[WA, VIC] Nintendo Switch Lite Console $219 @ The Good Guys (O'Connor / Highpoint)

The previous deal was marked as incorrect, however I purchased the deal from Good Guys in O'Connor, WA today for $219. The shelf price confirmed the deal at $219 (as per photo). When they scanned the product, it came up as $299 in the system, but they honoured the shelf price and paper advertisement price at $219.

          • @profar: This has nothing to do with pricing errors. The law on this is clear, advertised prices are an invitation to treat, not a contract so they are not binding. Nobody has to sell you something at whatever price.

            • @p1 ama: Pricing error or intentionally how does ACCC tell? Like I said a retailer can advertise one popular item at below cost on every weekly catalogue and once the consumers​ get into the store with intention to buy this items with some other items at the same time. The retailer could at least gain from other items sold at RRP by simply telling the consumers that the item advertised on catalogue was incorrectly priced so they have to pay RRP for all items. Note I am not talking about TGG but all other retailers can apply this strategy.

                @wtfnodeal: A business making deliberate pricing errors in catalogues to get get people through the doors, in the hope that they'll make other purchases (despite being pissed off over their "deal" being knocked back) isn't going to last too long.

                It would be up to the ACCC's discretion as to what they judge as an intentional error.

                • @dm01: Not necessary all Australian consumers are OZB members. Some get the paper catalogues and walk into the store to find out $299 not $219 and therefore if the sale person offers $289 they may still happily pay for it because it is still $10 cheaper than most other competitors. Another example is one consumer wants to buy 20 1/2 price items advertised on Woolies catalogue but 1 of the 20 is in fact full price so if the Woolie store is 10 minutes away from Coles the consumer might as well pay full price for it to save time from travelling to Coles.

  • Just tried my local store (QLD), they had the catalogs there with no notice of price error, the sales guy grabbed one from out the back and was about to process when another guy came pass and mentioned “hey you know there is a price error with those, there’s been like 5 emails about it”

    Was offered the discounted price of 289.
    Oh well.

    I was able to get one this morning at the Hoppers Crossing store in Vic at $219.
    Originally rung up at $299, at the register I queried it and the lady turned to someone, obviously a manager, he nodded and said $219.

    I just got two at my local vic store I rang and scanned at $299 but said will do the catalogue price I showed pic s good

    • Tried Essendon around 2 this arvo and they are no longer honouring it, said its come from head office. He did mention that he sold quite a few this morning, so I was just abit too late

      Try to get the catalog to ask a old guy, as the system shows $299, but the old guy speak with his manager and get price drop to $219.

        I actually tried again with the catalogue and the manager sorted it out real quick. Said they were honouring the lower price. Got one!

    Just purchased 1 from moore park nsw. Walked up with catalogue and asked to purchase 1 - she get one from desk, checked catalogue date and sold to me for $219.

    Can confirm $219 at Good Guys Frankston this afternoon. Picked one up for my son who has been putting his pennies away.

    Scanned at $299 but honoured the $219 price on the shelf.

        Yes i did, i even tried to speak to their managers but they said it has been instructed by head office not to sell at $219. They even printed an “ apology price error” note at the counter lollll

  • No luck at Castle Hill. They had a heap of price error signs on the shelf so the catalogue saying $219 was no good. Spoke to a rep in store and I offered that I would buy accessories to total $299 but he said the store manager got a very firm directive from higher up not to sell for $219.

  • $219 honoured at Nunawading, VIC. No dramas, no questions asked. No signs up about any incorrect prices, catalogue at the front still saying $219.

    Since there's some misinformation here, thought I would do a bit of an FAQ to try and answer some of the most popular questions from the POV of someone who used to work at the ACCC and is quite familiar with ACL. Anyway,

    1) Do TGG have to honour their advertised price?

    No, advertised prices are an invitation to treat, not a contract. They are allowed to sell or not sell to you at whatever price they choose.

    2) Is this price discrimination if some stores are honouring and some are not?

    No, see above. They are allowed to sell for whatever price they wish.

    3) Can we (or should we) force stores to honour price misprints?

    No, this is practically impossible. It would imply that you are contractually obliged to honour advertised prices, which would cause all sorts of different issues. This fundamentally infringes on the freedom of someone (whether they be an individual or store) to decide whether they wish to sell to someone or not.

    4) What does the ACCC think about this…etc.?

    It ultimately doesn't matter because it's up to the courts to decide, not the ACCC. The ACCC can choose to fine TGG, for example, but my experience would tell me that the legal case is weak and wouldn't stand up in court. You wouldn't want to start a fight that is basically unwinnable.

    5) Is TGG doing this "on purpose"?

    In my experience of looking at these sorts of things, it's extremely unlikely anyone would misprint a price just to "get customers in their stores". This is not 50 years ago where you had one electronics retailer every 20 km. There's literally a Harvey Norman, JB HiFi, TGG, Officeworks, Bing Lee…etc. within walking distance of each other. The argument that TGG somehow gains a competitive advantage over the others simply by "bringing you to their store" is just not really valid. If anything, TGG has lost massively from this silly misprint because:

    • Many stores have honoured the price, which is well below cost price (which I'm told is $285 for TGG).

    • In the case of not honouring the price, they're actually upsetting the customer and making them more likely to shop at their competitors (who are literally a 30s walk away).

    • They've had to spend significant hours and cost in rectifying this issue by reprinting catalogues, contacting stores, issuing apologies…etc.

    6) Are these sorts of misprints good or bad?

    Obviously good, some of us (including myself) managed to get it for $219 and not an insignificant number either. If there were never a misprint, nobody would have gotten it for $219.

      One of my mates is a store manager at TGG, I doubt he has any reason to lie to me about it. But hey, don't let my source pop your speculation bubble.

      • your mate is probs right , apple and gaming you dont make any money , im sure the stores were honouring it for goodwill or they couldnt be bothered arguing during a busy time of year or they had heaps of stock and were just happy to get rid of them….lets face it the loss made against the days sales is fairly minor

    Price sign of $219 was still up in my local store at Capalaba today so they were selling at that price. If it was an error then the sign should have been removed but it wasn't so while the signage has that price they are and should be honouring it.

      • Happy to share the info. I'd picked one up the week before for $224 which was a price error but they honoured it however it was grey only. They swapped the grey for an aqua with the new price of $219, happy to see that the store is doing the right thing and selling for the signed price with an issues.

    Just bought 2 from Capalaba for my 5 and 8 year olds. There were only 3 left in yellow, 1 now.
    $219 on the shelf still so no problems as you’d expect.

    *Edit, first tried Loganholme with no luck. $299 there.

  • I picked one at Moore Park at $219 and got buyer's remorse soon after.

    • Why? You can sell it on Gumtree for $250 or so if you want to.

      • I guess that really wouldn't be fair to people who genuinely wanted one (there was two left at Moore Park, ftr). My big issue is that games do not depreciated in value for the Switch (unlike PS4 and the XBONE). Games released over two years ago are still selling for the same price as day one. Even the market for used games is high.
