TopBuy.com.au - Recent Nike Sale FAKE! Buyers take note!

Hey guys,

Long time browser, first time post!

To all those who bought Nike shoes recently from TopBuy.com.au (I think all "Air Max" series of running shoes) then I suggest look at them again as they are most likely to be fake.

I am in the fitness industry and wear 90% Nike apparel. I also volunteer for the Nike+ Run Club. Long story short, I know my Nike products. Below is detail from my attempted contact to TopBuy.com.au to help everyone else in the same boat confirm that their shoes are fake.

Check first and get your refund from TopBuy.com.au ASAP.

1.) All orange Nike shoe boxes are made of a matte feel dyed paper cardboard. This fake shoe box is glossy and the orange colour is printed onto the cardboard, easily showing any signs of damage.

2.) All Nike labels are printed in high quality and easily readable. This fake label is of poor quality and you can't even read the Nike website writing.

3.) Nike running shoes do not come stuffed with two types of tissue paper, only one type (99% of the time). These fake shoes do not have the proper shoe stuffing.

4.) Nike running shoes have high quality reflective printing. These fakes are poor quality and not aligned correctly.

5.) Nike running shoes have high quality BRS rubber materials. These fakes clearly show the black and red has been painted or heat-treated onto each other.

6.) Nike+ enhanced running shoes always have a high quality rubberised plastic symbol on the sole. These fakes are poor quality hard plastic and do not sit flush with the sole.

7.) Nike running shoes have quality innersoles made of firm foam materials and have clear printing and never have additional stickers. These fakes are thin and still carry the fake Chinese factory stickers.

8.) Nike+ enhanced running shoes always ensure quality control in the construction of the shoe. These fakes have been made so poorly that the Nike+ insert holder does not even sit inside the shoe.

9.) Nike+ enhanced running shoes always have a dark piece of rubberised foam inside the Nike+ insert which fits almost always perfectly. These fakes do not fit together at all.

    The swoosh in your first picture on top of the box looks extremely fake.

    One thing I always checked for is that the serial number on the box and on the tongue matched, if it isn't there, or is different = FAKE.

      That trick doesn't work anymore - the pro's will use correct serials, as was done in my case!

    There is a lot of personal information on those links you provided; full name and addresses. eBay ID; PayPal details.

      • Click any of the photobucket links, and there is an arrow to go to the next image. Some images you have on your account show up. One in particular is an eBay checkout with Jason Chau and full address.

    I know this is not about Nike products but my experience with Topbuy is familiar.
    I purchased a Mitre saw sometime ago.When it arrived it would only cut up to 200mm wide material,not 240mm as advertised.The manual sent with the unit said 240mm so they said it was alright.Long story,short I had to send item back wait 30 days,then enter a dispute with Visa,cancel card,wait further 21 days ,then had transaction reversed.
    My advice,steer clear of Topbuy.com.au.

    This seems to be the norm with Topbuy - I rememeber that they also sold fake Havaianas. Disgusting.

    I have alerted Nike Australia, will see what they do … given the time it will take to gather evidence and go through the whole legal process it will probably eventuate into nothing, but one can only hope … TopBuy really need to be massively fined/shut-down for breach of IP law.

      Great work. Selling fake items in Australia is illegal and these shops should be banned.

      You can complain to ACCC or fair trading as well.

    Good on you for contacting Nike. Keep pushing it with them and don't let topbuy get away with it.

    btw did you contact topbuy about this and if so, what was their response?

    Nike's Brand Protection team have replied to me … good things to come I hope.

    No response from TopBuy yet, however my complaint was made on Friday so I'll assume they are recovering from the weekend's hangover still …

    everything on topbuy is fake, don't buy from them. All there items are from china by the way, even though they are Australian company.

    given the rash of negative comments here, can we ask Mods to ban any TopBuy deals on this site? That'll teach them to mess around with us!

      You do realise that sales that come from here probably make up a minuscule percentage of TopBuy's revenue? What use would that do?

        I think it's a good idea and was going to suggest it myself.

        What it will do is stop anyone who hasn't seen these TopBuy fakes posts from seeing yet another 'great deal' on here and going and buying from them. It isn't so much a punishment of TopBuy as a protection for OzBargain readers/members. It also helps protect OzBargain's name by not having them inadvertently referring people to dodgy deals.

        I know people will jump in and scream 'but remember the fakes!' any time there is something posted on TopBuy…but why not just keep it simple and ban them.

    • TopBuy.com.au has been permanently banned on OzBargain since May, but for an entirely different reason. They were in & out of penalty box until the moderators just had enough of this.

    I received a reply from TopBuy … as to be expected, their reasoning is that the stock is from overseas and on "clearance". This is consistent with some other posts on forums I have read. They offered me refund if I send back the goods, or keep the goods and get store credit plus bonus $10 (hooray, so I can buy more fake things). I will seek advice from Nike as they will be handling this situation from now onward.

    I won't be updating here on OzBargain anytime soon in order to steer clear of any path-crossing with Nike's Brand Protection Department and whatever they propose to enforce … maybe an update later with a final result (if allowed to be publicised, and if I am even kept in the loop).

    Thanks guys for listening - I hope the OzBargain moderators at least listen to the suggestions to remove TopBuy as a vendor. Good luck to you OzBargainer's in the same boat as me here!

    Like everyone else has said, avoid topbuy! They sell fakes very blatantly, we found out after their Vapur fiasco.

    Topbuy is pathetic, i learnt the hardway.

  • I used to sell stuff online. Basically topbuy is just a middle man. People email them saying they want to sell something, and they list it. They don't do any check to see if they are legit or not. Can sort of be top buys fault, but it is the same as groupdeals etc.

      That still does not make them innocent.When someone approaches the seller, they know it is fake or genuine from the price. The problem is only 5-10 % users or buyers comes back complaining and they give refund. Sellers still make huge profits.

      Few users complaining might take it to next level, so that other users in future won't be be fooled.

      One of my colleague used to sell cheap (fake) Nike shoes through ebay. He used to write tricky words in ebay listing like: Why buy Nike, when you can have this, etc.
      Few complaint and he refunded, but as they were cheap.

      Finally Nike contacted him to stop the nuisance. If we say he was the middleman, he still knew they were fakes.

      So TopBuy isn't innocent….

        Correct. Ignorance is not a valid defence. Unless you can prove you were misled by the supplier then guilty as charged.

    Just don't buy from this bunch of crooks. Tried em again recently - 1 month later received nothing - told nothing can be done until 29th august - and will not refund. Customer care is a joke - as is shipping - and anyone using them is asking for trouble. Expect to have take legal action to get redress - do not buy

      Enforcer, hopefully you paid via PayPal. They have a 45 day policy to raise a dispute - there is not much leniency outside this policy period, so make sure you raise a claim ASAP.

      If you do not receive anything within reasonable time (goods or refund) then you are entitled to immediate refund or replacement under Consumer Law (for breaching the most basic of rules, contracts). If you were cheeky, you could even argue for 2 months of interest on the monetary value if it is material.

        yup that's my reading - but time is money and these creeps are operating on how hard it is in Australia to get even basic consumer rights. parasites and scammers company ….

    I was stupid enough to buy some Nike Roshe joggers and a backpack off them. So I am guessing they are most likely fake as well? Not sure if there's anything I can do about it now :\

    edit: Actually, after browsing the net some, yes, mine are fake. The pull tab on the front and the back of these shoes is so much smaller than the ones on the legit pair. http://img96.imageshack.us/img96/5540/9cmr.jpg Real shoes on the top.

      MissMurd3r, my friend bought 4 pairs of Roshe's as well. They are 100% fake. If percentages could go higher, I would quote it.

      PM me for further instructions, I will piggyback your claim via Nike Australia for you. Make sure you raise a PayPal dispute claim ASAP - before the 45 day policy expires. Dispute classification should be selected as "imitation".

        Just trying to think how long ago the purchase was.. I think it was 20th June, but I only received the actual items a week ago.

    Hi all, after a couple of weeks of round-abouting with PayPal, TopBuy and Nike Brand Protection, final resolution is for TopBuy to provide full refund plus pay for return postage of the coutnerfeit goods.

    Their initial offer after I escalated the PayPal claim dispute was actually to refund the goods but I had to pay for the postage … what nerve.

    Anyway, now this has been resolved for myself, it sets the precedent for same resolution for anyone else who bought fake Nike items in this sale (MissMurd3r). Just contact TopBuy and tell them you need refund and postage paid for (reply-paid) - they will provide an RA number.

    • Ah cheers for that. I have been too busy to even take pictures of the shoes or anything. As for Nike doing anything, I had already read before this on the Nike site that they do nothing about fraudulent items that are not bought via their own website.

      Will be interested to see if Topbuy accept the shoes back off me since I had already worn them before I found out they were fake.

  • They should provide full refund even if you used any of the items. It does not detract from the fact that you were sold counterfeit goods… and on a side note this is all quite funny (coincidental) cos I received my latest CPA accounting magazine and it featured an article all about Chinese counterfeiting.

    Nike Brand Protection Australia have advised me that they are unable to comment further on dealings between them and TopBuy.This would mean legal action is being taken or a resolution behind the scenes was achieved privately (I assume).

  • Do these companies really care about counterfeit goods.

    I'm sure many workers/executives have been to bali/china/hong kong/Singapore etc etc.

    These places would have 1000 counterfeit goods to every original, probably higher.

    As one poster said, the price you paid was the chinese knockoff price, and that's what you received.
