Obviously, I have a vested interest in this - https://www.ozbargain.com.au/node/168750#comment-2352582 - but please fully inform yourself. Do not assume a State Government trustee will offer a good deal.
The public trustee in each state will charge a substantial fee for administration of the estate, and they will be listed as executor in a will prepared by them. In NSW for example, from their website, it is a fixed percentage (as an example, administration of a $500,000 estate would attract fee of 2.42% = over $10,000). Public trustees do have a role (for example, in the long term administration of trusts) but that doesn't mean they should administer all wills.

Free opportunity to give NSW government a portion of my estate. No thanks.

No no no no. I can't neg this possibly enough.

Rapacious fees on your estate for the privilege of a free will which you can get for a piddly $100-$150 from a lawyer, or even less if you go the free will kit route.

Source: I am a lawyer and I have seen the ridiculous costs (even by legal standards) charged by the Trustee. Avoid.

Gotta love the squealing from the legal fraternity when their lovely little earners are opened to others and costs are open and fixed. Rapacious fees? Look no further than the legal system and (many of) its operatives. Want reform? You'll be met with outrage from people claiming to be on the side of Jo Public but delve further and you'll find their interests lie primarily elsewhere. To paraphrase Keating - self-interest is always a good bet.

i think it was actually whitlam who said that:

"October 19, 1989: Whitlam wrote for the London Daily Telegraph - "The punters know that the horse named Morality rarely gets past the post, whereas the nag named Self-interest always runs a good race."

Don't know who coined it first but it pre-dates both Gough and Keating. Keating's version, learned from Jack Lang, is slightly different but PK has largely owned it politically during my lifetime.

I am a doctor. I get calls from the family after a loved one passes. The public trustee are dogs when it comes to wills and estates. They don't release you the money for months after death so the family can't even pay the funeral. Then they take roughly 5% of the cash. The best part is when the family calls me in the hospital and I'm like… Ok yeah that sucks. What do you want me to do about it?
    AVOID

  • I had power of attorney for my parents which ceased on their passing a few months ago. However the bank did pay funeral costs from their accounts on presentation of an invoice from the funeral home.

    • did you get the rest of the money or bank took it?

  • i miss the slater gordon free online will.

  • At the end of the day [or end of days for you] it will not matter to you then, But if you wish to have your wishes [and that is all they are] acted upon and your estate distributed they way you want DO IT BEFORE HAND , will, trust, early distributions [remember The Prodigal Son]and there will be nothing to come back to you if things change for you = GET GOOD ADVICE, SOLICITOR, ACCOUNTANT, FINANCIAL PLANNER AND THOSE WHOM YOU CARE ABOUT ]if you do not have too many partners[.They all should have a input and perhaps know your wishes,

Save now pay a lot in the future.

Also a side comment nah it should be in forums - how trustees should manage things for you and do they do it properly [ handicapped blessed family]

Here we are not saying this mob will not do a proper job but it will always according to their rules and the person handling the client "number"!

    • Good advice.

  • oops sory for the rant, but contained myself.
