Wondered about the .com.au address. Turns out State Trustees is the public trustee for Vic, but a government-owned company. On the privatisation list, I presume …

    • There are certain entities within the Vic Gov which arent technically 'government' departments due to the nature of their work. They have to have a degree of independence from the government which is why the .com.au is allowed. Its got nothing to do with privatisation.

      • Thanks for the reply. The public trustee in Queensland is a corporation but has .gov.au. I'm sure there are technical legal reasons.

        • Yes there would be. Like State Trustees, Infrastructure Victoria also has a .com.au address for similar reasons.

  • Thanks mate, was thinking of one, will have a look.

  • What would I get for $25? Filled out PDF?
What if I need to update the will next year? Could I just edit PDF by myself for free?

…and if I want the same kind of will for my spouse/relative, can I just copy PDF and edit it without paying additional $25?

Sounds cheap but main cost would come when executing the will.
Many of the solicitors specialized in writing "will" for some for a small fee but it does worth it. Writing your own will could be your greatest mistake

I suppose it comes down to how complicated your will is. Having something is better than nothing should you cark it as at least your intentions are known for the most part. The rest you don't need to worry about as you are dead. The greedy living can quibble over the spoils. :-)

  • Why do I have to pay first?

For those of you who are with CPSU (union) they have a free will offer via Slater and Gordon lawyers.

Check whether the Trustee takes an amount when you pass. The Qld Trustee use to and it is a lot more than a solictor will cost….Also please don't just rely on a will. My partner had one, we both had them done by a solicitor but one week after she passed her adult children who never talked to her already had a solicitor challenging the will. They won in the end and little did I know but if someone challenges the will their costs are paid for by the estate. They don't have to outlay any monies to challenge.

    • That is why I tried to say specialized solicitor fee better than your own self written will, if you want something to be done properly.
My close friend's husband died and her ex-wife challenged most recent wife and she won the case after 15 years earlier their divorce. I think the argument was deceased person didn't explained well the reason the way he set up his estate between his family members. And the court cost was also significant in tens of thousands dollars.
This has nothing to do to being greedy as above some comment, it is about leaving things in peace behind and in order you like.

I think there was an ABC document 4 corner about "The Qld Trustee use to and it is a lot more than a solictor will cost…"

      • I have read somewhere that it is better to leave something for everyone, that way it stops their chances of mounting a successful challenge. It is easier to challenge if someone has been totally cut off.

Yeap, leave them $1. This way there is no way they can challenge saying that you forgot about them :-)

    • The State Trustees website has their schedule of fees. They are expensive. I will be turning in my grave if my family were to loose that kind of money to fees. Probably need to find an OzB way for a deal on deceased estate management fees.
