    • and both arent worth the paper they are printed on.

      you go to the trouble of putting down your wishes on a legal document, and if your 'loved ones' dont agree with it they can contest it anyway.

      • … a will is not ironclad.

        If your relatives get along and are happy to follow your wishes, then the will can make it easier to distribute things.

        If they want to contest, then the effectiveness and value of the document can drop a lot. (ie the court can override your will, potential for a member of the family to inflict cost, expense and misery on the rest of the family)

    This is not a set price, its "from" $264 with no other details. I would expect to read this in a newspaper advertisement. Spam.

      I have not looked into it, but, maybe the Rep could write if there's anything different between what they offer and what we'd get in a post office kit; also how the pricing is calculated given that they've only provided a minimum price

        I can answer this.

        In this case, lawyers prepare your will. If you go to the post office, you prepare your will. If you are a lawyer, the result is likely to be, more or less, the same.

        Otherwise, you get what you pay for.

        Whether or not $264.00 is an excellent price, I couldn't comment.

          if you have common sense and can do some search via google, the will done by you will be the same or even better quality as the one done by a LAYER for $264.00.
          Do not forget that law firms hourly rates start from ~$350 + GST.

    Just to clarify: It is 20% off our normal price of $330 (see http://www.fclawyers.com.au/fclawyers/pages/home-5/category:…). We are a fixed price law firm and don't charge per copies or time. A very few amount of wills turn out to be quite complex which is why we said "from $264". This offer has been created as part of the Queensland Wills Week (http://www.pt.qld.gov.au/wills-week/). Hope I could answer all your questions.

      Perhaps, but I would imagine that would involve appointing the public trustee as executor - and they charge higher rates than your local law firm would.

        They are indeed free through the public trustee & I'm yet to see them charge more than any law firm.

        • They charge you when they administer your estate up to 3% depending on the value of your estate.

        Oh for f**k sake…get a WILL KIT through the public trustee…just because you get the will kit through them doesn't mean you have to use them as your executor! Just name whoever you want as executor! What next…australia post being the executor of your will since you got the kit from them?

          And you MUST appoint them as Executor if you want any kind of Will.

          In QLD at least the public trustee sells will kits, they sell them for $0.

          They also don't force you to make them executor.

    • You will never know if your son Will will try to sabotage your home made will from your other kids who will end up on the streets if you don't get professional help on your will.

      If you have any sort of property, even if it's just super, you owe it to your inheritors to make your intents clear. You don't have to be at death's door to make a will. And making a will won't hasten your demise.

    Its pretty funny that people consider a 'legal Will kit' from the post office to be similar to the Wills created by a lawyer.

    Please by all means do a 'legal Will kit' then when you pass away your family can go and see a lawyer to interpret what you wrote, maybe they will even have a bit of a fight about its meaning, maybe they will even go to court to fight about it…

    You can either pay a bit to the lawyer now or a lot to the lawyer later, either way you pay.

    FYI Got Wills done that cost $550 for both me and my partner.

      not like that doesn't happen with wills prepared by lawyers.

      Even for lawyer prepared wills and testaments, family will still need lawyers to interpret it, and may still go to court to challenge it.

      Having said that, although a DIY will is better than no will, a professionally prepared will is much better than a DIY. At the very least, it is often just useful to have an opportunity to talk to a lawyer about your will.

      no matter what you gonna do now, if there is a dispute later on, the parties involved will have to pay a fortune to have it settled or won.
      do not be naive it is the way our court system works.

      NO NO NO it is not pay a little bit now or pay a lot later

      a) if it's your will, you're supposed to be dead when it's executed, so you do NOT pay a lot later :P

      b) I am watching a case right now, where what should happen is being disputed, even though there is a will written by a lawyer. (It's also not the first case I've seen where this happened :S and you'll also find plenty of cases in newspapers and if you look into court case listings)


      There's something that bugs me about the wills.

      If you do go to a lawyer to make a will, they should ask you a bunch of questions.
      Why are you leaving things to these people?
      Why are you leaving other people out?

      The lawyer may take notes.

      If the lawyer takes notes, you can probably ask for your own copy.
      You may want to write a letter based on these questions to include in the will. (Especially where you have excluded people, particularly people who might make a claim on the inheritance)

      The reason is, after you pass away, you don't want the people inheriting from you, to be reliant on a lawyer as to how you answered such questions, so many years ago.

      I am watching one case where the inheritors are relying on a lawyer for this very thing :(

      The lawyer stalls them, delays communications etc but the people are afraid of getting on the bad side of the lawyer (so instead he treats them badly) :(


      Anyways, it's probably a good thing to write a letter telling your side of why you are willing things to various people (and why you are not willing to anyone else).

      Keep it polite. I'm not sure, but it might be possible to have a libel case in some circumstances.


      And remember, most importantly, I'm not a lawyer etc :)

        Maybe we should include it in our will that we don't want the money going to the government as "death duty" too ;-)

        PS. Actually if the lawyer(s) make a mess of your will/leave it ambiguous when writing it they will probably generate more work/money for themselves when it's contested… Hmmm… ;-)

    • I don't think so but I'll double check with our solicitors who are doing the wills.

    Get a will done. That way if your kids cause you grief you can "encourage" them to change behaviour by saying you'll take them out of it… ;-)

        If people are doing things that bother you, try and talk it out with them.
        If it cannot be resolved sufficiently, then walk away or make peace with it.

        Though it is nicer, if it can be resolved without having to use issues like wills, to get the other party to "come to the table" for discussions.

      • What if they are the main beneficiary in your will and they kill you (like so many tv plots), is it ok to haunt them after at least? lol
