    I call BS on their stock level excuse. They didn't offer us the option of waiting for more stock to come in.

    As soon as I made the order, instead of $48.00 showing as the price under My Account, it STILL shows this…

    It took them 7 days to send me an email telling me it's been cancelled, and my ONLY option is to wait up to 30 days for a refund… how can businesses get away with these practices?

    • They are protected by human mistake law. Let's just face the fact retailers are protected consumers are not. We are now unsecured creditors and hope Bupa is not another Dick Smith.

        Human error? In this day and age, websites should be sophisticated enough to monitor stock levels and prevent overselling an item that has sold out.

        It's not like these sunglasses are a discontinued model that were being cleared out. It's a product that is still being made. More stock could be (and probably will be) obtained, they just don't want to honour the sale price… that's what it boils down to.

        Unfortunately I can't call them today, so i'll have to gently abuse them on Monday. I didn't ask for a refund. If there's an option where i'll get the sunglasses in a few weeks or even a couple of months, i'll wait, but the only solution offered was a refund that i'd have to wait up to 30 days for (seriously… it takes them that long?), and offering me a 30% discount code towards other sunglasses is unacceptable.

        I messaged them on Facebook yesterday - no reply.

          According to my last complaint lodged with Consumer Protection, they defined it as human mistake and there was nothing I could do but to accept a refund. Unfortunately within the 30days you are bound to be an unsecured creditor and if unluckily Bupa goes into administration you can kiss goodbye to your pending refund. Like I said, retailers are protected but consumers are not protected.
          Dick Smith is fully aware of this loophole and therefore heavily promote its extra 10% value gift cards knowingly there is no consequence as they are fully protected.

  • Considering the funds were taken at the time of purchase, and it could take another 30 days for a refund, would it be worthwhile requesting they pay back the interest from my credit card for the period?

    I reckon if we all did it we could upset them.

    4000 orders , we each at least spend $50,
    so they have $200000 in their bank..for another 30 days.. (already 10 days, so total ~40 days)

    • Remember, the email mentions 30 business days. So from Friday, that means up to 22 Feb to refund

      • Just lodged through online banking. May receive refund quicker, but mainly as an inconvenience to BUPA.

    Same here got email about refund. What i don't understand if they don't have stock then why when we are ordering online it will let us purchase. The online system must know how much stock they have before accepting our orders.
    I call it is all BS and they want to earn interest on our money for 40 days. As other people disputed i am going to do the same and let them learn. If we all do the same then they will understand consumner power.

      Update - I have now disputed the charge hope we all do the same so BUPA never do this to anyone again.

        • I don't think they have any other solution if they do i will cancel my dispute. I did not dispute because they owe me $48.00 but they let us buy from their website even though they do not have stock(limited stock could be anything). They could have display on website how much stock they have and how much left . Its not rocket science or someone from their web team should have notice 4000+ orders and stop there and then and update the website. i want to see one ozbargainer get the glasses so far no one came saying that they got it.

        • @some_one_some_where: There is no big advantage as BUPA said they will give us refund but same token they said they will given us sunglasses too so…i don't trust them anymore
          Only advantage is you will be sure that you will get refund and don't have to follow up with BUPA. Also as someone said here they might get charged from credit card company for dispute raised so in a way they will be slightly penalised. Its free to lodge with your credit card company or bank.

        • @chutibuti: I've lodged a dispute via commonwealth bank. You have to call them to get your reference number and they'll give you an email address to send evidence to. If you're with another bank, i'd suggest just calling them and filing this under 'transaction/savings inquiry' or whatever option is similar.

  • Bunch of amateurs running a online business. Keeping track of inventory against orders taken is one of the most basic requirement and they cant even do that. OK, that's the whinge for the day.

    I will be lodging a charge back tomorrow too if nothing further heard on this as waiting up to 30 business days is pathetic!

    Hope they enjoy the administration nightmare they will have once everyone does chargebacks.

    I'm giving them one more chance to make this right tomorrow, otherwise will also lodge a chargeback. It would have been a lot easier and maintained a positive image had they simply honoured the orders as they were offered.

    Seriously not one order was honoured… they expect us to believe they had zero stock of all styles? Wouldn't be surprised if they don't honour the 30% off. Glad I moved insurance, dispute will be lodged.

    30 business days?! How can that possibly be justified? If anyone could enlighten me as to how its not as simple as they have all this excess cash from these orders and just need to process the standard 2-3 day refund with banks?
    I want to dispute the transaction but it says up to 120 days with NAB so not sure its worth it other than causing hassel for BUPA.
    They would still be making a big margin off 30% off so is this them increasing cash flow and on top of that trying to increase business from the customers they screwed over?

    Shiite deal. Bought some Oakley sunnies, few days later got email that they will issue refund due to stock lvls. Sounds like bollocks to me.

      Dispute with your bank. Bupa will be charged a fee by the bank (approx $33)

          Just tell your bank you want to dispute the $48.00 charge as you paid and received invoice but more than week later they said it's not in stock.

      I don't have any hope with them I don't think they even care about customers. Best bet is like I said before log a dispute with your Bank/Credit Card Company and let them worry about taking your money back from BUPA.

    I tried calling their 1300 number several times and it's a recorded message telling you to email them or leave a recorded message for them.

    They don't even want to talk to us.

    That p-sses me off even more and makes me want to slam Bupa on every social media outlet… great customer service!

    • Have you got the gift card still? You need to call the service number on the back of the card as I believe they may be able to dispute plus you need to check that the refund will actually flow back onto the gift card ok

    I've lodged a complaint with Fair Trading online - easy to do - provide screenshots of items still for sale. This is considered bait tactics and if a few of us complain they will initiate a formal investigation.

    This is super dodgy because they still have stock online and in store, they simply don't want to fulfill ANY orders at the discounted price.

      • I think they can't change tune as their response to everyone is not that it was a pricing error but a stock issue for the reason that they can't supply. As we have their email confirming that they can't now go and say our bad it was the wrong price.

    • Yeah they don't seem too interested in maintaining good customer relations. On their Facebook they say they are working hard to get the refunds done and update customers but really how long does it take? Worst online purchasing experience I have ever had and I certainly won't be trusting BUPA with my money ever again.

    Thank you for your email.

    Your matter has been assessed for potential breaches under the Australian Consumer Law (ACL). At this point, there is not enough evidence to substantiate a breach. Additionally I note that there is currently no consumer detriment as BUPA Optical have advised full refunds will be provided to yourself due to your order not being fulfilled, though I note they have stated refunds will be provided within thirty business days.

    Businesses are able to allocate an amount of stock to sales. I understand BUPA Optical did advise that there were limited stock available in their advertising. If they are unable to fulfil your order then they have done the correct thing by advising you a refund will be provided. If you wish to enforce the order, you would need to consider obtaining independent legal advice with a view to taking the matter to the Magistrates Court.

    • Told you so. They only look at those points in favour of Bupa to save them from going through the trouble to contact Bupa despite limited stock still available online after receiving the cancellation email. It is waste of time to lodge a complaint to anyone but to do a charge back.

    • So am I and used my debit MasterCard as well. If someone can answer this it would be very helpful.

      • I tried with my account with a Visa Debit card from the Newcastle Permanent Building Society.

        They normally could do it, but because Bupa offered a refund, they advised they would he hesitant to proceed until the refund period specified by Bupa had expired (eg more than 30 bus days) and in that event would likely want to cancel my card so that Bupa could not withdraw any further funds.

        So possible yes, but will they do it based on Bupa's actions - depends on the institution I guess.

    The latest email (13/1/16) in reponse to my complaint emails.

    "Dear ,

    Thank you for your recent enquiry and I apologise for the delayed response.

    The purpose of the recent sale was to clear out some overstocked items. The sale items were clearly identified as a limited stock sale and the terms and conditions confirmed the clearance prices were only available while stocks lasted. The reduced prices apply to the allocated stock and not for any existing or new stock that has since arrived.

    The interest generated by this sale far exceeded our expectations. We acknowledge this error and apologise for allowing orders to be placed after the sale stock had been depleted. We are taking steps to ensure this kind of error does not occur again.

    As we are not able to supply your online purchase at the reduced price a full refund is being provided.

    I can understand being upset about the delay in receiving a refund but rest assured we are working as hard as we can and have already started providing refunds. 30 days is the maximum time it will take but as I say some people’s refunds have already been processed and we hope to have them all done well before the 30 day mark.

    Once again I apologise for the delay and we’ll process your refund as soon as we can.

      I received the same generic response. Word for word.

      There's not much else we can do apart from telling others to avoid Bupa like the plague. Fantastic customer service. They don't even want to talk to you, just fob you off electronically, or with recorded messages.

      Did ANYONE actually get the sunglasses they ordered? They must have been VERY limited stock!

      I called CommBank late last night and disputed the transaction. They were really sympathetic saying that 30 days is ridiculous, that most businesses shouldn't take any longer than 7 days to process a refund. So, my bank will talk to their bank and hopefully something happens in the next day or two. It won't cost me anything, but I hope Bupa get slugged with a fee.

        lodged dispute with cba over charge but Bupa weaselling out of it by saying "old stock" when the new item has the exact same part number makes no sense?
