I Just Bought a $3,000 Rooftop Air Conditioner for $1.89, but The Order Was Refunded for an Illegitimate Reason

Zippay are running a deal today, and as I was browsing those deals I noticed this Roof Top Air Conditioner

I noticed that it was on sale down to $1.89, so I bought one.

Here is a screenshot showing that I purchased it today

I was preparing to go pick it up, but then received an email to say that the order was cancelled, with the following reasoning:

"Unfortunately, the seller had to cancel your order due to the following reason: I'm out of stock or the item is damaged."

However - the listing continues to show, but now for a higher price, proving that this is a lie.

What do I do about this? If it was a mistake, should this be my problem? I paid for this and was making preparations for pickup.

Edit: thanks for all your replies. OzBargain is a fun place. I've learned that even though most people on here would have no issue jumping on some crazy loophole of a deal that was obviously a mistake in judgement by someone working at a company, it's generally frowned upon to want to take a deal that was another kind of a mistake.

Also learned that people seem to be really worried about how they are perceived on here. It's a forum about bargains - lighten up 😂

    I know you're replying to everyone with sarcasm, but you obviously feel entitled to a pretty obvious pricing error.

    How has this impacted your life other than "making preparations for pickup". What does that even mean?… you had to put on pants or something?

    • No, I don't wear pants when shopping. I'm not going to an opera. My preparations included shifting my extensive morning routine forward by at least 30 minutes, so that alone is a basis to sue.

        There would 100% be a T&C covering E&OE listings. You can’t walk into a store and thrust money at them and demand they take it for a pricing error. They have the right to say no and hand your money back, which is exactly what happened here.

        There is no way you are going to be able to sue over this. You took a gamble they wouldn’t notice, you knew it was a pricing error, they found it and refunded your money. Simples! *meerkat chirp*

    This has been established for… centuries… in contact law that if something was put up as a genuine mistake, the seller is not required to follow through with it.

    We covered this in high school, a really, really long time ago. So I can't remember the details.

      Yes if something is offered at the wrong price, then sure the seller doesnt have to sell it at that price. Consumer law covers that off. However since OP has paid money, that is consideration and hence maybe the contract is now in force.

      • Fair point, but i suspect consideration is not sufficient. I've seen pricing errors like this for decades where payments been made and the sales still cancelled. Not just in Oz, either.

        • Insufficient consideration is not a factor. Thats why you see instances of people purchasing something for a symbolic $1 to demonstrate consideration.

          • @nedski: Let me rephrase - the exchange of consideration is not enough to enforce the contract. I've seen this happen before, something is mispriced, hundreds of thousands of items are ordered online and transactions are made, then the sales are cancelled.

            I'm not sure what the legal point is that allows this, but first time I saw it was over 20 years ago and it wasn't new then. OP is not faced with a novel legal situation here, it's a well trodden path.

            (So my point is as not about 'considerstion' not being a sufficient monetary amount, we are aware that it's a binary value in contracts, it either exists or it does not exist)

    I can guess why… it's because you knew it was a price-error and you wanted to keep it to yourself, hoping it would slip through…

  • If in NSW I'd dispute it with fair trading, saying they sold a item under a abn and while I have proof of the transaction they did not honour it and increased the pricing.

    If lucky they would doom their entire customer base if you were successful.

      • I think there is a difference. Taking advantage of a price error and then whinging when it is not honored is the problem here. Most Ozbargainers (and people in general) can accept that it is an error an move on if rejected. This is not Hypocritical.

    Are you that high up on your high horse that you thought any seller would honour a price error of $1.89 (Which to my calculation is 99.9% off) and proceed with a sale well below cost-price and take a loss to make you happy?

    This is what you do (In no particular order)

    • Contact Consumer Affairs
    • Contact 'A Current Affair'
    • Post a video on TikTok and ensure it goes viral for the maximum chance of a solution - Remember that there's no way to dislike or downvote a Tiktok video so it's a great way to gain publicity and attention
    • As per the above, when you do go viral start selling Merch (Shirts, Mugs, Coffee Cups, Mouse Pads, Pens, Hats etc)
    • Riot outside of their HQ (Extra points if you Facebook and Tiktok live-stream it)
    • Start a Change.Org petition
    • Start a Go Fund Me as the above (and everything else) will cost a lot of $$$$$ and you will likely need to book several 5-Star Hotels, Pay for Flights etc
    • Hire a Lawyer - A good one obviously
