Man Chasing Teens Who Stole His Car Charged Multiple Times

3 teens stole a car, and the owner chases them in another car ( probably second car )

Now it seems he gets charged "The man has been charged with Dangerous driving occasioning death – drive manner dangerous, Dangerous driving occasioning grievous bodily harm – drive manner dangerous and Negligent driving (occasioning death)."

Why is it now his fault, when the teens stole his car, and smashed into a pole ?

I heard from my son, that some kids, on L plates ( of course not displaying them ) get a thrill by driving 100km/h on straight roads ( don't think highways )

I also know of another kid, that has been caught driving his parents car with friends without having a license ( not even a learner one ), who got away with not even a warning.

Does that mean that you better not chase the thieves ?

Why is the police so lenient with Kids and Cars ?

    Hopefully he is found guilty / or pleads guilty on lesser charges but in terms of occasioning death etc, hope he gets aquitted.

    This reminds me about 15 years ago about a security guard who shot dead an armed robber, where she was acquitted on the murder charges. That security lady needs a medal imo.

    Look on the bright side at least two of the three thieving lowlife's wont be committing any more crime.

    Feel very sorry though for the poor car owner charged over this .

    We seem to excuse the behaviour of criminals … just waiting for the bleading heart stories of how good those thieving bloody darlings were..?…

  • Lols i remember back in 05 some kids stole a car and took it on a high speed police chase through a houso area, driver ended up wrapping the car around a tree and killing his two passengers, that culminated into the Macquarie Fields Riots. Funny enough the previous year to that some kid got himself impaled on a high fence and died cause he saw a patrolling police cruiser and decided to bolt, that too culminated into the Redfern riots, pretty much that period was like 2020 for Australian Law Enforcement.

    • I've seen that fence post. It's painted black. It's not high. The issue that may never be agreed upon is whether police clipped his bike or not. I'm agnostic.

  • Maybe when he calls the police next time, he could lie that someone stole his car with his daughter inside so cops would actually give a damn.

    • Maybe in this case the cops showed reckless disregard for life by not catching them before they caused too much danger, and are therefore culpable through inaction?

    Sometimes I think we need to remove problematic teens from their households, before their terrible behaviour escalates to the point of criminal activity that will get them charged or killed. Teachers could flag problem kids and if the parents aren't willing to work with the school on improving the kid's behaviour, they are removed and shipped off to boarding school. Maybe a farm or military one, something that gets them doing physical work alongside academia, and builds character and skills for their futures. I think a lot of kids could be turned around if they were given a chance, but not while they're living with terrible parents who neglect them, abuse them, or teach them poor behaviour.

    I think parents who are legitimately trying but just have trouble controlling their kids would see the benefits of these sorts of programs and volunteer their kids for them as well. It would be worth subsidising too, because it should reduce future crime rates and it would really help kids in need. The terrible parents would complain about their kids being stolen though. It's no coincidence that most bad kids have bad parents, it's literally where they get it from.

    I have no idea who the parents of the teens in this story are, but I would be very surprised if they are decent people. Good parents don't tend to raise kids who steal cars.

    There is nothing wrong with stealing cars in Australia, you cannot just chase them to their deaths

    Cars are worth much, much less than criminal lives, so basically you will be charged

    The rights of the teens have been violated, and the law needs to step in and punish this unlawful chaser

    Make sure no one will attempt this kind of stunt again!

    The law is the law and nobody is above the law, not even Berejilian or Palaschuk

      i also think its funny how the media plays up how the owner of the car… an ethnic gentlemen could have caused something bad but neglect to mention that they two kids instigated this and were ultimately responsible for anything that happens after

      Wow. Guy who followed is treated as bad guy here though he might be wrong if he was tailgating. How media is saying guy was tailgating and not accused of tailgating. Teenagers are advised to be accused of stealing.

        • I think you have to be realistic about this kind of thing. If you own a Commodore V8 or something like that (ie. turbo Falcon, Japanese import) then you're likely to be driving it in a 'spirited manner'.

          I dont doubt the owner has a colourful driving record but that should not count into his case UNLESS he actually made contact with the offending car.

    That commodore was probably the poor guy's pride and joy, he even had a personalised number plate on it. I don't think he was intending the car to crash. He didn't premeditate to chase them, he probably just did it in heat of the moment. Kids stole it for a joy ride, which involves speeding, driving the car recklessly, crashing, and maybe burning the car in the end. I don't think, they were planning to follow the speed limit and road rules, IMO anyway.
    I hope he gets a favorable outcome from the courts.

    There is something seriously wrong with youth law and order in this country and it needs to change.

    You can't expect troubled teens from broken homes to not repeatedly offend when there is literally zero consequences for their actions. Why shouldn't they steal a car or break into peoples houses?

  • The government doesn't want you taking the law into your own hands.

    That's why, they make examples out of people like this, regardless if it's fair or not.

    It is to deter other people from doing the same thing should they find themselves in the same situation.

    The Campbelltown local court list had Mazen Kabbara shown on the 3rd August 2021 for "LC Sentence".

    I assume that this means that he has been found guilty of something and this was where they told him what his sentence would be.

    I am not sure what happens with the publishing of court outcomes, but I am guessing that at some point it will be available to read online and find out exactly what happened (unless it gets sealed due to some of the people involved being under age).

    • The court case reference is: R v MAZEN KABBARA, 2020/00312010 and was on the 28/7/21.

      I really want to know more about what happened with this one. Was it a full blown trial court case, or was it just pleaded down to lesser charges? I would pay for transcripts of what has transpired.

        • I got a feeling that since it went from committal to sentencing so quickly, it suggests that it’s a plead out. I dont know if it will end up on caselaw if the driver plead guilty to a lesser charge.

    • Not on this one, but the Lady who killed 2 kids with the car smashing into the classroom, did not get sentenced to prison.
      I call this "How to get away with murder" or better "double murder".

  • There are two questions here. The first one is, should a driver chasing another car in a threatening manner be charged. The second question is, would the fact that he’s chasing thieves make it OK?

    I’m going to say that the answer to the first is yes, obviously. We don’t want people doing that precisely because it can potentially lead to their targets fleeing and injuring themselves or others, quite apart from the chances of the pursuer themselves injuring people. This is rightly very illegal.

    So the second question is, should the circumstances make a difference. And I have to say that I don’t think so. We’re not talking about someone chasing a thief on foot — a legal act, even if the thief slips and falls. I don’t know what the vehicle owner thought he was going to achieve, but motive is very rarely a justification for otherwise illegal acts. It sucks that he’s probably going to face serious consequences for a bad decision taken under very trying circumstances, but there it is.

      i cant imagine spending actual prison time for this but hey… if they want to piss away $60,000 a year on the public purse you may as well

    two things to note: kabbara collided with the Commodore several times, i think this has an impact on his sentence

    also:

    Magistrate George Breton today said it "was a senseless tragedy".

    "It has, I have no doubt, impacted gravely on the lives of so many others," he said.

    "Their loss is a loss for us all … two boys whose potential has been extinguished.

    "I pass on my sincere condolences to the family."

    this guy i think is over estimating the worth of the two dead thieves….

    • At the intersection of Cowpasture Road and Horsley drive, the court was told, Kabbara had backed off the Commodore when the teenagers entered the roundabout at 150kph.

      I think entering a roundabout at 150kph was likely the biggest contributing factor in the crash (though, the question will remain as to what speed they would've done if he had not chased them earlier)…

      • i think they alluded to the fact that the two perps would have had an absolute string of charges and would have served time… had they not expired that day

        you cant charge dead people but you can charge the guy still alive

        ALSO this court like others here seem to absolve younger folks of responsibility if they seem to be pushed into doing something by someone else who they think "should know better".
