        Yeppers, this. I rang all the places anywhere near my suburb here in VIC that 'apparently' had stock according to that online stock checker thingy; but none of them actually had stock.

      • I couldn't imagine wasting time looking for a phone that's out dated , and not particularly good ! Original post bought three , he's clearly not thinking straight.

        • This was over a span of a month and going to Woolworths that were along the way back home as well as needing to run errands while I was out.

      I seem to recall that by law in Australia the relevant company is obliged to provide you with an unlocking code for free after you have had the phone for 1 year.

              @[Deactivated]: I have read the relevant law, and I remember approximately what it states. Searching for that law is now tedious because searches that include 'unlock' and 'phone' are now flooded with query returns about the right of the Australian Federal Police to force a person to 'unlock' (as in, open) their phone for them (i.e., a different subject entirely). I'm sure if you tried hard enough for long enough though, you could locate the relevant law. What would be much quicker for you though, would be to simply call any major telco and get them to personally verify that they will unlock a phone for you for free if you can prove to them that you bought it more than a year ago; hence the advice I gave you.

              Getting back to the actual law, it refers to the buyer having possessed the phone for 'a reasonable amount of time' before they are entitled to have it unlocked for free by the telco that sold it to them, locked. It seems that the major telcos operating in Australia are united in their interpretation of the words 'reasonable amount of time' in this context as equating to 1 year.

                  That said, you could consult section 3LA (6) of the Crimes Act 1914.

                  'Section 3LA gives law enforcement officers the power to compel a person to reveal their private encryption keys and PINs or passwords, enabling the officers to access information held on a computer for the purpose of investigating and prosecuting a computer related offence.

                  Precedent indicates that 'smart' phones (and perhaps any mobile phone) fall within the legal definition of a computer, though I have not personally read that definition. Failure to comply with a law enforcement officer’s request to unlock your phone is evidently punishable by a gaol sentence of up to 6 months. I guess the obvious defences would be:

                  1. "That's not my phone"
                  2. 'I forgot the PIN'
                  3. 'I am putting in the correct PIN but the phone is not recognising it/the phone seems to be malfunctioning in this regard'.
    • May as well pay a few $ for an unlock code so you can start chasing cheap SIM deals.

      Forget wa I tried this weeks before Xmas a few stores showed stock and fist store we tried closest had. Went to pick up and yes was going to be a Xmas gift for son. When I went there the packing was bust open SIM card removed no protector on screen and the pin to eject sim car holder missing obviously someone either returned it or maybe wanted something out of it.

      I said to manager this is Xmas gift and nobody told me it was open possible used what if it’s not working? So he called several stores closer to him nobody had it.
      In the end he have it to me for nothing or should I say refunded as I only noticed as I was going out Woolworths door it was opened etc.

      I tried to get another called and tried several stores all saying none so gave up in the end.

      But I fixed up box etc and made it look like new for son. Works great and no issues with it.
