    I have refused a refund and insisted on performance of the contract. I will also return the refund they made against my will.You can send money with your order number via PayPal.

    As some people have managed under Australian contract law they have to deliver the goods or give a refund PLUS damages which is the difference in money needed to obtain the goods elsewhere.

    I did doublecheck this with a lawyer yesterday and it also makes sense.

      under Australian contract law

      The terms of the contract which you entered into (when clicking I have read and agree to the terms and contitions, if you did read the terms and conditions) allows the Good Guys to cancel the order for any reason.

      "Refusing" the refund means you will just take longer to get your money back (which will inevitably happen).

      If you stand fast and continue to "Refuse" the refund TGG could just ship whatever game they can get their hands on even if it isn't the game you actually ordered (or as some people have received, just ship an empty game case). As the item does not match the description under Consumer Law all you would then be entitled to is a full refund, not any damages and you can not force them to replace it.

      Damages = difference in money needed to obtain the goods elsewhere is bogus.

      Don't ship game and refund the money - you are in exactly the same situation as you were before the sale (minus a couple of weeks interest on the money they have held). The only damage is to your ego as you thought you were getting a really good deal and now you are not.

      Unless you ordered thousands of dollars worth of games $40 is more than compensation for the lost interest on the order funds and it is likely that any court would agree.

      Good luck to you and your Lawyer but in my opinion (though I am not a Lawyer) I think you are wasting your time and should just accept the refund and move on. Complain to everyone (TGG, ACCC, Consumer Protection, whatever) if it makes you feel better but it is not likely to make any difference.

        Ianal but I would think Australian law would over rule any "contract" TGG have made these are consumer rights just like stores can't revoke our return rights they can put up signs that say they have a different policy but they must follow the law.

        Besides if TOC is anything like TOS (tos has been over turned multiple times because just because you put a box that says you read it Nearly no one has actually read it).

          This is correct. The laws were created to protect consumers and the seller can't just get out of it by drawing up some dodgy contracts.

        Companies can write whatever they like in their T&Cs - that does not mean they are valid.Sometimes the T&Cs are wishful thinking by the companies and as long as people just believe that T&Cs are above the law of the land they get away with it. What you say makes no sense as if you were correct people could just revoke contracts unilaterally. Optus tried the same with me with their tablet some years ago -I refused and in the end they had to give me a Dell for the same price. Another customer just believed their story and left with a refund. Sometimes it pays to insist on your rights.
        Contracts exists and are made for a reason - if one party could simply vary or revoke it willy nilly why would people bother to make them. They exist to provide certainty to the parties to the contract. I will refuse and take my chances.

    Just got one PS3 game in the mail delivered by Star Track express from Auburn store. Game case is smashed up and held together with sticky tape. Sticky tape is taped onto the game cover insert, so removing it pulls off some of the picture. Not impressed at all, but at least the disc is ok (apart from two large fingerprints.)

    Will be interesting to see what the condition is of the other part of my order, whenever it turns up.

        • that is nuts. because its a clearance and the good guys clearly oversold their stock I could accept products that are slightly damaged (ie scratched or dented case)but that is ridiculous

  • I did complain to both the phone people and sent an e-mail, too.I think they more people call them and e-mail them the better the chances for a positive outcome as the people behind the e-mail are higher up the chain and also include the legal department who would know that they are in breach of contract. That's what I was told by HQ so I assume its right. If they do not react I am sure ACA will jump at this story - there is so much lovely info on this out here now. ;-)

          The Game is out of Print, it is a legitimate Clearance Item, so unlike black and white that are still being produced, its harder to get copies of gold and silver. Thats why people aren't getting any.

  • I've only received one generic email for one order (don't know which one as the email doesn't specify which order) which says they're cancelling and refunding and I've a received the refund email from paypal so does that mean my other order is being fulfilled?

        I'm skeptical since the order that didn't get a refund is luigi U and I don't think anyones getting a hold of that one.
        Refund of $12.00 for "ps3" (actually uncharted 3 which sits on the shelf at the store nearest to me this morning) Hopefully I can use the giftcard to purchase that title.
        But if I don't get Luigu U they'll be having some complaints at the ACCC and fair trading and all the offices I can get a hold of.

    Just got an email from Paypal saying I've been refunded $82 from Good Guys. Never had any phone calls from them, only confusing emails that contradicted each other, and no one ever contacted me to ask if I wanted a refund or wanted to wait for the games. They are an absolute shambles.

    Total failure by their customer services/social media team on every single level.

    I've been told stores will eventually be getting these games back in stock.
    You have every right to refuse the refund and they will need to honour your order once stock arrives.

      • If you paid by credit card or a savings account, you can put a block on TTG from making any transactions on your account. If it was PayPal, your out of luck, PayPal works on a different Set of principles since they are international, and you are obliged to accept the refund, Thats their "end all" solution.

    I just read a comment on facebook of some guy purchasing $800 worth of "christmas gifts" on the same day of this deal. He got the same treatment as us (buyers from the game clearance) so I'm assuming he brodened the game. I guess that's a good sign that brodens didn't get anything.

    I found a copy of modnation racers (ps3) at goodguys noarlunga, which was one of the games the goodguys were not able to send me. I asked how much modnation racers was and got told $23 on clearance, I explained to the person at goodguys noarlunga that I had missed out on that game in the game clearance sale and asked if they could possibly sell it for $10 as that was the price I had originally purchased it for, the salesperson said "nope, can't do it at that price because it has different packaging" (looked the same to me).

    I want to remind people that for the future - vote with your wallet.

    I've got a wad of pineapples in my wallet waiting to purchase a new dishwasher - I won't even consider visiting the 'good guys', both its online site or my local bricks and mortar store.

    Don't post or vote up TGG deals, because even it seams like a good deal - chances are its still being ran by a bunch of amateur muppets who can't deliver the goods.

    Total shamble, never again will these stooges get another dime from me.

    Hi Guys,

    Like many others, I had an email from TGG saying that my 5 vita games were dispatched last Friday (29th Nov). It's now Thursday and I haven't had anything in the mail from TGG. How long does it normally take for TGG to send stuff by snail mail?

    Also had a notice for Temando yesterday saying that a separate package was picked up today but there was no calling card in the mail. I am worried that the courier might have dropped it off at the front of my apartment block. Does anyone know how long it takes for the courier to perform the drop off, from the moment the Temando says "picked up". My Courier's Couriers Please, and the pickup shop was Penrith and I live in Sydney's inner west - Strathfield.

    • Did you try puting the consignment number in the Couriers Please website? It might have a bit more info than Temando does

        • No idea what that 0048 thing means. Have a look tomorrow after 9am and see if its changed again.
          Snail mail can be really slow at the moment with christmas approaching, so give it a few days extra if Australia post are delivering anything.

    • My Temando thing says my game was delivered and signed for by RETURNED, which I have deduced means that they shipped it to Canberra where I live, decided they couldn't deliver it and didn't bother to contact me, and then sent it back to Sydney.

      Not at all happy about it - at least Australia Post have the brains to use the included phone number and ring you to confirm an address if there's an error, and I've never had a courier company not even bother to leave a non-delivery slip and a few day's grace before returning a parcel.

      I know this isn't specifically the good guy's fault (unless the stuffed up my address), but it really is just the final nail in the coffin for this whole damn deal!

  • I noticed the one dispatch notice I got from TGG said "received" under each game. I have not received anything, should I be worried?

      I had the exact same thing in an email from GG two days ago, which made me think that I'd be receiving all of the items I ordered. Wrong! Today I got the Paypal notification saying I was getting refunded for 8 of the games I ordered.

      I think the "received" under each game on the "invoice" just means the store got an order for that item. They then fail to fulfill the "received" order and you just get disappointment and a refund.

    • Have you tried calling couriers please directly with your consignment number to report that the parcel was never received?

      Hi Rollingball,

      Couriers Please should still have your parcel. try ringing them up with your consignment number and organise a pickup from their depot? They have a rule that only the sender (TGG) is allowed to change the delivery address and the receiver has to contact the sender to make an amendment to the recipient's address.

      I just received an email saying that Couriers Please attempted delivery and would like me to call up to organise:

      1) re-delivery; or
      2) pickup at depot

      I chose to do a pickup. Hopefully that helps your situation.

      • I cheated. I requested a redelivery from their website even though they didn't leave a card (they couldn't have, it was missing the unit number). It still worked.

    • Mine was also allegedly delivered but was signed for by RETURNED and I think it is now just back in Sydney. Nobody buzzed my apartment or left a parcel slip, and our mailbox is locked/secured so I've got no idea what happened to my games :-/

    • This happened to me as well, I check the tracking number provided from couriers please, and suprise it's signed for "DOOR", but nothing outside my front door :(

  • Has anyone who ordered more then one order recieved 2 separate refunds or just one refund ? As I recieved $12 bu am more then sure that $10 is missing from another order

      Hey mate,

      Yea I got two separate refunds… one was for a full order of 2 games, and one was a partial refund for not supplying 2 of 4 games… both including shipping. It took about an hour between both refunds, and I paid with paypal for both.

    What a mess…..all the bad stories. First it was the TGG f*** up, now it is the deliveries. Wonder how this will end. People not getting there games even though they have been marked as received/shipped. I am in the same boat btw..

    Just got a refund for my 2nd order. The first order was refunded around midday yesterday, so they seem to be refunding orders one at a time.

    • hmm unusual thanks for the update I'll probably be getting a second one too as it's Luigi U speaking of which has any actually got a Luigi U yet? and also of note they refunded my second order first maybe they're going down the paypal recent transaction list and doing refunds in that order.

      • This is the reply I got when I refused the refund and gift card for failure to supply Luigi U and said I would wait as long as it takes.

        "Thank you for your patience and understanding through this issue.

        However unfortunately the supplier has advised us that we cannot source us any more copies of this game, and we cannot source them from other retail centres, who may have copies remaining.

        • if your able to respond ask them Why they can't source them from other suppliers or ask why they aren't doing the Refund plus the difference to acquire from another store giving a gift card is nice but doesn't help you purchase the item you were in a contract with them for.

  • A question to anyone that has received orders… did you definitely get a temando shipping email? I received an email from the good guys saying the items were shipped but nothing from a courier or anything else… was wondering if I'm supposed to get an email from the courier too?

    • My first order had a shipped email and nothing else. It arrived by star track express.
      2nd order had the temando shipping email. So they are using a few different ways of postage. No idea why.

    • No Temando here - just regular post. Will likely be the same for you so watch your post box.

    • My first order was a TGG email saying that my games have been despatched. That was last Friday, and I still haven't seen anything in my mail (electronically or snail mail).

      My second order is a temando email saying that my courier's Couriers Please.

    • I think Temando / Couriers Please is the NORMAL shipping method if weren't for the clusterf**k. The other shipping options I think were used in the wake of the problems to try and cope with the mess.

      Just an update, Star Track Express turned up at my door just now with Pokemon black 2 and white 2… brand new and sealed Australian stock in a box from Moorabin store.

  • I have only placed an order for two games and they are supplying both, but I have not received ANYTHING from them at all re sending out the order. Seeing a lot of people here at least have their orders dispatched I am getting very worried.

    • Well having said that, I only got the good guys dispatch email after getting the refunds yesterday so they're probably still working through them, if that helps :)
