Domayne - Do I Have The Right to Cancel Mattress Order

I went in a couple times to try some mattresses. As I walked in the Tempur range was upfront and sales guy (who proudly claims he's been selling there for 14 years) introduced them.

The first visit I was quite confused with the range because of the naming conventions and they way the tickets named them also. There were some in a white cover with yellow lining (the Sensation range) and there were some in a nicer white/grey cover with blue lining (the Pro range). I just couldn't get my head around the difference for a while and the sales guy said "they are the same inside and it's just the cover that's different". Myself and my wife were there.

I did some light research however I couldn't find almost any info on the Sensation range (not on their website when you go through products) but a whole heap of Pro's on the Tempur website. The sales guy (two of them - as the second time another guy standing around tried to help me understand) said it's "because only Domayne sell the range and Tempur can't list on their website since not all retailers can sell it". I thought air enough.

So my basis on what I ended up buying is the description of the mattress technology on the listed Pro range which mentions 20% better pressure relief compared to the Original material. So one would think this is the current range. I ended up buying the Sensation range as it was about 25% cheaper than the Pro range. He mentioned the low price "is because they want to help get more people onto Tempur mattresses".

Just before delivery, I was speaking to someone and I thought more about it and dug deeper about the Sensation range. I find it in some 'left over' style pages within the Tempur website that looks like a removed page (which indicated to me it's likely an old product including the web address is a totally different format to that of products on their current range). I further find articles dating back to 2019.

I also start noticing the use of the term Tempur "Advanced" Material on their product descriptions in the Pro range and don't notice this in a number of articles. I've put 2 and 2 together and conclude that the Sensation range is the older version/range than the improved Pro range with the Pro having new improved technology.

I cancelled the order first thing on delivery morning and delivery wasn't made. I called to cancel and was told I had to talk to the original sales guy (who wasn't in on that day). I go into the store (Domayne QV) the next day (Saturday) and tell the guy I'm cancelling as he told me it's the same thing (when it's clearly not). I said "You told me it's the same mattress but just different cover" and he continuously still tells me it's the "same and it's just marketing and they can put whatever they want".

There's been a few to-ing/fro-ing with emails to their office and a call with the sales guy (who still says they're the same and feels I'm just simply blaming him and not taking responsibility) and ultimately they won't let me cancel the order.

I'm not one to buy an older model of something to save some money. I'd rather buy something else that's current (just like my recent Sony TV). My claim all along is that I've been misled. If I knew they were different and it was the older range, no way that transaction would've occurred.

I'm about to lodge a claim with I think it's ACCC or Consumer Affairs and my card company. I actually don't want to be dealing with Domayne anymore for any future purchases - being misled by a so called experienced sales person and then the complaint process being also handled by the sales guy.

What do you think? Do I have a right to cancel?

    I'm not one to buy an older model of something to save some money. I'd rather buy something else that's current (just like my recent Sony TV).

    This speaks volumes. It's a mattress, not a mobile phone. Most of the stuff they advertise is marketing BS.

        I don't blame OP. 2025 and 2021 was a good year for latex, because of the later onset of spring, their support is more complex and intense.

    • Yes, we toured mattress factories overseas and locally during work as M&A and chemical and foam plants too.
      A lot of the big american companies have everything vertical.

      Most of the mattresses were just a combo of the same 5-7 foams and then the covers would change, especially in the tempur style.

      There are always the plebs that believe the booklets and website pictures like gospel, that's why they make them. Make it premium by doing a premium booklet and a premium store and some moron will always part with their money. The goal was doesn't matter what the original price is, the idea is to make people spend $2000+

    Yes, you have a right to cancel but I think you are blowing it out of proportion. It's quite common for "new releases" to be negligible upgrades from the previous generations eg. Apple and it was 25% from the pro range.

    You will have better luck, if you just want to swap to the newer one and pay the price difference!

      I agree with the above poster. You are partly at fault for not doing your research. It's a he says, she says situation. So try and work out a compromise such as swapping to the newer one and paying the difference.

      BUT before doing that, try to research more on the the mattress that you purchased. As it could be the same comfort or even better. Newer models don't mean better. A lot of it is marketing, and even newer versions can be worse as the factory is cost cutting.

    What does their website say about change of mind? Usually it isn't allowed for a mattress. I can't find anything on their rather crap website.

    Ultimately they might have been a bit misleading but it is just par for the course with sales.

    Is there a reason you didn't go home and do some research? Or are you about to move into your first house and really need a mattress?

      Pretty much only way to confirm is to call Tempur but OP would rather lodge an ACCC claim like a Karen. What if the sales people are actually telling the truth?

    For what it’s worth the whole mattress cartel thing is pretty anti-consumer. They specifically make it difficult to compare and price match or beat by selling identical mattresses with slightly different covers and names.

    However, at the end of the day if it’s comfortable and you got a good price then why lose sleep over it?

    This is amazing to me. The idea that you believe what a sales guy says, or what a marketing website says in preference to whether the mattress was comfortable.

    Just uncritical, American style consumer thinking. Take a breath and imagine you were an adult buying a mattress. Would you want the most comfortable or one the sales brochure says is the "latest".

    Sounds to me the Sensation Range is a repackaged old model where they make it so only Domayne has that product (It would benefit Domayne as they have an "exclusive" range and Tempur can move stock). It's very much like homebranding everyday items for supermarkets and big retailers.

    In terms of quality difference, unless they have study reports or dedicated description in there that can pinpoint the difference the new technology would make to your sleep quality, much of it is just marketing jargon.

    But if you insist on cancelling the order, check their T&C. What's the go? Do they allow you to cancel with fee or without? Do they have change of mind? You are an adult and ultimately, you were not forced or coerced into buying the product. It's like blaming the telemarketers on TV for your purchase because they sounded nice on TV

    I see people are not on your side, from those who have bothered to read your full post anyway.

    Firstly I agree the practice is very deceptive and its one that's been on ACCC's radar. Basically, its common practice for matress manufacturers to relabel their mattresses for each store or chain which makes it harder for consumer to compare. Domayne also keeps winning these platinum /diamond dealer awards for Tempur which i think is further in this vein of distracting marketing to make you think they have the best price/products.

    That being said the main issue is there usually is little to do no difference between the products. Mattresses are not tvs and not phones, which even these days usually see incremental improvements YoY, mattresses are even worse. Now it is possible that Tempur's new material in the pro is meaningfully better in some metrics (but also a good chance its worse in others, maybe it retains heat or smells worse) very hard to tell.

    It does sound like the salesmen was misleading and i dont think their return policy matters, they cant sell you something by lying to you about it, its just a breach of the ACL to do so. However, the issue you have is, have they lied, they are insisting the mattresses are the same apart from the cover, its not clear to me that you have clear evidence that they are not the same. I think you would need to try to get Tempur to weigh in, but I wouldnt frame it to them with all the background, just say your confused between the ranges, even say the sales man didnt know, and just ask what's better about the pro range to make it worth the price increase. In the meantime you can proceed with disputing the charge with your bank.

    However, while i dont think its ever reasonable or your responsiblity to correct misinformation that is confidently put to you by sales people, in this case i do think most commentators have it right that it really probably doesnt matter. Is it comfortable.

    For what its worth, we got our Tempur from Domanye QV about 8 years ago and were happy. We shopped around at a bunch of alternative places, and it was the best price by far we could get. It wasnt identical to the models at other stores, but the main differentatior between tempure lines (regardless of name) was how thick the Tempure was, and i think there was even a really bad hybrid (basically regular spring with tempur topper). Our mattress still feels like new, and i legitimately dread sleeping in basically any other bed, even in fancy hotels the experience is usually worse.

    I also think people are weird, we ended up going with the medium firmness one because the Salesmen at every store was like you will regret getting the soft (something like only 8% of sales were soft). In hindsight we should have got the soft, i think a lot of buyers are coming from cheap worn mattress that have lost support, have back problems and are just scared off by the 'soft' label thinking they need something hard to support them, but in terms of support its not really must different.

    • A salesman can't make false/misleading representations - they can sweet talk, smile and jazz hands all they like but misled through false claims is an easy charge back or worse for the business as it's simply against the law. The op needs to be prove the claims are false though… I'm not sure that's really been done.

      • While I would never trust a salesman. In this instance, given the way the mattress industry works, it is actually highly likely they are 100% correct. It is common practise to change the covers and names and call them new models and the new advanced materials are likely just their new advanced marketing materials. Regardless bedding material really hasn't changed much over the last few decades, all that matters is whether it is comfortable for you and the price, whether it was design yesterday, 5 years ago or a decade ago is irrelevant.

    From what I think you've said:

    • Sales staff said Tempur Sensation and Pro were “the same inside,” only covers differed.
    • Sensation is an older model, lacking the new Advanced Material in Pro.
    • This information misled the purchase decision IMHO.
    • Order was cancelled before delivery, but Domayne/Gerry refused (insert "mwuhahaha" evil Gerry laugh)
    • Under ACL, this appears misleading conduct, if you can show evidence/proof.

    I'd say you go to Consumer Affairs Victoria, file an official complaint and seek to chargeback through card issuer.
