    • I’d say you could a refund if that’s the case as it states the origin is Australia.

      • Origin could be where they are sent from, not where they are made.

          There is no way for them legally claim that the country of origin is Australia and have them made in China. It would have to have to be China, even if it was packaged in Australia.

            @DogGunn: Origin is not a protected word so if they were made in China and sent form Australia you could say

            Made in China
            Origin: Australia

            Country of origin is not the same as origin.

                Would mean they would take a few weeks to arrive compared to ones sent from Australia.

                • @spaceflight: It would be misleading conduct under the Australian Consumer Law to suggest that the origin of a food product is X, but manufacturing is Y due to the country of origin food standards.

                  If it's being sold by Amazon-AU, it's stored in their Australian warehouse, so it's not coming from anywhere but Australia.

                    So you can say a product is made in Y (which complies with the standard) and that it's origin (where it is sent from) is X

                    Origin X is not a statement under the country of origin food standards. It could be used to tell you where the product is being sent from.

                    • @spaceflight: You've missed that I suggested it would be misleading to use the term origin because the country of origin food standards exist, not because they use a protected term within the standard.

                      From the ACCC on this matter:

                      Businesses must be careful when making claims about their products to ensure that they are accurate
                      and truthful

                      Under the ACL, it is unlawful for a business to:
                      • engage in conduct that is misleading or deceptive, or likely to mislead or deceive
                      • make a representation that is false or misleading, including about the origin of goods.
                      Businesses should be aware that if they comply with the Standard, but make false or misleading country of origin claims elsewhere on their packaging or in relation to their food product they are likely to contravene the ACL

                        When buying from an online store it is not misleading to tell a someone where a product is made and where it is being sent from.

                        Is "actuate and truthful" for a product that is being sent from the USA but was made in China.

                        • @spaceflight: Amazon are not sending the product from the USA though (or anywhere else but Australia), which is why it could amount to misleading conduct if the product is actually made in China.

                          I do get what you're suggesting, but considering that the pictures say it is Made in Australia, and Origin: Australia, it would be misleading if it is suddenly China.

      • I'd rather avoid as well, but this one is from Australia is the label is to be believed. Some are Australian others are from China. According to Woolworths, it can be either.
