    On your website you list a living will as being valid in all states. The form you show is definitely not valid in Queensland.

    A "living will" or Advance Health Directive must be done on an approved form (the one on your website is not) under section 44 of the Powers of Attorney Act. The form you sell on your website is not legally binding and not an approved form.
    Also nominating someone to be your decision maker in the living will you sell is worthless and not binding. It needs to be done on a Short or Long form EPOA (Form 2 or 3) to be valid.

    You need to update your website as this would be considered false advertising. 30% off worthless is not a bargain.

    Good to hear from you. You are confusing two documents. A living Will is NOT a Power of Attorney, it is simply a document setting out what you want to happen in terms of medical treatment, should you become incapable of speaking for yourself. It does not assign any legal powers to anyone, just specifies your medical wishes.

    No they are not confusing two documents at all, they are entirely correct. You're providing misleading information and your forms are not valid, contrary to what your "official" website would have people believe. I'm actually concerned you haven't even grasped the issues based on your reply to his/her comment.

    To be valid in Queensland, an Advance Health Directive needs to be filled out on the form recognised in the legislation.

    Your own example at https://www.quickwills.com.au/g/sample_living_will.pdf is entirely invalid. It includes a section about appointment of an EPoA, (which you've just said it doesn't - have you actually checked your own website?) and is invalid. The terminology and scope is also not consistent with the approved AHD.

    Your website and forms are misleading and invalid and will not be recognised in Queensland. They are not worth the paper they are written on. I'm not sure about other states and territories, although I can form a fairly educated opinion that they'll face similar issues.

    I'd suggest you review what is actually on your website as it's incorrect, and refrain from providing further misleading information.

    Source: I'm a Qld hospital doctor with experience in geriatrics and in how AHD and EPoA matters are currently applied in actual clinical practice / decision making at end of life etc.

  • The links you provide point to Power of Attorney documents. As we pointed out these are two different things. A living will or advance health care directive conveys no legal power. It simply lists your wishes concerning medical treatment. It is a way to notify your relatives and doctors of your medical wishes - it is not a legal document and does not confer any powers.

    I don't know why you are making up these things - the form does not "includes a section about appointment of an EPoA", that is completely untrue.
