Found this online, yes it's probably 99% a mistake, but let's see if we can get it! It's unavailable online, but tomorow I'm going to see if I can get this for the same price in-store.

and using the code "MEDIBANKBIGW" (Thanks btaussie!) you can get it for $15.80 posted. The item is currently 'On Order' so right now we're awaiting to see if they will be shipped or not.

EDIT 2: The page above is now dead, it appears they have finally realized what's happened. The real thing now is to wait and see if they honour it.

          Ah huh. So you just so happen to know 9 other people who have bluray players and would love a copy of BTTF trilogy.

          Orders like that are what start the "alarm bells".

    • Ok, I paid via paypal (funded by bank account) as well.

      Paypal says it took money from my bank account to pay big w, but when I check my transactions online, nothing regarding big w is found.

      As far as refunds go, nothing.

      What the hell is going on?
      It looks like no money has been taken, so money will be refunded, yet paypal is telling me otherwise….

    I noticed a mention in another forum of someone who had a similar experiance in a store, they called Fair Trading and the response was "Bottom line was, if I had already paid for the items and they were correctly described on the receipt then they must fulfill the contract of sale."

    Sounds like us, already having paid for the goods.

    • We never got sent reciepts though, only confirmation of our orders, in which it specifically states on the sites conditions that it doesnt constitute one

      • When you ordered they ask at the confirmation page (saying the order has been completed) that if you want a receipt to please print that page as that will act as a printed receipt. I printed it off but it's at home so I can't double check maybe someone else can if they printed it off? (on iPhone)

        • I have my printed receipt too. I chose not to use any discount codes thinking they might try to cancel my order for using an unauthorised code or something if it was intended for medibank members only. As far as i am concerned I have a receipt and I expect them to honour it. I'm yet to receive the cancellation email or refund but like others I didn't register on the site first.

          I not only want them to honour it, I want them to honour us! I wont be satisfied unless they pay for private party for the victims (us) of the 2010 Back to the future blu ray disc catastrophe. including a red carpet anytime we enter the store. I will be calling them to request this and if they dont, I will contact a current affair. The more who get involved with this the more chance we have in getting or all expenses paid party.

    • It would probably be quicker just to wait for them (Big W) to process the refunds. Disputes are long drawn out process that really only benefit PayPal - they sit on your money for days.

    • That's also how I paid for my first order, straight through PayPal. No email so far. The second order I made via registering on the site and I have got the email. Both paid via PayPal existing balance, but no refunds forthcoming so far.

  • How about the ppl that say they got it price matched from JB post their receipt so others can try and price match it also.

    • I dont think its fair for JB to be out of pocket when the store who made the error wont honour it. I will be trying in Big W though, until I get what I want. I will continue until the end of next year, even if it means going into the store every time im in the area, and phoning them requesting the same thing, even if it ends up to be just for the entertainment value or until ive got around $50 worth of staff work time on the phones and in store. That will teach them to mess with the dr ;) They are in for an exciting year!

    After finding out the ACCC were AFK today, I called the Victorian equivalent, Consumer Affairs Victoria.

    I spoke to a very helpful person there, explained the situation, and my take on it (they accepted the transaction by charging the credit card, etc.). He asked if they were processing a refund, I said they were. He explained that since the consumer is not ought any money, CAV would not be willing to get involved.

    I asked if (while I understood that CAV would not get involved) my understanding of the implications of charging my credit card was correct - and he suggested they were. And that if I wanted to pursue it further then there was [something] Tribunal where I could pay my $37.50 and present my case.

    He pointed out, very correctly, that the first thing to try would be to send them a letter. And I pointed out that I'd tried calling them with no results, but I can certainly see how writing a letter would be the thing to do.

        BIGWentertainment happened to catch me in the small window of December/January where I had some free time. And, well, considering I've learnt a fair bit about Australian trade law in the past 6 or so hours, I'm quite happy with my knowledge-inducing hobby :P

    Anyone know the email address of Julie Coates who is the director of Big W. Tried all of the standard @bigw.com.au and @woolworths.com.au, but they have all bounced back. I'm sure once she caught wind of it, there might be some more decisive action. I have worked at one of the big boys in the past, and most of the time when an error like this comes up, it is covered up, with no customer issues ever getting to the bigwigs. Sometimes they would be horrified if they knew they had p*ssed so many people off.

    We realize the product was still showing on the website at the time of your e-mail, however the product has now been removed. The issue regarding these products relate to a system glitch which occurred whereby we had incorrectly quoted the price of $10.80 for Back To The Future / Back To The Future 2 / Back To The Future 3 (Blu-ray).

    The titles will be re-listed as soon as these issues have been rectified. "

      My basic understanding of the law is that if they've charged you, it constitutes a contract. As above, I've just sent a (politely worded) letter of demand via registered post to their Customer Service Manager.

    • Well I just checked the BigW Entertainment and the product has been removed. BUT it wasn't removed yesterday when they sent the email saying it was. I think they just did it now to justify their previous email.

  • Its been 5 days since I bought it and no email, no package and no refund. Will they send it to me or what! Are they just gonna stare at the box discussing if they really want to send it out!???! They could at least tell me what their doing about it…its frustrating!

  • Does anyone else find it annoying that they send you an email that states:

    "Unfortunately, your order for the product has been cancelled and a refund has been issued"

    but they don't actually REFUND you. So lame. I mean, I want to go spend my refund at Amazon - I love them, they don't cancel my orders (except for that Battlestar Gallactica thing LOL)

    • My understanding, and could very well be wrong IANAL, is that regardless of what their T&Cs state - they are unable to do that.

  • So when can we actually expect a refund? I got the same email stating that a refund has been issued but there's no sign of a refund in my Paypal since I got that email over 36 hours ago.

    • I got mine back after threatening to make it known in the store if they didnt refund and also opening a case in paypal.

    • I have it in my paypal atm. But from past experiences, it takes another 1-2 days before you'll receive it in your credit card.

      • im not sure if you can get this put back in your credit card, but ive never had a refund like this before. I think you have to either pay for something else with paypal or withdraw the funds to another account.

        • I recently got a refund from COTD. First, you'll see the refund on paypal. Then 2 days later, you'll see it gets credited back into your credit card.

  • I got the email about "not currently available to order" for BTTF. But I also got the same email for Iron Man 2. I don't like that they make it sound like a supply problem but then openly admit that some idiot (human system) made pricing errors when their explanation is challenged.

    My friend managed to get some of the blu rays for $12.87 as well. He went into Big W with a printed price list from the bigw website and they gave him the thumbs up.

    Part 5 Fair Trading, 53 Accepting payment without intending or being able to supply as ordered (TPA s 58)

  • Jeebus what a mess!! I also got the email… Used the Medibank code upon checkout. Paid via PayPal. Received confirmation…the works. Am awaiting a refund. If they're so quick to cancel an order like this, they should also be as quick to issue the refund and honor their word as stated in their mass "oops we fu*ked up" statement. Seriously, I'm pissed off. First they bungle up the 'Toy Story 3 Blu ray' deal last month and create a bungle there. Now this. What's next??? Whoever is managing "Big W Entertainment online" is doing a very piss-poor job at it. End of rant.

    i spoke to a man today his name was micheal in bigW entertainment. He was quiet smug about not getting the price for the blu rays and i told him in the past this happened with the call of duty world at war for 10. So i went into the store and told them to match the price , they said no of course and then i phoned micheal and told him im in store and could he approve it and he did . So im guessing this will be good enough for everyone in nsw. Just how to upload the receipt i took a photo of it , its on my desktop how do i get it here.?

  • The only small gain we all get out of this is that Big W can't sell the Blu-ray box set for a couple of weeks until this all blows over.
    Hope you lose heaps of sales and money Big W. When you stuff up, you should honour all of the (somewhat) innocent customers.

  • Not sure why Robzy is getting flamed, a few others have said the same thing but essentially:

    1) Price listed on website = Invitation to treat (i.e. non-binding)
    2) Completed order = Offer (i.e. non-binding)
    3) Payment accepted = Acceptance of contract by vendor (i.e. binding)

    I'm surprised that PayPal aren't assisting….

      Yes but its a very large store, maybe they should close the website down or put warning messages over the site if they cant run it properly. I dont think this is a one off occurrence over Christmas either, they seem to do it all the time.

  • I just received my BTTF trilogy bluray for $12.87 + $4 postage. I ordered it from the BigW online store (not the BigW Entertainment site that I think was mentioned elsewhere). I found it on the website a day before I noticed the OzBargain post, so maybe I was just early and lucky enough to have the order honoured. Only problem is, the security red/green lock on the case has not been removed, so now I'm researching how to get the case open!
