    So… My bank account from PayPal has been charged but I haven't even got any emails from Harvey Norman about my order. Do I just start a PayPal dispute and try and get my money back? What am I meant to do?

      I contacted them yesterday and they said the same thing "we'll be processing all refunds today". Contacted them again today after getting no refund "we'll be trying our best to process the rest of them today". ZzZzZz
      Edit: Oh and not to mention bank operating hours, even if they do process it today, probably a slim to nil chance of seeing the money return in my bank until well into the new year. There goes my spending money for NYE!

        • We will do them all as quickly as possible. However, some people have said that not having the money will adversely affect them over the holidays so contacting us direct is their chance to get it back slightly faster

          I've sent you an email requesting my refund ASAP. I would think that emails are more direct than facebook. Still have not received my refund and i need the money urgently as i used all of my savings on the tablet and have nothing left over for the holiday period.

    • Sometimes they do. Usually in my experience it's just for cheaper items with higher margins that they won't lose as much on. For something this expensive I'm not surprised they're not honouring it.

        If Ruslan Kogan can cop the results of his mistake (referring to this 'price error' bargain), surely a much larger organisation like HN can man up and cop it as a learning experience too…

          Cant compare a $10 price difference to an ~$800 one. As carbon12 said, cheaper items often get put through. Mistakes like this and the JB $15 TV get cancelled.

          Am I the only one who thinks those mugs were a publicity stunt. Gets his name out there, still makes $$. 2000 mugs, 2000 new contact details to bombard people with email promos. He is a winner in the end.

    It seems that this issue has gotten alot of publicity. I think its an opportunity for HN to make it positive. Now, i am not expecting a huge loss on the item but a small gesture i think will go a long way. Automated replies of refunds dont go down well with customers.

    Based on this experience i would rather buy elsewhere and tell everybody i know to do the same.

      I would have at least expected a heavy discount offer on the product like the JB tv example i mentioned above. I think JB offered about an extra 20% off the sale price of 15% off

          They'll send in a lawyer, or give someone outside Centrelink an ASUS EP121 as payment to represent them and they'll still win. I don't know small claims procedures, but I'd hate you to have to pay their expenses for a frivolous claim. Not saying don't do it, just look into it first.

        As posted earlier:

        There is no binding contract when you're charged. As outlined in Harvey Normans T&Cs (which don't appear to breach ACL) the offer is only accepted when you receive a tax invoice and receive receipt of the goods. Until that point it is only an offer. Customers agree to this term when using the web site and making a purchase.

        • Terms and conditions do not override the law (not saying the HN T&C are enforcable or not, tthat's up to a court to decide)

        • T&Cs cannot contravene the law, however they can be more prohibitive. Every person who made an offer on the tablet agreed to the terms.

        • What if they also claim there is a typo in the T & Cs which in fact there is a adjustment fee of $10 for all refunds? It is a human mistake again and we should bare with it too?

        • I don't know, I'm not a qualified legal practitioner - nor is anyone else here claiming to be. Perhaps you should seek legal advice to find out the answers to all your hypothetical scenarios.

Quite frankly, it's a slap in the face to come back and suggest it to us at this ridiculous price in the same email of cancellation. Ain't nobody interested in that for that price.         I get the same email today telling me that I can still buy the tablet for $877, it is quite funny actually because they think this price is awesome for this tablet.

      Will be speaking to the ACCC. Taking money from my bank account and holding it for serveral days isn't an offer, thats accepting the offer. T&C do not bypass ACL. HN will get no more of my business and I will urge all friends and family to avoid HN due to the complete failure to handle this 'pricing error'.

        I can't help but feel the same way..it seems to me that they have accepted our offer by taking the money and then they have decided to change their mind without a good reason. It is not as though the wholesaler has been unable to provide them with the product or there has been as recall etc, they have just decided to re neg on the deal.

          A pricing error is good reason to reject an order and I would have no problem if they didn't charge my account, but they did. They sent me a confirmation email. I went out and spent another $300 on accessories and software for the tablet I can't return.

          -Edit: Also note - some people received emails saying their orders were CANCELED - NOT rejected. For an order to be canceled, it has to exist. People who received these emails might have more of a leg to stand on with the ACCC.

          No offense but are you brain dead? You have 0 idea what I purchased. Graphic and modeling software isn't cheap. A nice mechanical keyboard normally costs upwards of $90. Depending on personal preference a nice mouse and mouse pad will set you back over $70.

          you still shouldnt of made add on purchases until you had a despatch email or some kind of assurance, other than a confirmation email and your money being deducted

        • Actually using it as a cheap graphics tablet. The wacom pen it comes with makes it very useful for this.

        • The email I received told me it should be dispatched usually within 2 days. Your not wrong but I guess I just live in a fantasy world where I pay for something and get confirmation of my order with shipping estimates that means I've just bought an item.

          Under what grounds would I ask for a refund? They are all supplying the product as described. HN is not supplying a product, refunding my money does not earn them any brownie points. The keyboard and mouse I could most likely return but I would have to pay the return shipping.

    Got the email - noticed it was carefully worded too.

    If I've got it right, when we pay for something on our credit cards, the money is placed 'on hold' for a day or two, then its transferred / deducted from our accounts. So if they got their act together, they could have cancelled the orders immediately, therefore cancelling the hold = instant refund.

    Instead they've decided to string it out (and now the money has been deducted from my account), and its going to take another 1-2 business days for the money to be refunded. I also love the fact that "remains in stock and is available for purchase at the correct price of $877" … no offer of any discount or anything, despite the inconvenience caused to all.

    And it is possible this deal could have been legit when we all first placed our orders, considering it was flagged as an 'EOY Clearance Sale' item, and keeping in mind what they did with the HP TouchPad a year or so ago (http://www.theaustralian.com.au/australian-it/exec-tech/harv…)

    Its funny how they say that I made an offer to purchase. If it was an offer, why was the money taken out of my account and the order confirmed??! Their terms and conditions are allowed to contradict the law btw, it doesnt mean they are applicable at all, they could say in their terms and conditions that they have the option to rape your wife and do you think that means they can?!

    I will be following this up, ACCC of course but herald sun (ill get in contact with the other ozbargainer about that) sounds good too. You guys should do the same methinks.

      Good luck bro, but considering its this time of the year and banks are almost just as slow as HN, I'd say you'd be looking at next week at the earliest to get the funds back in your account, probably around 2nd of Jan 2013!

    I just got the email as well

    Now considering i made 2 orders one paypal and 1 via CC but in the email it only noted one of the purchases.
    I would expect another email or both my purchases refunded properly in the next day

    After all thats been said and done, its clear where i will be spending my future dollars.

    Its definitely not the fact i didnt get the bargain, its the way this whole thing has been handled

    Agree with others that this whole thing was just to drive traffic to their website. End of year/Boxing Day sales are great opportunities to get heaps of sales. I guess Harvey Norman just wanted to make sure everyone goes to their website to check out their "deals"

    Got the email too, so stupid, at least overseas websites give you a 10% voucher without question when they make a mistake (e.g. Zavvi/The Hut). They really need to improve their online stores and turn-around times or they will keep losing their sales to overseas and keep damaging their brand.

    Although I am not bothered as it did look like a mistake, just bad timing since there was a chance it could of been real.

    I signed up for Ozbargain just to put my 2 cents worth in… I fortunately used Paypal to deal with stupid Harvey Norman, and have opened a Paypal dispute. Harvey Norman have 'offered' (to conveniently use their term) to resolve my dispute with a refund of $126.70 instead of $127.95 due to a $1.25 adjustment fee.

    My reply to them is that I refuse to accept their 'offer', and will be escalating this to a Paypal claim if they do not return me my $1.25. Why the heck should I be paying for a mistake ON THEIR PART?!

      • I'm not strapped for cash, but I would of gone looking for a new tablet in the boxing day sales if I had of been informed they had made a pricing error. Taking funds (not holding), and getting a confirmation email by most standards is a successful purchase.
