing can be done. It's gg

          I wasn't offered a refund or an exchange or anything.
          The first thing coming from the store clerks was: The package is opened we don't do exchanges or refunds.
          And believe me, they look very well trained to just negate anything you say to them because they know there is absolutely nothing you can do in a situation like that.
          Think about it, what can you really do?. Sue them for $100?
          They are counting on your reasoning that way.

        chillax man, i don't do fake reviews. if you bothered to look you can see for yourself.

        the reviews posted online are real, unfortunately we don't wow enough customers to go above and beyond to post a review on a third party website.

        so we have a few negative out there, which are genuine.

        well except one guy, who think they got a fake, when they could have just looked on lifeproof for authorised reseller.. he spent some time making a video, so good on him.
