  • existing deposits before 05/01/2016 will not be honoured,
  • gift cards will not be honoured,
  • Warranty may not be honoured on DSE branded products if the company folds
  • Refunds may be limited

          You're absolutely right.

          To summarise, Employees are paid through the governments fair entitlement guarantee (feg) scheme. The liquidator will contact all the employees from the company's books and records and request that they submit a claim for wages, annual leave,long service leave commissions etc. And once the FEG pays out these employees claims, FEG becomes a secured creditor. So employees are actually the safest of all creditors in terms of getting unpaid wages! They rank ahead of secured creditors including the banks.

          This is not fully correct. FEG protects only permanent employees, Australian citizens or permanent residents, working for Dick Smith at least 12 months.

          The rest are screwed - this includes contract workers and casuals (which would be the majority of store staff), those that started working in the last 12 months, non-citizens/PR (so international students, holidaying/working poms, I'm not sure about our friends across the ditch).

          Sure but you'd assume that majority of employees would be citizens. Sure there will be people that miss out though and that sucks.

          Casuals don't get any entitlements so other than a sucky loss of employment it doesn't make much of a difference to the statement.

          Employees get all their entitlements bar super in the event of a liquidation (if there is one). As I tried to link above and got negged for, the government assists with outstanding entitlements and to say that staff are losing out on their entitlements is wrong.

        The irony is I saw a staff that bought a fair bit of stuff then walked into the Cashies next door…

        • It's no secret staff have been flipping items. Or buying products for friends and family. Staff also tell staff of other stores what's available and reserve stock. I don't hold grudges unless they are taking every bargain item, or multiples but it seems most take one or two things. A TV or PS4 etc. last time so don't have a problem and won't "dob" them in.

        You would think in a situation like this, where the store is still trading, they should be able to be used. After all they are virtually a single store currency. If I had some I'd feel like I should one able to go to a Dick Smith, take some stock, and slap down the gift cards and say,' I HAVE paid for this' and leave with it.

        Really frustrating.

          the company's broke, their assets are frozen, they have no way of accessing the money you've already paid for the gift card. so as far as they're concerned it's taking goods and paying with a worthless piece of plastic. it's not like this is a new thing, when borders, angus and robertson and babyco went under they all either put conditions on gift cards (like you could only use it if you spent double its value) or stopped accepting them.

        • @universe93: I pay to see that court case. I haven't read the terms and conditions that go with gift cards. But logic suggests that if money has been taken and the business is still selling items that gift cards should be honored even by receivers. If the business cease trading and assets are transferred to a liquidation company associated with dick smith then the gift cards would be worthless.

          The problem is that although the name above the door is the same, the business that you bought Gift Cards from is no longer trading.
          The name above the door is legally "a new business".

        A gift card should be considered a liability, and yes, if they shut the doors I could understand you losing your rights to use it. But as they are continuing to trade and taking payments, explain why the hell they shouldn't accept a gift card?

        Why keep going on about the gift cards JV? It's well know that gift cards are not honoured when a business is going under like this yet many people still purchased them (mostly at a discount) and did not spend them straight away.

          No they haven't, many people purchased gift cards knowing that Dick Smiths were in trouble and it is well known gift cards are unsecured creditors. Nobody stole anything.

          People are entitled to expect to be able to use them up until their expiry date.

          So even if the company is gone they should be able to use them! Is that your logic! LOL. You should learn a little bit about companies and how they work especially Pty Ltd operations and look at things like secured and unsecured creditors.

          Actually no, I said that Dick Smiths were in trouble and people purchased their gift cards at a discount in order to save even more. There are examples on this site of people doing exactly that when Dick Smiths has been in trouble for months.

          Gift cards of all sorts are nearly always on sale at one store or another…

          Really so why were there people buying gift cards from this deal (https://www.ozbargain.com.au/node/226624) only a few weeks before they went under? And what about the other threads where people have said they purchased gift cards just prior to them going under including one who spent $650 on them to buy a phone.

          Exactly, some people just can't understand the difference between a retailer making maybe 10% and a service like Skype where the cost of the service is a few percent allowing you to sell gift cards at 40% off and still make over 50% on the face value.

    I bet they get alot of people through the doors tomorrow expecting the sale to be like the last clearance sale, most will likely be disappointed. Time will tell.

      Probably why they are in receivership. Unable to price products properly compared to competition. Sometimes too expensive, sometimes too cheap but 100% epic fail.
