Received $448 Red Light Camera Penalty (NSW)

Hi guys,

I received fine for jumping red light. Here are the pics. The grey vehicle turning left is mine. Here are the sequence of events:

  • I turned left when the lights were still yellow.
  • While turning left, realised that the vehicle in front of me is too close to comfort and braked and slowed down my vehicle.
  • The lights turned red when I still had not completed my turn. From the images provided, looks like the rear tyres of my vehicle triggered the camera.

I was under the impression that if your front tyres cross the stop line while lights are still yellow, you are safe.

What are your opinions, should I contest the fine, and it yes, how can I do that?

    From what I understand, the sensor is in the white line so you triggered the camera when your rear wheels ran it over (since your front wheels ran over it on the yellow).

    What you should've done is stopped on the red before your rear wheels hit the line, even if it meant half your car is sitting in the intersection.

    • Have a look at the photos again, the car would not have been across the line when the lights changed to red as the first photo was 0.9s after it went red, the second was 1.6s after the red and the car has moved forward more than one car length in the 0.7s indicating that when the lights changed the car was not across the line at all.

      What should have been done is stopping BEFORE the line, with the whole car. If part of the car crosses the line then you are in the intersection.

    I was in similar situation before, the two brightest flash that sunk my heart… anyway i did not proceed and finish the turn like you did and hence the two pictures showed that I stay put.

    The notice never came.

    • THAT'S the difference:

      1 - The car is in the same position in 2 photos indicating that you haven't moved after the light turned red OR
      2 - The car being in two different positions after the light turned red indicating that you have moved after the light turned red.

      And THAT'S why red light/speed cameras take two consecutive photos - to show that a car has indeed moved through an intersection after a red light.

        And I think it is okay to reverse back too (and not get the infringement).

        Trigging the camera is not the offence… driving thru is.

          Australian Road Rules 2014, Reg. 57:

          57 STOPPING FOR A YELLOW TRAFFIC LIGHT OR ARROW
          (1) A driver approaching or at traffic lights showing a yellow traffic light must stop:
          …and must not proceed past the stop line…

    Been there, no point to dispute it. The time since red on my case it was 0.7s, your whole car need to be over the line before the light turn red. Moral of the story: yellow means "prepare to stop" and not speeding up to make up for it.

    The cars that were going straight managed to stop. They would have been going faster because they didn't have to slow down to turn the corner.
    There was no reason why you couldn't safely come to a stop.

    • Or maybe there was a left green arrow while the straight was still red? You can see a silver car turning right across the intersection in pic 1

  • Just write a letter accepting you were in the wrong and that you have a really good driving record. Also go onto to say that it was an honest error/misjudgement and that you really have a high regard for road safety. It costs you $0 to contest a fine. So you have nothing to lose.

    • Op said two fines in two months. I’d be careful about which one to apply for leniency for, ie pick the one most likely to get off.

    The photos show your already in the intersection when the light is red, does not show you entering on a red. just say you entered when the light jusy turned green and were stuck there until after it went red, only after it went red did they move up. Then your guilty of entering an intersection when there isnt room, but thats not what they are charging you with so thats not guilty.

    • Unlikely. There is a car in front that has cleared the intersection. The distance travelled in 0.7s indicates traveling much faster than from a standing start and the brake lights are showing in both images indicating the car is under brakes.

    • The 2nd photo (not shared) shows the OP car no longer there.

  • Here's the thing. If it is safe to stop for a yellow light, it is legally required from you to do so - even if you can make it before it turns red. If it is safe to stop, you MUST stop. And given that the light was yellow for 4 entire seconds while you were presumably travelling fairly slowly to make a tight left turn, I'd say it was definitely possible for you to stop safely for the yellow.

    pay and forget,i had once crossed red by .007 sec( less than a sec late) and had to pay.

      0.007 (7 thousandths of a second…) The traffic cameras are not that accurate. Maybe 0.7?

      But just so we can actually put it into perspective. You saw the yellow light for at least 4 seconds prior to arriving at the intersection. At 60km/h (where most traffic lights are situated), you saw this light change from around 65m away.

      In reality, you didn't go over by 0.7, you went over by 4.7 seconds.

    I like the point system but to me the fines are excessive and certainly regressive.

  • Pay the fine and move on. Your not going to waste your time with a day of work to contest this are you? I have a good rule. Factor in that you will get 1 or 2 fines a year be it parking tickets, speeding or red lights. Makes life less stressful. Another simple tip which I now find is that everyone is driving 10km slower, braking way before intersections with lights. Oh the joys of driving. Turn up the radio and just keep try and enjoy the congestion.

      What? One or two a year? Learn to drive and park properly. Many of us driving haven’t had fines in over 10 years, for me closer to 15.

        Yep, most people in the trucking industry or similar professions where they are on the road all the time accept 1 or 2 fines a year as par for the course.

      • @euphemistic You may just be lucky, but you can be distracted for a second and get speeding fine. You need to be driving at the speed limit not 10km below it. I was saying to OP get over it.

          I still say if you are expecting to get fines, you are doing it wrong. Im not an angel, I learned my lesson a long time ago. went through the phase of thinking regular fines were ok, but the reality is if you need a licence, you drive to not get fines and that might mean staying below the limit by 10.

          @Euphemistic: That is the issue. Driving below the limit causes conjestion and frustration in drivers. In Vic they are trialing 40km limits and some Councils talking about 30km.I cannot drive my manual RS Megane that low. Lets agree to disagree. I dont drive to get a fine, I just think that you can be as careful as you like and still get fined. It happens.

          Apparently the new Megane RS only comes with 4th, 5th and 6th gears and a 2 position throttle, on or off…

          Did you want to keep the car in first gear with the clutch in. Stalling with the start stop is an issue and not safe.

    Pay the fine, you will not get off. Trust me.
    You entered a congested intersection.
    Any part of the vehicle which crosses the line when the lights have turned red will trigger.
    When you see yellow it also means stop and it lasts for a minimum of 4 seconds.

    These posts should just be banned. I got caught and now can anyone sympathise with me or tell me if I can get off the fine.

  • I had pretty much the same problem. My red light duration was only 0.4 seconds, the light had changed whist following a queue of traffic into an intersection on a yellow light. I wrote in and asked for section 10 waiver. As I hadn't had any fines in years and a clean record it was waived. My lucky day.

      S10 would mean you went to court.

      If it was through the SDRO, it would have been based on your driving record, but as of June last year, RED light is now considered serious and leniency cannot be offered.

  • My opinion is that you should not have run the light as if it was yellow for 4 seconds that is plenty of time to stop even if you were behind a slow car.

    You really don't have a leg to stand on, I'm surprised you would even ask this question.

    There seems to be quite a bit of referencing as to where the front wheels of the car were on red on this post. I believe it has nothing to do with front wheels crossing the unbroken line at the lights but when the car crosses that line. The road sensors are basically metal detectors so that flash will trigger when the first part of the car made of metal crosses the line.

  • The red Commodore was stopped, the blue car, the black car, the white van, white ute, all stopped.
    but the gray BMW drives through. Fine!

      Have another look, there is a car turnin right across the intersection and there is another car turning left ahead of the BMW. Looks like it was a green left arrow only.

    I got caught there as well!!!! That camera is spot on! ALOT of people get caught there!!!!

    I've only witnessed 2 other people getting caught in that lane. I wonder how many other people got caught too.
