  1. Information on how to claim and the offer form part of these Terms and Conditions.
  2. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  3. Offer not valid in conjunction with any other offer.
  4. Offer is open to permanent residents of Australia aged 18 years and older. Employees and their immediate families of the Promoter and its agencies associated with this offer are ineligible to participate (Eligible Claimant).
  5. The promotion commences on 28/04/2011 and closes 11.59pm 27/05/2011 (or while stocks last) (Promotion Period). All claims must be received by the Promoter by no later than 11.59pm on 27/05/2011.
  6. To be eligible to claim, individuals must purchase one (1) participating 1L Rosie chilled juice/drink* with a promotional necktag from a participating retailer during the Promotion Period (Qualifying Purchase). * Participating flavours include – "Rosie Ruby 1L"(Apple and Cranberry); "Rosie Blue 1L"(Apple, Cranberry, Blueberry & Elderberry)
  7. To claim, claimants must log on to www.lifeisrosie.com.au and fully complete the online claim form including entering your promotion code, the last five (5) digits of the product barcode and the last five (5) digits of their purchase receipt.

    You must retain your Promotion Necktag and Receipt (Proof of Purchase).

  8. Claims are limited to a total of the first 5,000 valid claims received by the Promoter. Subject to this overall cap claims by SA residents are limited to the first 1,000 claims received by the Promoter (Claim Limit).
  9. Each valid claim received during the Promotion Period will receive a $5 Coles Gift Card (Coles Gift Card).

    1. Coles Group Limited is the issuer of the Coles Gift Card but is not the promoter of the offer and is therefore not responsible for the prizes, products or services under the offer or the fulfillment of the offer terms. Coles Group Limited is responsible for the fulfillment of the terms and conditions of the Coles Gift Card. Coles Gift Cards are redeemable at participating stores only. Participating stores may change from time to time. Coles Gift Card terms and conditions apply.     2. Any ancillary costs associated with redeeming a Coles Gift Card are not included. Any unused balance of the Coles Gift Card will not be awarded as cash.
    3. Coles Gift Cards are not transferable, exchangeable or redeemable for cash. Coles Gift Cards must be taken as offered and may not be varied.
    4. The Promoter is not responsible for any Coles Gift Cards that are lost, stolen, damaged or tampered with in any way before they reach the claimants or after they have been released to the claimants.
    5. Claimants will be notified within 28 days from receipt of their claim as to whether they have been successful or not and successful claimants will be posted a Coles Gift Card within that time frame. The Promoter’s decision is final and no correspondence will be entered into.
    6. All claims may have already been received by the Promoter by the time a claimant makes their Qualifying Purchase or submits their claim and the Promoter assumes no responsibility for such purchases or claims made in circumstances where the first 5,000, or in the case of SA residents the first 1,000, valid claims have already been received by the Promoter.
    7. Claims are deemed received at the time of receipt by the Promoter.
    8. The Promoter reserves the right, at any time, to verify the validity of claims and claimants (If requested by the Promoter, Eligible Claimants must produce, within the time requested by the Promoter at its absolute discretion:

      (a) appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim the Prize (if drawn) and compliance with these Terms and Conditions; and

      (b) their Proof of Purchase that corresponds to all claims they have submitted in the Promotion.

      If the items required by the Promoter are not received or a claimant has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the claims(s) submitted by the claimant will be deemed as invalid.

      Claims will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction.

    9. Incomplete, indecipherable or illegible claims will be deemed invalid.
    10. A valid claim is one that has all sections of the on line claim form complete and otherwise complies with these terms and conditions.
    11. Strictly only one (1) claim shall be permitted per household or IP address. Any additional claims made shall be deemed invalid.
    12. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
    13. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in offer value to that stated in these Terms and Conditions; or (e) any tax liability incurred by a claimant. The Promoter (including its officers, employees and agents) assumes no responsibility for any costs incurred by the claimant in relation to this Promotion, including, without limitation, costs to travel to the claimant’s bank to deposit the cheque, other than those that are expressly set out in these terms and conditions.
    14. All claims become the property of the Promoter.
    15. Details from claims will be collected and used for the purpose of conducting this promotion (which may include disclosure to third parties, including where relevant, local lottery authorities, for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By participating in this promotion claimants consent to the use of their information as described. If the claimant has 'opted in' when participating in the promotion, they also agree that the Promoter may use this information, or disclose it to other organisations that may use it, for marketing purposes ( including electronic communications ) without any further reference or payment to the claimant. Claimants may access, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy by contacting the Promoter in writing at the address below.
    16. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

    So no guarantee you'll get the gift card, especially since the promotion started 3 weeks ago.

      You can always get a refund if you hang on the receipt.

        Unless you mean the 10c recycling refund… in which case… no, you can't. Unless you're in SA.

          Also I bought today and didn't realise you needed a special necktie (just thought it would be printed under the label) so was ripped off :(

          As above - no, you can't. Refridgeated items can't be returned.

          I'd also think that trying to return it over a week later (you need to apply for the gift card and wait for confirmation) wouldn't help matters either.

    I'm guessing like most other juices out there, there's enough sugar in it to give you Diabetes! (and potentially for generations!)

      In moderation, I think they're OK.

      I don't know why someone negged you, though. Juice (and smoothies, and the like) destroy the fiber content in foods, making the sugar much easier for the body to absorb.

      That's one of the reasons excessive drinking of juices has been linked to diabetes, among other illnesses. So, what you said wasn't incorrect.

    was just at my coles today, it was not on special, cost $4.99 and no special neck tag either. it self was stocked very well so i wonder why!

    Badly worded entry form and conditions. There is nowhere to enter the receipt number and the full barcode must be entered, not just the last five digits as stated in T&C. I often wonder whether a company that produces a product is aware of the incompetence of the marketing companies they may employ to manage promotions.
