Neighbour Lifting Weights at 4:30am

So I will keep this short.

Neighbour is lifting weights at around 4:30am in his garage which is closely located next to my bedroom.

We have told them before to maybe invest in a mat so when he drops it, its not directly onto the concrete floor.

They keep doing it, not every night but its bloody annoying. He has a home gym machine, and I reckon his deadlifting.

Next point of contact if he keeps doing it? Po-po?

      Yep, if you've exhausted all options with him and he's not being reasonable then the cops can give him a warning of some sort

        Yeah they will. Call them at 4.30am with a noise complaint, and they'll knock on his door.

        And keep calling until the neighbour either stops his selfish behaviour, or the cops have enough and give him a noise abatement order…. and then fines!

        4.30am noise… NOT ACCEPTABLE!

          Police do not issue Noise Abatement orders. They are done either by the courts or the EPA

            If they have to return, they most certainly give you a direction to turn it down.

            If they have to come back again, they can seize the item causing the noise.

            I don't know what the official order is called, but they definitely can give one.

                The party stopped pretty quick when the cops took the whole stereo!!

                Host got it back again, but cops definitely stopped the noise :).

          • @Cyphar: In NSW they do, they can issue a Noise Abatement Direction for up to 28 days. They can seize any equipment that is used to contravene a direction, and can even get a warrant to enter to issue a direction.

    It's OzB, i konw, but I would send him whatever mats you were talking about earlier before even thinking of escalating it to the police or council.
    It'll be very unpleasant to live next to someone who's mission might be to make your life hell if you call the cops on him.

        It really comes down to "delivery". That'll make a huge difference in how he reacts.
        If you just chuck something at him, then yes. But if you walk up with mat in hand and a big fat smile and say.. "want to try thissss?", he'll probably feel a bit sheepish/apologetic at the whole thing and might even give back the cost, etc.

          Even still, this guy spends hours every single night training his punching muscles. When it comes down to situations where someone gets punched, the laws against punching people didn't really prevent the punches from coming. Tell a stranger off and you'd better believe they are going to feel some way about it.

            Someone would have to be pretty screwed up to consider their neighbours to be "telling them off" if they've come with some additional gym equipment.

            @AustriaBargain: I box (only with pads and bags) and lift weights similarly to this guy multiple times a week. I wouldn't even contemplate punching someone who is complaining about the noise. You're only getting punched if you're actually physically threatening me or someone else. Other than that, words are way more effective.

    Dead lift drop pads.

    Suggest going halves. If he is a good neighbour, he will buy it himself and your problem is solved.

    If he is a bad neighbour, he will get you to pay for the whole thing. If he uses it, your problem is solved.

      I mean its fairly inconsiderate. I went out at 4:30am when he started. The entire street could bloody hear it, I must be the only one who values my quiet lol

        I am sure most people can but it can be hard for them to realise the disruption they are causing and/or the benefit of good neighbourly relations.

            To be honest, it isn't an "investment" when he doesn't care about the noise. You should probably kit out his home gym for him if you want the sound gone. I doubt he'll change his mind.

        If you want to insist on your rights, you can start guns blazing. You won't get very far and you now have one pissed off neighbour.

          The neighbour is being beyond unreasonable. Benefit of the doubt, maybe he didn't realise, but the issue has now been brought to his attention and is now continuing to behave in a way that he is fully aware is disruptive. The neighbour is now clearly not a reasonable person.

          "Just a gesture" to deal with what is 100% unreasonable behaviour isn't a reasonable response.

          "Please don't make the noise of dropping lead weights onto concrete at 4.30AM" is a reasonable response, and has been attempted.

          Also mate, being reasonable, you're a world-class shit stirrer so I hope you appreciate the irony of providing advice on how to resolve disputes.

            I always advocate leaving people be. Stirring shit is trying to impose onto others albeit that seems to be the more acceptable behaviour these days.

            Back to the relevant scenario, OP wants quiet enjoyment of his property, so does his neighbour. I recognize that the neighbour is being selfish but telling them to STFU (or whatever colourful words chosen to dress up the act) is going to yield zero results. Worse, it will get you a neighbourly feud.

            Exactly. It has been attempted. Results - none.

            So OP has a choice.
            1. Stand his ground and get authorities involved - legally in the right, financially unaffected and 100% chance of bad blood.

            1. Roll over - financially unaffected but achieve nothing whatsoever.

            2. Pragmatic approach - potentially shoulder some trivial cost and improve the scenario.

            Good luck with your neighbourly disputes.

          I'm all for gestures but if some gronk is deadlifting at 4:30AM in the morning even after i've spoken to him and he continues to do it then i'll piss on his door and leave a shit out side the front of it.

    record the sounds from your room.

    So you can show how loud it is and get him/her to empathise.

    Most people workout with earphones in - which means they can't tell how loud it is when they make noises.

    Then make an offer on the mats.

    Otherwise, complain to strata or cops for a noise complaint.

        How old are you?
        I think if you're at the right age, you can put some speakers to the wall and play a sound loud enough for him to hear it.

        What sound you ask?
        A baby crying! Do this a couple times, and don't go over to his house. Eventually he'll feel sorry, and perhaps even annoyed, and he will eventually either drop weights slowly and/or invest in some thick mats to dampen the blow.

        Perhaps if you did this for 1 week straight, and nothing changed, you can buy the mats for him. Not the expensive $300 ones, just get thick foam for like $10. I don't have any links yet for you.

      Well imo, most of the sound is coming from his machine. He does the old school letting the plates smack eachother between each rep.

      Then sometimes, whilst im trying to get back to sleep, he must be changing the weights on the bar. Doesnt (profanity) stop for a good 2 hrs.

          Yeah he definitely is. I go max 45 minutes sometimes an hour.
          Day 1: Upper Body Power
          Day 2: Lower Body Power
          Day 3: Rest
          Day 4: Back and Shoulders Hypertrophy
          Day 5: Lower Body Hypertrophy
          Day 6: Chest and Arms Hypertrophy
          Day 7: Rest

            Usually session is 2 ish hours.

        That would be so frickn annoying! I hate it when you are trying to get back to sleep knowing that any moment a loud noise will wake you up again.
        Need to knock on his door again.. "hey looking good man, those weights are really working their magic". "The noise from your weights clanking is really loud at a time that I didn't know existed, is there something that you can do to prevent the clanking noise?"

        If he respects his neighbours he would:
        noise proof the room
        rubber mats on floor
        rubber strips between weights
        use rubber coated weights

        He is clearly going to do weights for the long term so he might as well make the investment now. I completely disagree with you paying for it, dont take ownership of his problem. If you wait too long to go over to see him, you're at risk of going over tired and angry with a twitching eye and come across as the crazy one.

        I sincerely feel for you, annoys me that people like that aren't more mindful. My old neighbour used to turn on his harley at 6am and leave it idling for 10 minutes, then rev the hell out of it before burning off down the road. Good luck!!

    Legally its a enforceable offence to make 'inconsiderate noise' before official construction start times, like 7 or 8am depending on state.

    Call cops or council, recommend council for a real good stab & twist 👍👍

        Well really, that would appear to be the EPR 2018 that doesn't mention "deadlifting at 430am".

        The EPA 1970 seems pretty clear that it applies to any "unreasonable noise from a residence. Any noise from a residence at any time may be unreasonable".

        Deadlifting without pads at 430am on a concrete floor seems unreasonable, to 100% of the people in this thread, and it seems to all but 1 individual involved in this situation.

        • The other party may have done what is reasonably practicable to minimise noise. Op have of course the right to make a complaint with the EPA or other authorities if they believe that the other party has failed to do so.

          • @whooah1979: I appreciate your position, but if the sound is as disruptive as OP says it is, it seems the measures are ineffective no matter how "reasonable".

            My suggestion would be don't drop the weights, but my max deadlift is a thing to be laughed at so maybe my suggestion sucks.

        I'm not condoning the inconsiderate turd but I would work out if I have a plan B before escalating the dispute?
        I previously lived in a high rise apartment and successfully dealt with numerous noise complaints.

      It's funny how there's different types of people in this world hey. That would be my immediate solution. There's a sound, well, block the sound. Noise cancelling headphones. Or better yet take the opportunity to get a great start to the day.

      Everyone is happy and the police aren't involved. 430am is a very respectable time to lift weights.
