      Interesting you say the grey is ugly. It's subjective of course, but I personally think the grey one is ugly. If Nintendo chose a grey that was much lighter than I think I would have liked it more.

    Full RRP plus Kogan has refused to honor warranty for me recently as item was 1 month out of warranty period. They don't believe in the Consumer Guarantees even though they are law.

    Ruslan Kogan has been on Gerry Harveys back for years, but with Ruslans price-gouging he should be ashamed of himself. Selling a $197 freezer for $1200…
    The reason he doesn't go around bagging Gerry anymore is that he has sunk so low and doesn't want to be called out for his shonkyiness.

      They cant avoid Australian Consumer Laws regardless of their T&C's, if your item is within a reasonable use period for the money you paid and the fault is genuine they must take appropriate steps to remedy. It'll just cost you a piece of your sanity.

        Yeah, they did though. They have said that they only provide a 12 month warranty, strictly and make no exceptions. However, they did suggest I try turning the powerpoint off/on to see if it rectifies the issue.

          They are unequivocally incorrect, but that doesn't necessarily mean you're entitled to a repair/replacement/refund.

          The ACCC on warranties specifically states:

          "The consumer guarantees which apply regardless of any warranties suppliers sell or give to you, apply for a reasonable time depending on the nature of the goods or services. This means consumer guarantees may continue to apply after the time period for the warranty has expired."

          So the actual "warranty period" is at a minimum what they offer (12 months in this case), but is a grey area beyond that. For example — it's reasonable to assume a cheap toaster may only last a year, but it's expected that a freezer would last at least few years. Also worth noting that the determination is based on the product, not what you paid for it.

          If they don't want to help, you can:
          * Report a consumer issue with the ACCC.
          * Make a complaint with Fair Trading / Consumer Affairs.
          ** NSW.
          ** QLD.
          ** VIC.
          ** ACT.
          ** WA.
          ** SA.
          ** NT.
          ** TAS
          * Request a Small Claims tribunal (a fee may be applicable).

          With regards to Harvey Norman specifically — their franchisees, 2ICs, and Service Managers will all have received training on ACCC Consumer Rights. Regular sales people may not be aware due to high staff turnover, or the managers are telling them to repeat the "12 month" mantra unless pressed. If you log a complaint with their CustomerFirst department through the Contact Us page, the stores have a KPI to respond within 24hours. You'll know the case is closed when you receive an email survey. If you receive the survey before the issue is resolved, re-lodge the complaint so it flags with their head office, and inform them you're beginnning the escalation process. Harvey Norman are dinosaurs of the retail world, and will try to bully consumers to offset the many "Gerry taxes". And before anyone asks — I don't work there, but I went through this process last week (they gave me a refund as soon as I started quoting the ACCC). Any retailer will want to avoid these escalations, as enough complaints will prompt an ACCC investigation.

          The more often retailers get away with these practices, the more acceptable it becomes for consumers to get screwed over.
