$50 Rebate Promotion Terms & Conditions

Merchant Offer Terms and Conditions

To be eligible to receive the $50 Rebate you must register an American Express Card issued by American Express Australia Limited or by a licensed third party bank issuer of American Express branded Cards between 00:01 AEST 1 August 2011 and 23:59 AEST 30 September 2011 at amexnetwork.com.au/home.

American Express Business Travel Accounts, Government Cards or Corporate Purchasing Cards, are not eligible for this offer. Participation is limited to the first 7,500 Cardmembers who register.

Once registered, you must spend at least $250 in one or more transactions at one or more of the participating retailers (in store or online) no later than 23:59 AEDT on 30 September 2011. Participating retailers are listed on amexnetwork.com.au/home.

Limit of one $50 Rebate per Cardmember. Cardmembers may only register one Card for this offer. Only transactions made on the Card registered for the offer are eligible. Transactions made on another Card account or a supplementary Card with a different Card number are not eligible.

For American Express Cards issued by American Express Australia Limited, the $50 Rebate will be credited to your registered Card Account as a statement credit. Please allow approximately 4-6 weeks from the end of the promotion period for the $50 Rebate to be credited to your account.

For American Express Cards issued by the various Licensed Network Partners of American Express Australia Limited, the $50 Rebate will be issued in the form of an Australia Post Money Order and will be mailed approximately 4 to 6 weeks from the end of the promotion period to the address provided on this registration form. Redemption of the Australia Post Money Order is subject to the terms and conditions of Australia Post. Please visit www.auspost.com.au for more information. Australia Post Money Order rebate is not available for American Express Issued Cards.

If due to reasons beyond the control of the Promoter, the $50 Rebate is not able to be supplied, the Promoter reserves the right to substitute the $50 Rebate with an alternative item of similar value at its discretion without prior notice.

Please carefully read the following Terms and Conditions (the “Agreement”) before registering for the Merchant Offer(s) (as defined below) provided on this registration page (the “Registration Page”). By registering for the Merchant Offer, you have entered into a legally binding agreement with American Express Australia Limited and its affiliates (collectively, “American Express”, “we” or “us”). If you do not agree with the Terms and Conditions of this agreement, go to return to the American Express Network website. The Merchant Offer is provided to only those eligible Cardmembers (as defined in the Merchant Offer Terms) who agree to be bound by the Terms and Conditions of this agreement.

A. General

The Merchant Offer (as defined below) is provided by American Express Australia Limited (“American Express”) through a computer having access to the Internet ("Computer").

B. Eligibility and Registration

Eligibility. To redeem the offer set forth on this Registration Page (the “Merchant Offer”), you must be 18 years or older, a holder of a valid consumer American Express Charge or Credit Card issued in Australia either by American Express or by a licensed third party bank issuer of American Express-branded Cards (“Licensed Issuers”) and you must have received an invitation to register for the Merchant Offer (an “Eligible Cardmember”). Eligible Cardmembers must comply with this Agreement and with the Merchant Offer Terms to receive the Merchant Offer.
Registration. Eligible Cardmembers must register an Eligible Card for the Merchant Offer on this registration page (the “Registration Page”) pursuant to the Merchant Offer Terms. An “Eligible Card” is defined as a valid consumer American Express Credit or Charge Card, in good standing, issued in Australia either by American Express or by a Licensed Issuer. Certain American Express Cards, including but not limited to, Corporate Cards, are not considered Eligible Cards. You may register only one Eligible Card for the Merchant Offer. The Eligible Card that you register for the Merchant Offer is referred to as the “Registered Card”. If you have any problems with your registration, please contact the customer service number on the back of the Eligible Card you wish to register before making any Eligible Transaction(s) (as defined below).

C. Merchant Offer Redemption

To redeem the Merchant Offer, you must comply with all of the Merchant Offer Terms, which includes, but is not limited to, completing the eligible transaction(s) (the “Eligible Transaction”). Your Eligible Transaction(s) must be charged in full to the Registered Card. Transactions made on another Card account or transactions made on a supplementary Card with different Card account number are not considered Eligible Transactions. The Merchant Offer is only valid during the times and on the conditions specified in the Merchant Offer Terms. If you have successfully complied with the Merchant Offer Terms, you will be mailed the voucher in accordance with the Merchant Offer Terms.

American Express will send you the voucher and this voucher shall be subject to additional terms and conditions as stated in the Merchant Offer Terms.

D. Additional Offer Terms

The following Terms and Conditions apply to every Merchant Offer, unless otherwise specified in the Merchant Offer Terms: subject to availability; Merchant Offer can only be redeemed by following the redemption instructions included with the Merchant Offer (either via email or direct mail); Merchant Offer cannot be combined with other promotions or offers: Merchant Offer not valid on vouchers, voucher certificates, or prior purchases. Other restrictions may apply. Void where prohibited. No substitutions or transfers will be allowed.

E. Availability/Interruption

You acknowledge and agree that we are not responsible for performance degradation, service interruption, or delays due to conditions on the Internet or due to any error or malfunction of the Equipment or System. You acknowledge that American Express, ISP and Service Providers shall not be liable to you if the Merchant Offer or this Registration Page is unavailable, interrupted or suspended for any reason. If the Merchant Offer or this Registration Page is not available, interrupted or suspended, you agree that your sole remedy shall be to terminate this Agreement. "Equipment" means the Computer and active internet connection through which you intend to access the Merchant Offer and use the Registration Page. "System" means the hardware and software owned or operated by American Express, an Internet Service Provider (“ISP”), or any third-party service provider engaged by American Express to facilitate or administer the Merchant Offer or this Registration Page (“Service Provider”).

The Merchant Offer is available only on this Registration Page and cannot be accessed by any other means. American Express reserves the right to suspend or cancel any Merchant Offer or other sales transaction if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Merchant Offer or of this Registration Page, as determined by American Express at any time and in its sole discretion. In the event the Merchant Offer or this Registration Page is modified, suspended or terminated, American Express will provide notice thereof on this Registration Page. American Express is not responsible for any computer virus or damage caused to a Cardmember's computer by accessing the website.

F. Fees

American Express does not charge any fees for receiving the Merchant Offer.

G. Privacy and Security

Any information provided to American Express by you in connection with the Merchant Offer (e.g., information submitted during registration) shall be governed by the American Express Privacy Policy available at www.amexnetwork.com.au/privacy.html. The American Express Privacy Policy Statement sets out policies on the management of personal information. To arrange access to your personal information, request a copy of the American Express Privacy Policy Statement or enquire generally about privacy matters, write to American Express. The Eligible Cardmember agrees that subject to the Privacy Act, American Express or their agents may do the following:

  • Transfer or disclose personal information confidentially to American Express, its related companies or external organisations that provide services in relation to the Merchant Offer. This includes transferring personal information to the USA or other countries for data processing and servicing;
  • Request verification of Eligible Cardmembers’ account status and/or personal information from the American Express Licensed Network Partners;
  • American Express reserves the right to interrupt, restrict, disqualify or terminate your eligibility or receipt of the Merchant Offer without cause and without notice to you. You agree to immediately notify us if you suspect fraudulent or abusive activity. If you so notify us or we otherwise suspect fraudulent or abusive activity, you agree to cooperate with us in any fraud investigation and to use any fraud prevention measures we prescribe. Your failure to cooperate or to use such measures will result in your liability for all fraudulent usage or abusive activity associated with the Equipment or your Registered Card(s).

American Express reserves the right, at its sole discretion, to disqualify any individual suspected of tampering with any aspect of the Merchant Offer or this Registration Page or any other current or prior program made available by American Express. American Express also reserves the right, at its sole discretion, to disqualify any individual that it believes may tamper with the Merchant Offer or this Registration Page or that it believes to be acting in any manner deemed by American Express in its sole discretion to be improper or disruptive or with intent to annoy, abuse, threaten, or harass any other person. Caution: Any attempt by a user or any other individual to deliberately damage any website or undermine the legitimate operation of the Merchant Offer and/or a sale is a violation of criminal and civil laws and should such an attempt be made, American Express reserves the right to seek damages and costs (including, without limitation, attorneys’ fees) from any such person to the fullest extent permitted by law.

H. Changes to this Agreement

We may change or modify this Agreement, including the Merchant Offer, from time to time by posting such change or modification on this Registration Page. If you use or continue to use the Merchant Offer following the effective date of such change, you agree to such change and its applicability to you.

I. Limitations on Liability

By registering for the Merchant Offer, you acknowledge that technical processing and transmission of information to and from this Registration Page, including the information you may enter, may involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices.

American Express, its Licensed Issuers, agencies, participating merchants, its Service Providers, and any ISPs are not responsible for: (1) any incorrect or inaccurate information, whether caused by card holders, printing, typographical or other errors or by any of the equipment or programming associated with or utilised in the Merchant Offer; (2) any transmission delays, interruptions, omissions, deletions, defects, delays or failures of any kind, including, but not limited to, system malfunctions, performance degradation, service interruptions, or disconnections or disruption in phone lines, network hardware or software or Internet connectivity; (3) unauthorised human intervention in any part of the purchase process or the Merchant Offer; or (4) computer, mechanical, technical, printing, typographical, technical or non-technical, or human or other errors or omissions which may occur in connection with the administration of the Merchant Offer or of this Registration Page or the processing of the registration. You acknowledge that American Express, its Licensed Issuers, agencies, participating merchants, and Service Providers, and ISPs, shall not be liable to you if the Merchant Offer or if this Registration Page is unavailable, interrupted or suspended for any reason. If the Merchant Offer or if this Registration Page is not available, interrupted or suspended, you agree that your sole remedy shall be to terminate your participation in the Merchant Offer.

American Express specifically disclaims any responsibility for any equipment, service interruptions, computer hardware and software, Merchant Offers, transactions, and goods and services advertised in conjunction with any Merchant Offers. You agree that your participation in the Merchant Offer, access to and registration on this registration page, and use of any products, services, or offers obtained in connection with the Merchant Offer are at your sole risk. The Merchant Offers and this registration page are provided on an “as is” and an “as available” basis. American Express specifically disclaims any warranty regarding any goods and services advertised in conjunction with the Merchant Offer, and disclaims any implied warranty, including any warranties of merchantability or fitness for a particular purpose.

Cardmembers agree to this Agreement, and on their behalf, and on behalf of their respective heirs, executors, administrators, legal representatives, successors and assigns (the “Releasing Parties”), release, defend and hold harmless American Express and its Licensed Issuers, agencies, participating merchants, and Service Providers, and ISPs, as well as the employees, officers, directors and agents of each (the “Released Parties”), from any and all actions, causes of action, suits, debts, dues, sums of money, accounts, reckonings, bonds, bills, specialties, covenants, contracts, controversies, agreements, promises, variances, trespasses, lost profits, indirect or direct damages, consequential damages, incidental damages, punitive or exemplary damages, judgments, extent, executions, claims and demands whatsoever, in law, admiralty or equity, whether known or unknown, foreseen or unforeseen, against the Released Parties which any one or more of the Releasing Parties ever had, now have or hereafter can, shall or may have which in any way arise out of or result from the Cardmember’s participation in the Merchant Offer. Cardmembers assume all liability for any injury, including, but not limited to, death or damage caused or claimed to be caused, by participation in the Merchant Offer or use of any product, service, or offer purchased or received in the Merchant Offer.

This paragraph shall survive termination of this Agreement.

J. Equipment Requirements

In order to print this Agreement and any other notices from American Express, you must have a personal computer equipped with a 128-bit JavaScript-enabled browser and Internet access and connected printer.

K. No Amendment of Existing Terms and Conditions For Cards

The Terms and Conditions of this agreement and the Merchant Offer Terms do not amend, supplement, change or replace any other notice or information that you may receive in connection with your Card Account, including, but not limited to, any information provided to you on your periodic statement or the agreement governing your Card Account (“Cardmember Agreement”). If you have any questions or concerns about your Card Account or the status of your Card Account, you should call the number provided on the back of your Card or use the online Customer Support available at your Card Issuer’s website.

L. Dispute Resolution

Cardmembers hereby agree that any and all disputes, claims, causes of action, or controversies (“Claims”) arising out of or in connection with the Merchant Offer or this Agreement shall be handled in accordance with the dispute resolution provisions of your Cardmember Agreement. Dispute resolution under the Merchant Offer is subject to the arbitration provisions in your Cardmember Agreement.

This paragraph shall survive termination of this Agreement.

M. Assignment

We may assign or delegate all or part of American Express’s rights or duties under this Agreement without such assignment or delegation being considered a change to this Agreement, and without notice to you. You may not assign this Agreement, or delegate any of your duties hereunder, without American Express’s prior written consent, and any assignment or delegation by you in breach of the terms hereof shall be null and void ab initio.

N. Entire Agreement

This Agreement represents the entire understanding between you and American Express with respect to the Merchant Offer, and may only be amended as described in this Agreement. No waiver by us of any breach of any term or condition of this Agreement will constitute a waiver of, or consent to, any subsequent breach of the same or any other term or condition of this Agreement. If any part of this Agreement is found to be void and unenforceable, it will not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms. The failure to enforce any term of this Agreement on one occasion shall not prevent enforcement on any other occasion or the enforcement of any other term. Headings and captions shall not be considered included for purposes of interpretation or application hereof, but are for convenience only.

        I unexpectedly received $50 in my AMEX after buying a modem at Dick Smith a month back which I subsequently returned because I found I could get the same thing elsewhere for less, even after the $50 rebate from AMEX.

    • Normally any kind of spend is valid, even though it may be excluded on the T+Cs. You should be fine

    Another option may be to go to BigW and buy $250 worth of wish cards. Valid for fuel purchases as well as at dan murphys :) Its excluded in the T&C's but I very much doubt they have the IT systems in place to check.

    Amex would be running a SQL Report over their transaction database for each registered user and simply matching up the merchant ID's and amounts. Amex probably can't even tell that the purchase was for a gift card.

    • yup, no way they can trace what u buy, 7500 registered member * items per invoice, and i don't believe the retailer will passed the what the customer buy to amex.

      if stock opened purchase same stock in store and return them using the old receipt… ( maybe udeal to first return the stock in case Amex SQL's look for returns too..)

      • I can't fault you on your strategy … it sounds great. Problem is, the purchases are two heavy storage boxes. Too much work lugging them back to the car and back to the shop (and possibly incurring additional parking charges). Then lugging them home, etc. But great idea! :) I will keep it in mind for future purchases. I have signed up anyway - probably easy to spend $250. I can just buy a bunch of Telstra Prepaid recharge vouchers in advance. :)

        Say if we make purchase on 30th Sept then cancelled transaction after that, do u think Amex' s tracking system will find out cancellation after time of closing their cashback program ?

    Always wonder if you could register the main card and a supplementary card and take advantage of the $50 on both cards or is it one $50 per account

    EDIT: FYI, I just received $100 (2x 50) for the previous electronic offer - Main card + Sup card so I suppose this answered my question above :) hope this helps

        Amelyn - I read that as meaning that if you register one card, only transactions on THAT card count (or other accounts or supplementary cards won't apply), but not that supplementary cards can't register at all. It's a grey area, but if he managed to get cashbacks both on his primary and secondary cards than that ought to mean that if you register both, you CAN get two cashbacks.

        • haven't tried that before myself. Technically, supplementary card holders aren't Amex cardmembers, are they? Would be nice to get two cashbacks.

        • I suppose they are because it is a different card with different card number all together. If anything I received 2 cashbacks on the last promotion.

          But again… its not that clear on the T&C

      this might clear it up a little.

      I received 2 lot of $50 in my account from the previous offer that had a similar T&C. PER CARDMEMBER not PER ACCOUNT so if you have 10 sup cards in your account you are able to sign each and every one of the supplementary card.

        • They have lots of T+Cs that they don't seem to follow. Seems a few people got the $50 last time for each supp card that was registered, and many people got the money just for buying a gift card, which was specifically excluded.

          I wouldn't go out of my way to spend an extra $250 just to find out, but if you shop a lot at big W and Woolworths anyway then you're just bringing the expenditure forward a bit.

        • If you spend 2 second reading the comments before you will find that it looks very silly to quote the EXACT SAME clause as the poster above,

          All that aside, lets say "CARD 1" is main card holder and "CARD 2" is the supplementary card

          1. If you've registered CARD 1 on amexnetwork, don't expect to get your $50 if you make an eligible purchase on CARD 2

          2. However, if you've registered CARD 1 and CARD 2 on amexnetwork. You will most probably get the $50 rebate if you spend $250 on EACH card.

          If that still confuses then I suppose just don't bother :)

      • What they mean is, if you have two cards in your own personal name you can't use both. Only one.

        Supplementary cards are obviously in a different name, so they're fine.

      past experience has been that you don't need an invitation for these sorts of offers. Also you can sucesfully register without the invitation.

    • The T&C's clearly states that they will credit the $50 between 4 & 6 weeks after the promo ended. So counting from 30 June, the 6th week deadline is on the 11th of August. I was lucky got mine on the 4th week.

      • I purchased a GPS from BingLee on 30th June 2011, and still think it is eligible. However, once I check the statement, it shows the transaction on 1st July 2011.
        I wonder if I will get the cash back? ( Cash back was the reason why I bought the GPS- I already had a GPS, which incidentally works better than this "new" nüvi 2360LT).
        I have a receipt for 30th June 2011 at around 3PM on the day.
        It is not my fault if the merchant charged me a day later. Is there a way to contact American Express?

  • I had a quick look at AMEX cards, they have annual fee and large interest rates. What is the way to minimise costs of using the card to get these savings.
    I'm a uni student without a lot of money and do not want to be owing credit card companies money. help would be appreciated.

      umm.. only spend the money you actually have?

    • make sure you have money to pay for your expenses, then pay off your credit card even before the money is due. Ozbargainers know that, unlike popular belief, credit cards are not for people who spend beyond their means.

      1) get (if possible) a commonwealth bank awards card with visa/master and AMEX! and they will weave off the annual fee if you are a student (i had to call them every year to get the annual fee refunded)! so you get the awards benefit without paying annual fee!

      2) BMW AMEX gold card! no annual fee, will get award points but no gold card benefits like travel insurance

      interest rates are high ( about 20%) so payoff every month!

      first option is better coz you get visa/master which is accepted widely!

      • Qantas discovery card also has no annual fee. You get points for every dollar. Spend only money you already have, not money you have yet to have.

      • Are you sure that we can do that with the commbank visa/master & Amex Awards? I don't think there's a policy for them to waive the Awards cards annual fee for students. They do have a free annual fee card especially designed for students but these don't provide awards.

        • I worked for me and my friend for the last few years! And hope it stays the same for few more years at least (until i finish my studies :p)!

          If you have one of these cards, give them a call just a day after they charge ya the annual fee ($68 i guess). They will refund ya!!

  • I have an Amex from the Law Society of NSW. I wonder if that qualifies as one of the eligible amex cards on their list?

    It's not a coporate card, or company issued card, it's just an amex with law society of nsw wording on it.
