Repairer damaged the phone but refuses to admit and is being threatening

Hi all,

Let's get down to the story first. 3 weeks ago, I purchased a Sony Xperia Z Ultra outright for work purposes as it means I get a phone and tablet in one. On tuesday, the glass on the phone screen cracked. Please note that the phone was in a case and in my pocket when the magnetic clasp pushed on it and cracked the glass. I took it back to the retailer to see whether Sony would be able to fix it but the retailer mentioned that I would have to get it fixed privately as Sony does not have repair centres in Australia. So after searching online and making a few calls, I took it to a repair shop on Broadway who had competitive but not the lowest prices. As promised, they returned the phone the next day with the new screen installed and charged me $295.80. However, when I got home, the Wifi, Bluetooth, and headset were not working. This was surprising as before giving the phone in for repairs, I had connected the phone with a mouse using an OTG cable and synced the company data off it, printed the cards using the bluetooth printer and factory reset the phone.

I went back today and told the repairer about the problem. They took the phone back in and said they would call me shortly when it was fixed. They close at 7pm and when I hadn't received a call till 6pm, I called them. The guy on the other end said that I can come pick up the phone as the wifi/bluetooth module was broken and there is nothing he could do about it. I went to pick up the phone and the guy showed me the open phone and said the part was missing. I asked him where was the part if it was broken. He said he didn't have it as it could have fallen somewhere when he opened the phone. He also kept saying that I had dropped the phone and the soldered part came off. This is not true as I know tat the phone was in my pocket when the screen cracked. It was not dropped. I treated the phone very carefully by putting it in a case and taking really good care of it. My mistake was being careless about not realising it was in my pocket and applying pressure on the screen as a result.

I told him that I had used the wifi and bluetooth the night before to sync the data off it and he kept saying that I was lying. I asked him to give me the part, which he said he did not have. The phone had never been opened and the repairer was the first one to open the phone. I said if the part was broken then give me the broken piece. He was getting verbally abusive at this point and kept fluctuating between his statements saying that the part was never there and that it might have fallen out when they opened the phone. I then told him that I was going to be forced to report him to the ACCC and I needed his business card. He refused to give that to me and when I asked him politely to borrow a pen to write the name of the repairer on the invoice, he snatched the invoice from me and destroyed it. He then said "get out of my f*****g shop. This is my private property, get the f**k out." He also tried charging me by coming out from behind the counter. If his girlfriend wasn't holding him back, he was sure to have physically assaulted me. I then again asked him, politely, if he could give me the receipt as I needed that as I had paid him for the service. At this point he got really worked up and started pushing his girlfriend away and being verbally abusive. I then left the shop as I did not want to get in a brawl with him.

I can get my hands on a copy of the invoice as I made a photocopy to give in to the office.

Also apart from the cracks on the glass the phone is in absolutely pristine condition. There are no dents, marks or cracks on the phone. If something had in fact broken, it would have stayed inside the casing and well that particular module would not be working.

Now I need your advice as to how to deal with this situation. I haven't had any experience with this before. I am sure that the phone was working fine before I gave it in for repairs as I had used it via an OTG cable and a mouse. The only thing I can't vouch for is the speaker headset as I did not make or receive any calls after the screen was cracked. Also the guy being so violent is pretty shocking.

This is a serious matter so I would really appreciate some useful answers.

If I had stayed a second longer, he would have assaulted me. He also snatched my invoice that was paid for and destroyed it.

    This is one of the reasons why I will never really trust a repair shop. They are providing a service with which there are really no real skills or qualifications required.

    The first thing I would do is to report it to the police. He has scammed you and damaged your property and that's the first port of call. I would also suggest getting legal advice as well as reporting him to the relevant authorities to get his business shut down.

    My advice is to do it yourself next time. All of the parts are available on eBay and these crooks literally have no more skill than anybody with repairing phones. All they do is rip you off and charge you for what is essentially manual labor.

    • Thank you for your post. I would have repaired it myself but that meant having to order the part online which would have involved considerable delay. I run the company software off the phone so needed it done immediately.

        Yes, the part where the shop owner allegedly assaulted OP is entirely a civil matter. Assault does not even require physical contact iirc, his demeanour and threatening words could be enough.

        In relation to the phone itself, contact NSW Fair Trading. In general I would also diarise all material facts in case they come in handy in the future. If you are advised to go to NCAT i would not recommend it and would instead recommend the small claims division of the local court. As stated above, assault in its legal sense does not require actual physical assault. For a quick example see the benchbook provided to magistrates in the local court:

        In a society where we are more or less deprived the right to respond to such intimidation through force of our own, I wholeheartedly encourage you to report his behaviour to the Police.

          I have filed an online complaint with teh police. I described the situation in the text. I think this is important as i go to the same complex 2-3 times a week. If there is repeat action, at least I have a ground to stand on. Although I must mention that i am a completely non-violent person and would hate to be in this situation.

          I'm under no delusion as to how far the police will go. But it's the only check OP can place upon this hooligan in a society where many people get away with this sort of behaviour and the concepts of consequence for one's actions and the golden rule have diluted entirely.

          Also if there is repeat behaviour the incident report can be used by OP in any AVO application they may wish to bring against the shop owner.

          For $300 you should have just bought a new Z Ultra. lol. Don't they retail for around $350??

          Also Sony does have a authorized service center in NSW:

          Fair Trading can't do anything, they legally have no power, they can "try" to discuss with the person to reach a solution but they cannot force a business to comply with Laws.

          You will need to go to NCAT and open a Civil Case against them.

          @striker5950: he was being threatening. he carged from behind the counter in an aggressive manner and was showing all signs that he would assault me if i didnt leave. his girl had to forcefully hold him back. i asked him i would leave if he gave me the invoice. he kept getting aggressive so i left.

          @Crowdedthehouse: you obviously didnt understand what I meant. glass phone as in glass back.. and sony dosent use gorilla glass on their front screens, which is inferior quality to gorilla glass 3 of the galaxy line, I guess i should have said dont buy xperia phones, search up xperia screen cracked by it self. they even crack for no reason..

          if they are going to charge him with anything, it would be a fine, thats it. but prepare to put in time and effort, court appearance maybe..
          if I were you I would name and shame, expose this rat, leave a review on google if you can locate his business. you will hurt him more in the long run.

        Whilst not all are crooks, it's not something that requires skills or knowledge. All you need is a steady hand, a couple of tools and to browse iFixit and you can do all the things they can do.

          That's rubbish actually. Most people have had no practice with tools like a soldering iron and wouldn't know how to diagnose a fault to save their life. It isn't brain surgery but it is something you get better at if you do it a lot. Doing a handful of repairs yourself is going to meet varying levels of success depending on who's doing it and the complexity of the fix. As well as know-how there are specialist tools that aren't economic to buy for a handful of repairs.

          I fixed my own kids' Galaxy Tab 3 when my 4 year old stuffed the charge socket by plugging the charger in the wrong way. But I was lucky that there was no soldering involved.

          @syousef: Yeah, but I've repaired a lot of phones in my lifetime, I've only had to use a soldering iron once. Most of the time, the hardest part is to have a steady hand. You can get the tools for a couple of dollars on eBay.

      I know your pain. I dropped off a pristine phone at at local repair shop with a cracked screen. I was told it'd be ready in 2 hours.
      I got my phone back three weeks later, and it is pretty clear they took at crack at repairing it with household tools. Totally worthless now with a gap around the screen and a special bonus wobbly bit :P

      Unfortunately its rarely economical to pursue these people and you'll put a lot of time and effort into complaining to the Police/ACCC/Fair Trading
      and they'll respond by concentrating their efforts on excuses why its not their job to do anything about it.

      If you want a real result find the appropriate small claims court (probably www.ncat.nsw.gov.au) and put in a claim.

      These guys have watched the youtube videos.

      Not taking anyone sides, but a lot of people when they break the screens, believe that is the only problem, it takes a good knock to break the screens so other damage can occur.

      I always suggest to everyone I know, only get the manufacturer to do repairs. I also love Apple for this reason.

      The glass you have is most likely an inferior product as well.

    Wow. He sounds a shocker. I am not sure what you could do in that case except take him to small claims court. Unfortunately you'd struggle to actually prove that he did the damage, but you never know - if he can't get his story straight with you he may actually be dumb enough to admit to it in a roundabout way. His aggressive behaviour would also indicate some level of guilt and with any luck you'd get a repeat demonstration of his inability to control himself in the courtroom.

    Other than that, are you able to cancel your payment to him in any way? That would go some way towards paying for a replacement. Not sure what the legal ramifications of that would be though.

      • Also he did repair the screen with a new one. Its just that he damaged the phone further.

        Perhaps you could try and get a chargeback on your credit card? Best bet would be to ring your bank and try.

          Thanks. The card has already been charged. I will call Fair Trading on Monday to get their advice regarding this. I dont want to be hasty as he did repair the screen. I will ask them if a chargeback is necessary as i want to limit liability to my end as much as possible.

          - as you can see a chargeback covers goods or services that you did not receive or that were faulty.
          Doesn't matter that your card has been charged already. You have nothing to lose by contacting your bank :)

          Yup, do a chargeback then buy a new phone. A New Z Ultra only costs like $350.
          Give them all your evidence to prove it was dodgy and scam, then they will do the charge back.

          I'm not siding with the repairer. But you need to think:
          For $300, is it worth going to Small Claims?

          You need to pay $47 for the claim, then you need to waste time going to court and stuff to tell them your case.
          All that time and effort, is it worth pursuing $300.

    • Thanks. I will go through the stuff. Also the seller was being quite aggressive and threatening. Do you reckon it is a matter to be reported to the police as I work frequently in the area where the shop is; my main reason of taking it to that particular shop.

      • As someone who has served hundreds of customers a day, you have to come in pretty regularly for me to recognise you. I suspect that will be the same for him.

    Sounds like you really got screwed, TBH I don't think you could find an easy remedy that either gets your money/phone back or find any sort of revenge. I think the most you'll get without possibly inciting violent behaviour from him is taking him to small claims simply to waste his time.

    I'd just post some reviews online, google review comes to mind (I forget how it works but I'm pretty sure reviews come up if you search online, especially when looking up business location on maps). I know this because I left a bad review for real estate and they threatened legal action. I didn't have any evidence of what they'd done so I just took it down so that I couldn't be charged with slander (pretty sure there's a lesson in there too) #1 correspondence by email can't be underestimated #2 don't try to get even if it just causes more issues for yourself.

      Thank you for this. I will definitely look into it. I am not after revenge. I just want my phone fixed. I paid good money for that and the service has fallen short.

    Even more surprising is that this was a 3 week old phone and Sony cant support it with a repair facility here.

    Forcing someone to deal with the clowns mentioned above.

    • Yes I was surprised about that too. But as I was responsible for the cracked screen, I cant ask Sony to repair it.

        I think the original phone retailer deliberately gave you bad advice so he wouldn't have to deal with the cracked screen, which wasn't going to make him any new income.
        If Sony doesn't have its own repair centres, then it certainly has repairers qualified and contracted to work on Sony. Repairers who do warranty work that Sony pays for can certainly do out-of-warranty work (like fixing broken screens) that customers pay for.

    What a load of bullocks, I had a Sony Xperia phone ultra and my screen broke, rang Sony they shipped the phone back for repair, in the end they returned me a new handset. That was in Sydney.

        Yep, it broke in my pocket when I was moving house, so they said they'd put through for warranty claim but if the repair guy decided it wasn't accepted, they would bill. In my case they covered everything under warranty.

    • i discussed with sony but it is hard to prove that the product was shoddy, especially when Sony has acknowledged the fault. i just wanted my phone repaired so i could use it for work.

    I hope this is not the "Glass" phone repair shop in broadway, because last time my mate went there to get his phone fixed, they ended up breaking his phone even more..
    If you phone is broken, better fix it yourself, or sell it cheap on gumtree mate. Normally I would get a quota on how much it will cost to fix it, then deduct the actual price with this quota and get it sold on gumtree..

      Quick Revenge, however with a electronic trail leading back to you, then he can get police to investigate, then Gumtree gives your IP Address over, and they find you. Then bam you are in trouble.

      Sadly this country doesn't allow an eye for an eye, therefore do not break any laws, 2 wrongs don't make a right in this country.

    went to the website, first thing I saw, "Every repair we preform includes a full 3 month warranty on parts and labor, giving you peace of mind!"…. "preform" yeah nice.

    I don't have the same problem but have a similar experience which I can share on threatening behaviors of so called "business owners" of the business.

    A few years back now, I was looking for shoe laces to replace the one my Nike shoes needed, it is a different neon colour type which makes it so difficult to find. I do not have any experience in shoe laces and so I went to the mall to check and I was looking at the shoe laces hanging from a Mister Minit Kiosk.

    I don't know if any of you have been to a Mister Minit kiosk, but they have so many things all over the kiosk and some hanging others in the glass cabinets and some you have to ask for it. Anyways I saw some shoe laces hanging on the one side of the kiosk and they come in many length but they are all sealed up in blister pack and I have no idea which length I need for my Nike. So naturally I took one blister pack and approached the owner of the business, who was at the time quite busy, there was a line forming and I waited for my turn, then it was my turn and I asked the man politely if he could show me the length of the shoe laces I had in the blister pack I took from the display. He said to me, "I don't have time for a $5 item to show you the length or explain to you..I have other customers waiting for me" I was shocked to hear that, $5 for 2 strips of cotton is actually a very rich margin and what does he mean he has no time for the customer.

    I said thank you and left, he then yelled at me so loud as /I walked away that every shopper was looking. It turned out not only he did not want to show me the length of a $5 item he was selling but he was chastising me for not putting the product back to the display where it came from. His behavior was very threatening and I then realize that moment I will never ever shop at any place where the owner of the store is running the store. You must understand these people think they are almighty where you cannot complain to anyone except to them as they are the owner of the business. It's really sad that these business owners give other business owners such a bad name.

    many times I have walked into large stores and ask questions without buying anything and I still get treated with respect, sometimes the store people even offered to open the sealed package to show me the item but I usually say no need.

    It was the most horrible shopping experience /I ever had in my life. Needless to say I had excellent service when I went to Mathers Shoes just upstairs to this Mister Minit, a nicer store not a kiosk, the sales people were so courteous even though I was only buying a $4 item and it was all wrapped and nicely explained and shown to me before I bought it. No yelling no saying I have no time etc.

    That is the difference when doing business with a big reputable store as opposed to some mum and pups store.

      Lol, I had a similar time when I was buying a watch.
      They were trying to push me to buy 2 watches because they can give me a 10% off.

      So I told them I already have one similar, I don't need another watch.

      So when I was just about to pay for the 1 watch, the sales person mumbles to me saying "You already have a $3000 watch why are you being so stingy and not buying this $300 one".

      So I said "Sorry I'm so stingy, I am not buying any of them" and walked out of the shop.

      I know you feel hard done by, but it's not fair to judge small business owners with this one experience. In fact, most small business owners will always treat their customers with respect because they know what's important to their bottom line, i.e. customers. Unlike big businesses who often hire employees for pretty much the minimum wage, some of these small business owners actually genuinely care about maintaining a good brand image and a loyal customer base so they can continue to survive.

      I know a restaurant owner who is a chef and always makes sure his diners get the best experience because he knows that happy customers = more money in his pocket and when running a business, the bottom line is pretty darn important.

    • I had a similar experience with "Key Worx" in Melbourne Central very bottom level just near subway and Pie Man.

      I wanted to get some more keys cut for my house so I went there gave the bloke the key he cut them and all was good till I got home and the keys didn't work. There was a clear difference between mine and the newly cut ones.

      So about a week later I went back explained what happened he threw the 5 keys on the floor really aggressively yelled (not at me more about the shite quality of the keys) slammed 5 new ones on the counter and didn't charge me for them. They didn't work either so I went to bunnings instead.

    Take a deep breath. I know you had a bad time
    But, Let it go and smile, don't make it worse, don't waste any more time and let your brain free off this, if they did not directly physically threaten to hurt you, they probably had a bad day.
    Leave some reviews of the shop online, on their Facebook, Google map and others like the shopping centre website with their name and address plus a part of receipt. You could name them here and their address so everyone knows about them, anyway it is not hard to guess, there are not many in Broadway! It remains forever and others will add to it until it gets back to them one day very bad! When they have a reputation!
    Get your money back of credit card, I am sure most credit cards pay it back.
    And check the phone if sony repairs it under warranty or for a cheap price or buy a new one.

      Hi OP,

      Pal has provided good advice. But there is more…

      You have 5 issues to resolve. First a phone that doesn't work, second a phone retailer not providing appropriate repair assistance because they are required to honour warranties under consumer law and should know the repairers. Third is a dodgy ripoff repairer who has done the dirty on you and fourth his threatening behaviour. Fifth is a phone to get you by at work.

      Pal covers off the third well. Claim the cost of this back from your credit card. You will find a dispute claim form from the credit card providers' website, or visit a branch to get one as you have limited time to claim this. Keep a copy of the completed form as well as any documentation you receive from the financial institution agreeing to you your dispute. This documentation may also help you with my subsequent advice…

      Fifth is can you loan a phone from work or a friend to get by for a few weeks to get your job done? Perhaps the $300 phone mentioned by others can help you with this. If so, buy one and you can sell it later on ebay. Make sure you keep work well informed. The receipt may also help you with my subsequent advice…

      On the fourth, make a report to the police assistance line. It won't help you unless the guy subsequently does something stupid to you or to someone else in the future. Get a friend to go in and get the blokes card with his name and details for the police report and retain the police report reference number. This documentation may also help you with my subsequent advice…

      On the second, you need to speak to the original retailer. That person should have told you the details of a Sony Service centre. If yours was an actual warranty repair (I acknowledge it isn't), they would under the law have had to send it to a Sony service centre on your behalf. No ifs, no buts. Ask them to help you with getting a proper repair done at Sony. Depending on how helpful or reluctant they are, you can report them to consumer affairs. Again reporting may not help you, but could help another consumer down the track. Their behaviour sounds much like a Harvey Norman MO.(Modus Operandi) Again, this documentation may help you with my subsequent advice…

      Now here is that subsequent advice…

      On the first and final issue, having got your money back from the scammer repairer, you will be even on the money front, so go to Sony to try and get a repair done and provide them with all documentation, Police report, dodgy repairer details, retailer details, letters to consumer affairs (if iffy retailer is reported), the receipt for your back up phone (if purchased) and this blog.

      Ask the most senior available service manager at Sony for special assistance on this occasion, because Sony have to date been the only organisation that has not let you down. Be calm and be Zen when explaining… At best they may make a special allowance for the crap you can document and prove you have been through. At worst you may have to pay for the repair and the part. This documentation trail is key to getting them onside with you and as helpful to you as possible (mainly because I would not believe it myself - but life does have a way of delivering bizarre stories that cannot be invented).

      Any other action is wasted energy, that may make you feel good, but doesn't actually get you further to a solution. Be Zen and focus on the solution.

      yes but i got the phone repaired from a local repairer. doesnt that void my warranty?

      • Probably does but there is no harm in trying… Give Sony tech support a call and say it just stopped working. Honestly that is what you should've done in the first place. They probably wouldn't have done it for free but it would've been done properly.

    Get a caught and resolve the matter in court.

    If possible, you can try and see if they can see thru your bluff by sending a notice beforehand. If all else fails, then proceed to do so the whole way.

    Keep your dignity intact and bring those mfers down

    He's guilty as sin. Name and shame. These jerks need to be held accountable.

      He's mentioned it in the post and looks like they're in the broadway shopping centre. They also have a facebook page which is pitiful and a website which looks like it's half-done by a 16-year-old who's doing this for work experience.

      • Appears to be iresq but I guess the key thing is we've really only heard Op's perspective and whilst the story does sound pretty dreadful, the business in question hasn't really had a chance to respond.

    Give us his name and business so no-one else has the same issues. Post it it on facebook etc. Just make sure that you have evidence to back it up.

    Never going to a 3rd party phone repairer again. I simply asked how much it would cost to replace the top bottom on my iphone and was berated by the shop keeper. He never answered my question just kept asking me over and over again if I had stolen it.
