        That doesnt mean we are not covered. Ourdeal should still give us a refund if the item that arrives is not what was described or sold. They are just saying, we cant sue them for extra damages if it isnt.

    Haha.. Here we go.. and so it starts.. Any sign of trouble and I'll be contacting consumer affairs about this.. You can't just promise one thing and then deliver another. It's called bait and switch, and is illegal under consumer law, irrespective of whatever their terms might say.

      Yep - did the same. How were some people receiving emails from them saying they may not be Seagate drives? I've yet to receive such an email.

          I think what they may have meant is its a Seagate external drive provided by Seagate but since they havent opened up the casing, they cant guarantee its a seagate hdd inside but assume it is.

      • I have not received mine either which makes me believe that it is not an auto response.
        I reckon that they are sending emails once they process a voucher.
        It is also possible that they are looking at comments here and revising the text of their email. They must think probably we have given too much information or been too honest. I am now worried that if they fail then I would have to do a run around and waste my time which is anyway valued more than the cost of the hard drives. It makes me feel sick but I know that there are other 2000 or less fellow OZbargainers who would unite and confront axeze regarding the products only if they fail to deliver a product to us which doesn't match the specification or description of the product as per the deal. Until then we should just wait and watch "this" space.

        I sent order email right after the purchase 2 days ago..

        I have forward their email to Ourdeal letting them to investigate but anyway I may also lodge a complaint to fair trading office IF they cannot honour the deal. For me, I am just sick of these people that drawing huge internet attention with some fake products that dont even exist. It is like "free advertising" cost them zero dollar and they think they can get away with it just saying sorry and moneyback? no way!

    if they assume its a seagate drive and its from seagate, why would they have any reason to doubt its a seagate and go through the bother of emailing people. They obviously know something they are not telling us. I have yet to reply to them as i was so furious. I will just let mines be delivered and take it from there. Very very poor show and most likely illegal, either advertising it as one thing and delivering another or knowingly supplying counterfeit goods as "its labeled seagate but may not be"

      If 1000+ people are emailing them with all their details and you're going to email them again because its been 12 hours since the the offer has been open, surely you can't expect miracles. If after a week and you've heard nothing, then maybe contact them but for now, just sit tight. No need to panic, they're doing exactly what is required as per the offer.

      • Agree with Vladdo. Do you expect them to reply withing 5 mins? I will give them till next friday MAXIMUM before I worry :)

        • I think you need to allow them the time stipulated in the offer (2-4 weeks or something) and proceed on the basis that they will provide what was promised in the offer.

          You guys all need to cool your jets and give these people the benefit of the doubt that they will deliver what was promissed.

          This talk of contacting Fair Trading at this time is rediculous. It's like ordering at a restaurant, waiting 5 minutes and then complaining that the food had not arrived.

          Give them a chance - they've done nothing wrong (and hopefully won't).

          Those that got the "may not actually be a Seagate" email should call them (the seller - not OurDeal) directly for confirmation.

        A week's worth of interest will probably pay for the labour needed to issue refunds to 2,002 people and hopefully take action against Axeze.

        edit: hurr, at 6% p.a. a week's worth of interest on $130,000 is just $150. Is that right?

          Let alone the fees that they'll have to pay for firstly receiving the money and then refunding it.. I think they probably lost a bunch of money on this, so hopefully theres no next time..

    Let alone the interest. dont you guys feel being fooled by giving all the Credit card info, home address, name and phone number to these bastards and then accept their refund for a unknown period waiting.

    Come on guys, you knew it was too good to be true, especially with OurDeal taking 50%.
    A full refund is the best outcome you could reasonably expect. We'll all be wiser next time and maybe resist.

    I'm sorry I didn't have the balls to 'neg' it while active.

    Edit: I'm guessing it was Axeze who got scammed. Maybe they had no drives and made up the bit about "not genuine" so that Ourdeal would cancel and refund the whole thing.

      I'd say that axeze never had the drives in the first place, hence the long quoted shipping time.. in the last day or so they probably got one of the drives and then realised something dodgy was going on.. we acted in good faith, so did they.. it didn't work out, so time to move on..

  • I guess whoever hasnt received refund email from Ourdeal will get the drive within 2 weeks. Azexe never had 2000 stock, may be only 200 so they make it up a story and Ourdeal can issue the refund. Not a bad show for Ourdeal considering 130k cashflow + interest + marketing benefit (positive image that provides money back guarantee) Just blame everything to Azexe

  • Surely there must be some kind of legal ramifications for these bastards, they fool people and take their details and say that we can't fulfill the order? What can we do collectively to pay them back in someway, they will probably have details of thousands of people and my email is getting spammed twice daily.

    I know this is a scam from the beginning. Not a single company can stock 2000 pieces of electronics products. Even dicksmith dare not stock that many.
    for electronics company, stock level is the most important KPI, because the price can drop dramatically after days.
    when you say a dodgy company has 2000 hard drive in the warehouse, the first thing coming into my mind is scammmmmmmm.
    I am pretty sure even if the deal come through, everybody would get a seagate cover with a refurbished disk (possibly WD, Hitach, Samsung) inside.

        apparently axeze does not know ourdeal will only send them fund AFTER they have delivered the product. Axeze only thinks they get the money within days and then they can deliver some fake products. but after requesting money in the last 2 days, they begin to know that they cannot getway from it. so generally speaking, Axeze is a scam website but ourdeals protected us from losing money. the same thing happened last year. if you search ettalong beach on ozbargain you will know.

        No need to lose money to be a scam.

        The mere fact that there has (potentially) been misleading or deceptive conduct by Axeze and/or OurDeal is sufficient.

        I expected to receive a 2TB external Seagate harddrive for $65 delivered - the director/manager of Axeze has given written confirmations that they will be able to supply the drive for that price. They then disclosed that while they would supply a drive it "may" not be a Seagate (still no suggestion of not getting a drive). Now they say there is no drive at all?

        Do you not find any of that to be misleading or deceptive conduct in the course of trade or commerce?

        The fact that Axeze (may/allegedly) have an issue with their supplier is their problem - not ours. They have agreed, and made representations to the effect that, they will supply the drives as offered. Their conduct, if they fail to supply the drives, will certainly be of interest to the ACCC, ASIC and the various Offices of Fair Trading.

          We didn't put a gun to their head to make the offer. We accepted what was offered and have complied with their terms. The fact that they may have "screwed up" does not relieve them of those obligations.

          Perhaps a representiative of Axeze would like to come forward and clarify what has occurred.

          There seems to be various different stories circulating - an honest response would be appreciated (and, of course, expected).

        • Jon187 and rainy118 - A scam is something deliberate. A mistake is not a scam. Using sensational words like "scam" doesn't reflect well on you, unless you have evidence it was deliberate. We're all disappointed we're not getting our drives, but it certainly does not look like a scam at all. A poor decision perhaps.

          Just saying it was a mistake doesn't relieve them of their obligations, but if we all get our refunds in a timely manner, what else do you expect to happen?

          I too hope a rep comes on and explains the real story.

          Fair Trading would be your first step. However if they refunded you in full, as far as Fair Trading is concerned, the slate is clean.

          I know people here are like mobs who want to torch a place down for not giving them cheap drives but the reality is Fair Trading is final and they are conservative and they will not go further than a full refund.

          They are the arbiters, not you.

        • ourdeals has protected us from a scam, but this is definitely a scam. If the products description says 2TB but the actual product is 1TB, we can say it is a mistake.
          But how come a Seagate hard drive with Seagate brand can have some other branded harddrive inside? If I sell you a Sony TV (at an unbelievable price) but inside the box you can only find a Soniq TV, you still call it a mistake?
          Had ourdeals allow this to go through, I am pretty sure all of us would receive a Seagate cover with refurbished WD, Samsung, Hitach inside.

          I doubt it's an intentional scam on Axeze's part.

          In a previous email, they told someone the drives were coming from China. That set off red flags for me because buying from random Chinese sellers is dangerous because it's effectively an unregulated market. It's the bloody wild west.

          Too many westerners, including some companies of not insignificant size, don't do their research, log on to Alibaba or similar, organise to buy a ton of stock from the cheapest company on there and are surprised when it turns out to be dodgy. It's entirely plausible that Axeze was just dopey and thought they were getting legit stock.
