      If Product Review is like Google reviews it will be 'cleaned up' in a few days to remove all bad experiences related to the AO code. That's what happened with all the St Ali comments about their 'free' RATS offer. Cannot trust the ratings on these review site as they are highly moderated.

    I might have let this one go through to the keeper but the reference to "fraud" in the cancellation emails has left a very bitter taste. None of us have done anything wrong; the implication flowing from that word's use is offensive.

    Even worse, and rather hypocritically, Quay HAS done something wrong.

    I have looked into the circumstances by which we all sought to purchase sunglasses from Quay. In my view, each of us has a binding contract for the sale / purchase of the relevant product(s), which Quay is unable to 'cancel' or otherwise extricate itself from. As a matter of principle, I intend to sue Quay for the loss I have suffered, that being the value of the sunglasses that should have been delivered to me pursuant to my contract with them, but which now will not be delivered. (There are tribunals in each state of Australia designed for the quick and easy pursuit of small consumer disputes like this; they are generally called the "Civil and Administrative Tribunal". See eg https://www.vcat.vic.gov.au/ ).

    I have set up an email address to exchange correspondence on this topic with other OzBargainers. Anyone who would like to be kept apprised of the progress of my lawsuit, please email me at [email protected]. Please include in your email the number of pairs of sunglasses you purchased, but which purchases have purportedly been 'cancelled'. If and when my lawsuit succeeds, I would be pleased to provide to those people who have contacted me guidance on how to pursue your own claims. For absolute clarity, that will not be legal advice; this comment is not legal advice; I will not ever be providing anyone with legal advice.

    Oh, also. The chairman of Elevate Brandparters (which is the private equity owner of Quay) is Myles McCormick. Myles is available at [email protected].

    • Are you being serious, c’mon man, we all knew deep down that the order wouldn’t be fulfilled. Yes, it is a mistake to call us a bunch of fraudsters but I don’t think you should waste any more time on them.

      The fact they didn't even apologise, or give some sort of explanation is poor. No I didn't expect the product, yes they they need to tighten their processes and not waste people's time, for them it ended up being a free way to retrieve our personal details, so at the very least, "would you like to us to delete all of your personal data?" would of been much appreciated.

    • Lol what. This is too far. For one theres usually a fee attached to tribunal applications which is likely to be about the same or possibly more than a pair of glasses depending on how it plays out. Plus your time drafting submission and responding etc. Don't waste your time.

      Plus arguably you have sustained no loss other than 5 minutes of your time signing up and emailing to ask for data deletion. Whilst consideration is no longer strictly required in contract law, it is still influencial and we didn't give any quid for the quo.

          I'll admit contracts law is very much in the rear view mirror for me but your time loss is all of 5 minutes. So I'm not sure what damages you think you've sustained. Even if you make $1000 an hour the fair compensation for your lost time is going to be about the same cost as that of making an application.

          Unless you've submitted hundred of orders and was planning on on-selling the sunnies and you're trying to claim reliance or something. Which I think even Ozbargainers will think is a bit much.

            Per Amann Aviation:

            “The general principle governing the assessment of compensatory damages in both contract and tort is that the plaintiff should receive the monetary sum which, so far as money can, represents fair and adequate compensation for the loss or injury sustained by reason of the defendant’s wrongful conduct.”

            In contract, the court seeks to place the successful plaintiff in the position they would have been in if the breach had not occurred. What position would I have been in if they hadn't breached - ie, if they had performed? I'd have sunglasses worth $XXX, ergo my damages entitlement is $XXX.

            My "time loss" is completely, utterly, absolutely irrelevant.

            PLEASE tell me you're not a lawyer. I won't sleep thinking someone as incompetent as this might have a ticket.

              But even per your own cited case, the remedy is to restore your position. The sunglasses at the top end are about $100-120. Take off your tribual fees and time. Yea maybe you need to learn simple arithmetics or cost/benefit assessment.

                  @dwarves: Do you have any examples of cases that are more relevant and representable to this Quay situation? Price errors, cancelling online transactions in retail/online shopping happens all the time, shouldnt be difficult to find and help others here, since you're a lawyer?

                    @Ughhh: If you read my initial post above, you'll see I've offered to provide (non-legal) assistance to anyone wishing to pursue a claim. I have already filed my own claim; I'm currently waiting on the tribunal to provide a stamped copy for service.

    • I get you are disappointed. I am too. But it was a long shot that this was going to work out. No company, especially no new company, can afford to give away product, even more so a product with a normal price of $65-85 per unit, for nothing.

      It was all but inevitable that these orders were going to be cancelled.

      Did they stuff up in how they communicated the situation - their error in how they set up the code, and then their attempt to pull back from bankrupcy by cancelling the orders? Yes, definitely.

      But is it worth pursuing them with a lawsuit?

      No. Not at all. Not unless your life is so empty that you feel the need to squeeze out a small startup in a market which is already difficult to get into.

      You know what happens when you unrealistically hold smaller companies like this to offers which are obviously errors? They close. Or they simply stop offering discounts. If the potential benefits of attracting new customers with a discount is outweighed by petty customers trying to get something for nothing, then they'll just sell products at the marked price, or with BOGOF offers like the one they are running now, and they'll be done with it.

      They made a mistake. Why do you feel the need to crush them for it?

      • Small company WUT? PE bought this business in two stages, completing a full buyout last year. The vendors made out like bandits. Quay has >100 employees and its products are sold in >2000 retailers. This isn’t a mom and pop shoestring operation. Your bleeding heart needs to go look for other sob stories, because this ain’t one.

        • Quay is owned by Summit Partners, an investment firm that manages over Au$60b. Wouldn't really consider it a small startup

  • They could’ve made a joke of the whole situation and just given a $5 off discount code or whatever and I believe they could’ve made some sales.

  • Hold up. I know everyone has given the guy above crap about the lawsuit lol.

    Look at their Instagram though, they posted two hours ago and showed off the “spin to win” thing at the Australian Open. I took a screenshot and did a couple of different spins. It only lands on 15%off atm but the free thing is still there? They should honour this then right? They’re still promoting it.

    Edit: ok when landing on free it says, “show the quay staff a screenshot to redeem, cannot be redeemed at a later date”

  • Omg i actually received my pair. Ordered two pairs for me and my partner. I got cancellation emails and she didnt. Her order was the one that came in.
