    sigh this is the second thing I've ever bought from social sites, and thought it was worth a shot, first one was hair cut and credit etc, business went under, and now this one refuses to offer up the drives, (for what ever reason don't care), social sites really need to get a contract written with penalties if a company doesn't follow through.

      P.S. I'm still waiting for my email telling me that the deal is off, I should not have to find out about it via the OzBargain site, or Facebook or whereever else it is you've posted it. The moment you called the deal off, you should have sent emails to all customers advising them of what's happening.

    Really p!ssed that I have to discover on here that the deal was a fake/scam/mistake. No contact from either OurDeal or Axeze. Really poor form. These deals are intended to promote a company. Instead they have damaged the reputation of OurDeal, Axeze and Seagate. What an effort!!

      I couldnt agree with you more, I wonder if there's a seagate representative lurking here prepared to offer people any form of goodwill (i.e - providing their own deal) to promote seagate. Even if it is at a slightly increased cost to the original deal for even the internal drive only.

      I was really looking forward to filling out my microserver!

    I, for one, from now on,
    will turn away with any deal from OurDeal & Axeze,
    and these companies are permanently black-listed from me & anyone I know!

    I am not saying all these becoz I am angry that I can't get the hard drive,
    but at their advertisement, collecting of personal information(including credit card),
    and then refused to honour any deal at all!
    (see page 1 & 2, people even called Axeze to confirm if there's such deal)

    who knows in the future any of these bull shit will happen AGAIN and AGAIN from OurDeal?
    they take your money, credit card details & personal details including your number & address,
    and then say there's no such deal!?

    they will never get my business or referral to anyone again! EVER!

    $65 for a 2TB external hard drive, including postage, from a relative unknown seller - and on the day they were offering this deal, the only sales rep who knows about the deal happened to sick. It was quite fishy and too good to be true. Therefore, it was basically a gamble for anyone who purchased it.

    Anyway, people will get their refund. A positive side of this is that those people will learn to be more cynical about these too good to be true deals in the future. Buying bargain deals online have risks. Generally, online deals can be cancelled by the merchant at any time.

    • which is the reason I didn't buy or vote for it. I think everyone should have waited for delivery confirmation rather than voting out of the box hoping it would arrive.
      Generally speaking emailing anyone for ordering a hard drive is very very suss to me and wouldn't have touched the deal with a 10 foot pole

        I've seen or scored a couple of deals that have been almost too good to be true on OzB that have come through. The $35 Verbatim 1TB USB3.0 drive from Staples is a prime example sitting here spinning away as we speak! ;)

        Sometimes you win, sometimes you lose…the loss in this case is fairly negligible, a bit of my time was nothing coz I was on holidays anyway & a couple of days wait for a refund, that's the extent of it. I've had good experiences with OurDeal to date, I don't think they've done wrong in this case, and they're apparently doing the best they can to fix it. No harm, no foul IMHO!

        Yeah, Axeze appear to be complete idiots, they've stuffed this up royally; but at the end of the day nobody here has lost anything tangible except a few contact details which depending on your level of paranoia may or may not be an issue.

        I'm not revoking my + vote coz the OP found what we all thought to be a great deal and posted it in good faith, we all took the bait, renegging on that doesn't seem kosher to me! :)

  • Why are some people getting refund emails and others are not? I still haven't gotten mine.

    • It's the weekend. They were issuing some refunds on Friday, but I haven't seen any posts about refunds since then (then again it's hard to keep up with a 6 page thread). Presumably they'll get to the rest of us come Monday.

      I'm a bit shitty that they didn't make the effort to refund everybody before the weekend. A quick refund, instead of being stuck in limbo for a few days, would've made a better impression of OurDeal… I do wonder why they don't seem to have the capability to refund everyone automatically instead of manually doing it.

    • Our Deal claim EVERYONE was emailed on Friday and are suggesting that anyone who didn't get an email should check their spam filter. From comments on here I'm suspecting this may not be the case…

    "Refunds will be processed over the next few days, we're trying to work out the fastest way"
    "I will need to speak to management about Axeze having your personal data."

    I can forgive ourdeal for this, it seems like a stuff up by the supplier plain and simple. Ourdeal can only go so far to check the suppliers info is correct.

    However I also did not get an email on Friday, and them telling people that everyone got is bs. This is way I won't be dealing with them again.

    Telling people who feel they've been ripped off / scammed that they have been emailed AND a refund is being processed, when clearly 100's, perhaps 1800+ people were not sent the alleged emails, makes the matter worse. Should we believe anything you say in future? Are you going to refund the $130,000 collected? Are you going to explain what actully happened to our $130k investment?

    Mistakes are understandable, but dodgy, shady practices are not tolerated for long.

    How about a sfraight, clear response to clean this mess up?

  • bugger!!! cc billing cycle now includes the tab for $65… will have to pay that extra amount because the refund wont make it in time…. end result this fiasco will cost me $65 for a month!!!

    Seems that if two weeks pass from the date I sent them the email with the voucher code (i.e. 13 January 2012) they are obliged to provide the drive.

    I've complied with the T&C's in the voucher itself:

    Terms of this Deal

    2TB" in the subject line of the email Valid from: 13th January 2012 Limit

    I've also had a read of the T&C's on their website and there certainly is an argument that I've complied with all relevant conditions and that they haven't terminated the voucher so there is an enforceable obligaiton for Axeze to supply the goods (given that OurDeal merely acts as the agent for Axeze - see T&C 15 on their website).

      I'm still not convinced they are able to issue a refund and wash their hands of this mess.

      References are to the T&C's on their website:

      "7. When you place an order for a Deal, it will constitute an offer to purchase a voucher from the relevant Supplier in respect of the goods / services which are the subject of that particular Deal. We will issue the voucher on behalf of the relevant Supplier. Your offer will be deemed accepted once the Deal becomes “active”.

      1. We reserve the right to accept or reject your offer to purchase a voucher for any reason. If we do so, we will provide you with a full refund of any payment received."

      So - they accepted our offers when the deal became "active". Their rights in clause 8 only come into force before the offer is accepted.

      From a read of refund provisions:

      "Refunds by OurDeal Pty Ltd

      1. If your voucher expires or becomes invalid for any reason, then it is not refundable in whole or in part.

      2. You acknowledge and agree that vouchers are not refundable if your voucher has been damaged, lost or stolen or if you are unable to redeem your voucher or if you have changed your mind.

      3. We will however refund the price which you have paid for a voucher if:

      1.we become aware that a Supplier has become bankrupt, started being wound up, entered into administration or had a receiver appointed to it after the start of the Advertising Period but before we transfer the purchase price which you have paid for a voucher to the Supplier;
      2.we make a mistake, for example by issuing you a voucher which is incorrect."

      It also appears that they are unable to issue a refund in circumstances where a Supplier is unable to supply the goods (seems to be some poor drafting there - look for this to be unilaterally amended in due course).

      In terms of Axeze's obligaiton to supply the goods, clauses 25 and 26 provide little clarity:

      1. All goods / services are subject to Supplier availability. We cannot guarantee that goods / services will be available so that you can redeem your voucher at your preferred date and time.

      2. You acknowledge and agree that Suppliers may cancel and reschedule any booking which you make to redeem a voucher.

      Certainly 26 does not apply (given that is a services related clause). In terms of clause 25, they certainly made representations that the goods would be available. At the time the offer was accepeted (i.e. the go live date) - I'd say their ability to rely on clause 25 no longer applies.

      OurDeals - on what basis are you entitled to issue us a refund?

      You excluded all implied terms which would have given you that right and none of the clauses of the T&C's apply in these circumstances.

      When i rang them this morning i advised them that i wasn't happy with axeze having my details, as per ourdeal instructions. I asked them what was going to be done about this.

      Guess i wasn't the only one asking.

  • How about giving us an added voucher of $10 to want to ever work with ourdeal.com.au again? Is our time and energy not valuable enough for the company to want to retain us as customers? We did the proper steps in order to recieve the voucher, and to redeem that voucher, isn't the least they can do to compensate us with some type of "store" credit? Why is just a refund enough? Where is the customer service in this mixup by both companies?

      and to do a whole lot more documents than now,
      and they would have to deal with ACCC, Fair Trading, Bank Credit Card Revert Cash..

      so..IMAGINE! who is more in troubles?
      unless..ofcoz if they run away with the money(close down the company)
      that's different story! (this gave we all a lesson, don't buy from company like this)

      it's a EASY $130,000 in a day or two!

  • Wow, just found out this deal turned out to be a loser deal. I saw this post quite early but since I've already bought a WD Element 2Tb drive from Officeworks not long ago, decided not to take up this "too good" deal. Glad I made the right decision and feeling sorry for those OzBargainers who bought into this deal. What a fuss and waste of time.

          I don't think Azexe will do anything - they were unknown before, and their target market (access control) is so specific that this won't affect them.

      Ahh, it's all a game. People who don't take risks in life usually stay stagnant. Look at the most successful people in the world - did they get there because they took risks, or because they played it safe?

      In this case the risk of losing money was low, so it only cost a few minutes time for most people.

          What makes you so sure others did not calculate the risks first? Perhaps you're just blissfully unaware of the factors behind their decisions, and your single-tracked thinking prevents you from taking any risks.

          You're forgetting that the four points you mentioned above only came out AFTER many of us bought it - it looks like you were just late to the party.

          In short - don't assume you're the only person who calculates risks and everyone else is stupid. And don't assume you know everything.
