HTC 10 (Topaz Gold) for $487.20 is pretty good too if you want to add it? http://m.ebay.com.au/itm/182446944624?_mwBanner=1

    • Thanks! Spotted that earlier but forgot to include it.

    • +1

Bought one for $550 at the shopping square sale few months ago, best phone i've ever used.

      • +2

Yep, picked one up a couple of weeks ago. Build quality, screen, audio, camera, battery life, HTC sense skin, it does everything really well and doesn't have any obvious weakness or flaw.

        • Bought my girlfriend one and it's great! Although, I have an s7 and it is much more compact with better ergonomics and has a brighter screen. I'd probably spend the extra $50 on that imo.

        • @spazattack91: We're the opposite - my missus has the S7, and I have the 10. Both great phones, but I wanted the 10 mainly because of its audio capabilities (Samsung, who are normally excellent, really dropped the ball with the S7's headphone output).

        • -1

@aja12: Guess that's not something that I've really noticed tbh.I do use headphones most days without issues. Different strokes for different folks I guess!

        • @aja12: Really? The adapt sound feature on the Galaxy S series is fantastic.

        • @maxdestructo574: If you enjoy it, that's all that matters. With cheap headphones, you won't really notice the difference. With a pair of decent headphones, the S7 output is average (well, the SD version is very average). The S5 and S6 before it had excellent dac's and decent amps. The HTC 10 is on another level as far as dac and amp combo go.

        • +1

          @aja12:

Same situation here. Wife has the s7, I have the htc.

Wife wishes she had bought the htc now. The metalic finish makes it feel much more premium.

      • How is the camera compare with S7 and LG G4?

    • +1

Gosh I am so tempted. I have a HTC M8 that is starting to fall apart (Screen lifting say what?) but I otherwise love the phone. A cheap HTC 10 would be golden.

But I am curious to see what the Samsung S8 line up will be. Hoping for their next Note version as I want that stylus!

      First world problems :(

      • +1

I'm using HTC M7. Still going strong with custom rom- wish they bring back speaker grills cause M7 ones are unreal.
Feel like i need an upgrade with current HTC 10 price but i'm holding back to see the next flagship from HTC.

        • Oh yeah I love the Boomsound speakers on the HTC M8. Blew me away when I watched my first video on it.

  • +1

What do you mean by Australian warranty? Warranty is provided by Vaya, not Apple I understand?

    • Yes

      • +4

I'd pay the $180 extra (eg. iPhone 7 32GB) from Ausluck and get Australian stock and local Apple warranty - just not to have to deal with Vaya.

Plus you get it delivered a month earlier and can claim GST back if you are travelling overseas.

        • It really depends on how you use your phone and how ofter you buy a new phone. Did you regularly drop your phone before? Two year warranty is great but not essential. One year apple's global warranty should meet most people's need.

    • From eBay listing:

      Locally serviced warranty repairs
An Australian mobile network based in Sydney

Warranty by Vaya yes, just means you don't have to ship it overseas or anything. I've read conflicting reports about whether Apple still offer their 1 year warranty for overseas stock, assume no and it's Vaya warranty only unless someone else can clarify either way.

      • Thanks for clarifying hamza.

      • -4

        Warranty for Apple products:
iPhone, iPad, Apple Watch: local only

        iMac, MacBook, MacBook Pro: global

        • +2

I've had an iPhone bought in the middle east covered under warranty in Australia in the 1st year.

          Source: Personal experience.

Jimbob, can you back up your claim?

        • -3

          @hashtagbargain:

Apple may restrict warranty service for iPhone, iPad and Apple TV to the country where Apple or its Authorized Distributors originally sold the device.

          http://www.apple.com/legal/warranty/products/ios-warranty-re…

It's not something I am claiming, it's been the case for a long time
And it's at the discretion of Apple and I have personally experienced issues getting warranty on grey imported items. The exception I believe only applies if you buy Apple care and that has to be purchased from same country as a device. As in you can't get iPhone in Singapore and buy Apple care for it in Australia.

  • +10

The store has an eBay score of 3, if it's anything like their service. I would avoid like the plague.

according to their ebay history, user was 1st registered as "darrebel3" on the 12 Dec 2016, then changed it to "vaya_shop" same day per here

        • +3

The eBay store belongs to Vaya, ensured that was the case before posting - it's advertised on their official Facebook page amongst other things.

  • Do they issue a tax invoice with GST claimable through TRS?

    • No GST, it's overseas stock from Hong Kong as per title and description.

  • +4

its a risk to buy from an ebay seller with only 3 reviews….

    • i doubt ebay would add them to the list of 20% shops if ebay has not verified them.
pay with paypal if it doesn't come, claim your money back
      simple

      • What happens when you need to claim warranty 6 months later?
It took my 2 months and 6 phone calls to sort out a double charge issue.

        • just get apple care $189,

i thought apple works on the activation date regardless where the phone was purchased?

        • @volanti:

I'm pretty sure you will only be extending the OS warranty.
Read up on international warranty, Kogan phones have the same issue.
Regardless, extended warranty to fix poor service is not a solution.

        • @volanti:

If you want to buy Apple care you need to source it from Hong Kong. You can not add Apple care bought in Australia to a phone sold in Hong Kong.

        • @jimbobaus: You can't neg the deal because it doesn't have local Apple warranty (none of your comments have actually stated why you have down votes the deal).

        • +2

@aja12: the deal originally said "Australian Warranty", which is a load of shit.

The only warranty you're getting is from the little reseller. Which you have pretty much zero rights to enforce if there is a problem.

        • -7

          @aja12:
My reasons for neg are clear.

        • @jimbobaus: What is your reason for neg? It's not clear, you just talk about Apple warranty?

        • -1

@ChickenTalon: It was cut and paste from the listing, and a lot of grey importers list their phones as having "Australian warranty", meaning the phone is returned to an Australian address for warranty claims. OP wasn't misleading anyone.

The original title of the post clearly indicated that the phones were not Australian stock ("HK"), the prices are also a dead give away that stock is imported, although I can see your point.

jimbobaus has neg'd the deal, but none of his comments justify why.

        • @aja12: Australian warranty was never on the eBay listing. Only ever appears in the deal description (now history) posted by an ozbargain moderator.

There should never be any illusion of an Australian warranty. This transaction is not covered by Australian consumer laws. If something goes wrong you will not be able to enforce your rights against the reseller using Australian law

        • @ChickenTalon: "Australian warranty" and "Australian stock" don't have the same meaning. At no point did the description allude to the phones being Australian stock, with local manufacturer warranty, covered by Australian consumer law, but rather that warranty claims are handled locally, as opposed to having to return the phone to an overseas address (which is not the case with a lot of grey importers).

        • +1

@aja12: Doesn't matter if it's Australian stock or whatever (that's an Apple thing). It's the warranty jurisdiction that's important, and this comes down to the laws covering the transaction. Because the phone is being shipped directly to you from HK there is no such Australian warranty. YOU become the importer.

If they imported the grey stock into Australia and then sold to you, you'd be covered by the ACL as a local transaction. You would have full legal rights under Australian law. The ACL warranty rights are between you (the consumer) and the retailer.

All you have is a flimsy agreement from the seller that they'll look after you locally.

This is totally unenforceable. If they decide for whatever reason to walk away from it, they can and they know they can.

Adding "Australian Warranty" to the deal description is misleading.

        • -2

@ChickenTalon: What do you mean it doesn't matter if it's Australian stock? Of course it does, that's the whole point!

I don't need your input on import vs local warranty, my last 5 or 6 phones have been grey import. I know very well what position I am in if I need to make a warranty claim on phone imported from (insert country of origin).

Go on eBay, see how many sellers use the term "Australian warranty" to refer to grey stock that is serviced locally.

My point was questioning how jimbobaus had justified negging the deal in any of his commentd, as per ozbargain voting guidelines. He hadn't, which is why is vote has been overturned.

        • +1

@aja12: I thought it was a valid neg. I negged myself when the moderator put "Australian warranty". If it remained, I would have reported it because it is a very misleading term to use.

I don't think you're quite understanding how Australian Consumer Law works. I'll agree the term "Australian warranty" is used in such a way that is misleading by a lot of eBay sellers, which makes this confusing. You aren't getting a warranty that is covered by Australian laws if you're receiving goods directly from overseas.

To be clear, if you want coverage under Australian law, the transaction (money and goods) must be conducted locally. Those goods can be grey imports if shipped locally from an Australian business, and you'll still have full rights under the ACL.

    • +1

just ask the official Vaya website and confirm this is their ebay shop

      • +1

Even the Vaya website looks dodgy.

        https://shop.vaya.net.au/collections/samsung/products/samsun…

AFAIK, Australia Samsung does not sell Dual Sim model of S7 Edge. Are they the only MVNO in Australia selling grey import phones? That will mislead a lot of buyers.

  • Anyone had experiencing purchasing off these guys?

    • +2

I highly doubt the three people that have are on Ozbargain.

  • I called and asked a rep at Vaya who had no idea that site existed. I guess the facebook post confirms that it is at least Vaya

    • the Vaya support people just said:"All Apple items come with a global Apple 12 month warranty.

You can contact us if ever you will process any warranty claim so that we can further assist you." Also confirm again it is their shop.. hopefully good luck….

  • -2

Grey import should be in the title. And you're being missleading with the description.

There is no coverage under Australian Consumer Law. This is being shipped from Hong Kong. Absolutely no Australian warranty applies and you will not get a receipt showing GST. At best you might get 12 months international warranty from Apple.

Or you can chance it with the seller 10 months down the track if you have problems. You really think you'll be able to claim warranty from an eBay store on an issue you're having??? Who can you complain to if they decide not to honor???? PayPal will laugh at you, too late for a charge back if you paid via CC. No Australian consumer laws apply, so you can't go to fair trading or accc. You're at their mercy.

Doesn't matter who owns the store. I'm not saying don't buy it. Just have your eyes fully open.

    • I see the deal is updated now to remove "Australian warranty" so happy to remove my neg.

That's much better, but still hugely risky. There is absolutely no recourse should anything go wrong. You're unlikely to be buying from an Australian based company, more likely to be buying from an OS company. Even if that OS company is controlled by an aust company (think Kogan and their integrated OS Kogan company) you have zero rights.

      • I have confirmed with Vaya that they will provide an invoice with ABN and GST.

Although it is a grey import, the company selling it is an Australian. If invoice is from an Australian registered company, aren't they legally bound by Australian Consumer Law (2 years warranty)?

        • I don't think they are supposed to do that for product being sent direct to customer from overseas.

          Goods

A sale of goods is connected with Australia if the goods are any of the following:

          • delivered or made available in Australia to the purchaser
          • removed from Australia
          • brought to Australia – provided the seller either imports the goods or installs or assembles the goods in Australia
        • Why would they supply an invoice with GST?

You really think they're collecting GST on a phone sent direct to you from Hong Kong? They have no reason to collect the GST.

Someone is confused here. Even more concerning.

        • (02:51:45) Marvin: Hi John! How can I assist you?
(02:51:58) John Doe: Is this your store? http://stores.ebay.com.au/vaya-shop
(02:52:49) Marvin: Yes John, that is a part of our online store.
          (02:52:58) John Doe: Ok, thanks.
(02:53:06) John Doe: If I order this phone: http://www.ebay.com.au/itm/iPhone-6s-32GB-Gold-Rose-Gold-Sil…
          (02:53:18) Marvin: Your welcome John!
(02:53:22) John Doe: Will I get a local Aus invoice with ABN and GST mentioned?
(02:54:23) Marvin: Yes John, that is correct.
(02:54:58) John Doe: Good to know that. For warranty claims, I will not have to send the phone to HK, right?
(02:56:21) Marvin: No John, All Apple items come with a global Apple 12 month warranty, you can also contact us so that we can assist you for any warranty claims.
          (02:57:01) John Doe: Ok.
(02:58:03) John Doe: Also, you are aware that as per Australian Consumer Law, the warranty would be for two years? So, Vaya will have to honour that. Is that correct?
(02:58:48) Marvin: No John, All devices come with a 12 month warranty. This warranty is with us, not the manufacturer as what we have are international stocks and this will be serviced here. You will need to contact us via chat or email so we can assist you further for a warranty claim.

        • @newington07: I cannot fathom why they would unnecessarily collect GST on a phone they are shipping direct from Hong Kong.

After 30 June when the law changes, yes. But now?!? It makes no sense. I suspect Marvin is wrong.

        • @ChickenTalon: And now the statement from Ebay shop"
"Apple iPhones are shipped from Hong Kong. You are covered by eBay's buyer protection and ACL. An invoice is issued by eBay but I'm not sure of their ABN."

The chat in my post above was from their website.

        • +1

@newington07: ebay don't issue an invoice for anything, except perhaps your seller fees if you've been selling items on ebay yourself.

Why would they issue an invoice for an item listing?!?! They aren't receiving any money or selling anything, they can't issue an invoice.

          Marvin is very wrong

Can someone explain me how GST claims through TRS works?

Does it means if you spend at least $300, 60 days before going overseas you can claim the GST?

If so, as I go overseas at least once a year should I just buy the expensive stuff e.g. cameras, laptops etc 60 days before?

What is the catch on this? Any problem bringing those same devices back?

    • for starters, you wont be paying GST on these. So it doesn't apply to this deal.

for the rest of your questions the TRS website is pretty good at explaining everything. https://www.border.gov.au/Trav/Ente/Tour/Are-you-a-traveller

    • The catch is, if it's worth more than your duty free allowance of $900 upon re-entering Australia you have to declare it and pay GST on top any customs duties applicable. That's for the entire amount not just the excess over $900.

      • So that means that is better not claiming more than $899 ? All the other devices I will carry but bought overseas or before doesn't matter right?

    • Provides Australia Tax invoice, it should show how much GST you can claim back.

Grey import, you may not be able to claim GST back, and your risk to pay for import duty if its value more than $1000

  • How long is shipping realistically speaking? A couple of weeks via HK?

    • +1

Its like a month according to ebay estimated delivery date. I have bought from a grey importer from ebay before and it took only 4 business working days, and it was also delivered after 6pm when i was at home.

I'd pay 120AUD more for Aussie stock iPhone 7 Plus 128gb… The store is price jacker Aus_luck though.

    • Their phones are higher than the RRP from Apple at the moment lol.. bastards

      • Yeah i know they are renowned for price jacking when it comes to eBay sales. However they are cheapest if compared to Mobilecity atm. Abit cheaper when it was 10% site wide eBay against Mobilecity

  • +1

In spite all the grey import comments, each to their own. I bought my wifes iPhone off eBay grey import, and u save heaps.

To put it into perspective, if u save around $150 per phone that costs around $900, You effectively save a whole phone every 6 purchase, so if u think phone issue rates are higher than (1/6) you should stick to Aussie stock. If u think phones have a high reliability/built quality than 83% u should go with the savings.

Personally, I dont think apple has a 1/6 phone issue rate.

    • With local iPhone you get that additional 1 year ACL warranty for that peace of mind.. For any other phones i'd go for grey import if they're cheaper

      • +2

I'm simply trying to put a probable approach to a bunch of opinions by many.

Too often people spend based on feelings or close infouences, not based on probabaility or statistics.

Based on what I think, of likely failure rates, this grey import price is a bloody bargain.

        • Thank you for your opinion :)

  • +4

Make sure you buy what you really need, don't get sucked into the Hype. Mobile phones will always be superseded by newer models.

    • hahahaha, i am so tempted to buy an iphone though i have already bought a new phone recently.

      • +1

I know right, I just got a new phone a few months back. It's so tempting. hahahaha

    • Needed that reality check haha. Thanks mate.

      • check mate? yeah?

    • -1

Agree…Prob not a good time to buy an iPhone, wait for the new update in Sep, will definitely be a big improvement.

  • So tempted..

  • Great price for the S7 edge, but only 3 reviews within 12 months? Better wait for the S8 in a few weeks time.

  • damn tempted by HTC 10.. however still like an iPhone lol

  • Is additional GST payable on the phones above $1000 ?

    • No, they will take care of that

    • Yeah, once your phone has been received by customs you'll probably have to pay duty and GST.

You can calculate the fees from link on this page:
      https://www.border.gov.au/Trav/Impo/Buyi

      • Vaya will take care of the import tax, so feel free.

        • No they won't.

        • @tranter:

          New message from: vaya_shop
          Hi,
Yes, we pay the import tax at the Australian border if applicable.

        • They have no idea what they are talking about. If the item sent from Hong Kong is addressed to the customer fees, duty and taxes are paid by the addressee (the importer). It's got nothing to do with Vaya.

You literally can't trust any info Vaya give you.

        • @tranter: I am not worried about that.messagesent via ebay message, it should be fine as an evidence. I can open a dispute and request the tax if on my side.

  • +2

I just recently bought an HTC 10 through the vaya website (not ebay store). Very happy with the phone. Shipping took about 2 weeks.

    • Did it come with GST invoice? It came from Hong Kong?

  • Yep from Hong Kong. Not sure about the invoice. I think my gf threw it out.

    • No GST Invoice, just a purchase proof. No GST can claim back at all.
