    Gerry why don't you act as a professional and refund us immediately. You do not mention if all customers have been refunded. You have been keeping my money for more than 3 days and counting… still no refund on my cc card.

    What I found very interesting is that Gerry said his people were alerted to the problem at 4am. I didn't even wake up until after 5, so why was I able to make my purchase ad around 5.30am? Actually I just checked my screen shots and it was after 6am when I made the purchase.

    If you got a confirmation of order in your mail from harvey (not just from paypal), I think there is a 95% chance that we will win the ACCC case. So dont forget to file the case.

      i doubt they just have a small stock for that tablet and now they can not demand for all orders and they said pricing error,its clearly they cheated their customer

  • if they think there are professionals buying 20 tablets each, they could at least put a limit on each purchase in the first place or they can at least let those buyers get 2 tablets each and refund the remainder.

    one for them the other for whoever they want to give to (ie. wife/husband/mum/dad/gf/bf) im sure many people will be happy with that.

    whats the price of good publicity for the company? could this be much better than an Advert on TV if they build loyal customers, (they have family and friends they will spread the news to how HN honour such deal)

    so those customers & family/friends would generate future revenue for the company or am i mistaken?

    • I bought a $3000 laptop for $1000 a while back from officeworks, sure enough, it was a price error and they say they lost money from that, but they honour it. since then before i look anywhere else for office stuff, i drive by their store. they have fully recoup the money they loss from the laptop many times over, from me since then.

      recently im big JB customer, because im techy i buy all tech stuff for my entire extended family and friends. this year i bought at least 5 LED TVs, 10 laptops, 4 cameras, more than 5 tablets and many other electronics/entertainment equipments from them.

        He might still come around to your place and take half of it away for buying too many items so keep your doors and windows locked.

    Seriously, SERIOUSLY, BLOODY SERIOUSLY this is getting out of hand…

    No, I'm not talking about all the understandably angry OZbargainers who feel cheated and humiliated by HN, nor about the "others" who keep advising us to suck it up as it was "obviously an employee's mistake and we were obviously abusing someone's error"…

    What is getting really out of hand is the insult after insult we are getting from HN. Insults not just in the form of "professionally" rude attitude and even calling us names ON NEWSPAPERS, but more in taking us for idiots, providing excuses and fragile explanations that, only an idiot with a negative IQ value may buy.

    I initially bought two of these tablets after researching their worthiness, thinking it'd be cool to have a fast win7/8 tablet. An hour later, I bought another two after thinking of a few people who may love such a gift. Given the price, I didn't even have second thoughts about it. Bought them, then went to sleep.

    I've been following the debacle on OZB (OZB is like my morning newspaper, I flip through it religiously every time I sit down, take a break, have coffee, tea, or simply get insomniac!), and was feeling frustrated with HN's reactions.. It wasn't until that ill- reputed Mr Norman decided to insult us in public that I lost it…

    I wouldn't go into details in this post as to why I think this was a "Professional" set up by HN AND NOT IN ANYWAY A MISTAKE, nor into the numerous counts of insults received throughout the debacle, as many of you have already pointed out many of them..

    My point here is, regardless of whether it was a genuine error on HN's part (highly unlikely), or whether our intentions were genuinely good in just taking pleasure in buying good stuff at good prices and gifting them during the holidays, we came across the straw that broke the camel's back… This whole debacle shows how much respect some of the giant retailers have for their customers, and how likely they think of them, professionals, eh?), let alone the inflated prices we pay in Australia for virtually everything..

    This debacle has now garnered media attention, and I bet other retailers are seeing how this is going to play out.. We may/may not be able to do much, but a community effort is the least we can do to show our disgust for HN's ways and demand better treatment, and let that be a message to other retailers.. What needs to be done IMHO is we put together a detailed cause/explanation for our concerns and the reason behind our bitterness with this issue, contributed by ozbargainers, as well as sharing ideas on how to address this most effectively to get some of our respect back..

    Just sayin', I'm not in such a hurry to get my 500 dollars back into my account, it just bewilders me how one can get away with "refusing your offer", but taking your money!! Oh, and I'm NOT GOING TO LIKE THEM ON FACEBOOK TO GET MY MONEY BACK.. IT'S JUST NOT WORTH IT

    I'll post another comment about why I think the whole deal smells so fishy..

        Well.. Harvey's recount of the incident just incriminates him…
        I found the deal around 2:30 am, and did some background research about the tablet before buying 2. THERE WAS NO EMAIL CONFIRMATION SENT.

        Nearly an hour later, I decided to buy another two.. I couldn't as the whole site was "DOWN FOR MAINTENANCE"… Please note… It isn't that the site was just being crashed with requests, it still loaded up fine, it just came up with "site under maintenance" banner.. This was around four, and IT CLEARLY INDICATES THAT HN WAS ALERTED TO THE ISSUE.. IT ALSO CORRESPONDS WITH HARVEY'S STORY OF FINDING ABOUT IT AROUND 4…

        THEN…. The site is back online.. Guess what?! After someone was alerted to the issue and bringing the site down, the site went back online, and the tablet was STILL THERE AT THE SAME PRICE, 122 dollars…. It was only eventually removed at 8:30 am from the whole site..

        Now.. What is the explanation for that?!!

    We are being accused of being Professionals? Professional what exactly? Professional Criminals? Does he think we do this for a living? That this is our only or even second job?

    We saw a deal. What seemed to be a very good deal. Many of us found it on a website which highlights good deals. We purchased. Why should we be ashamed?

        • As someone who did buy an Asus tablet that night. Shit happens, it may or may not have been a mistake but as you accepted the terms and conditions during the purchase you can't do much for it since you entered a contract with HN upon agreeing with their terms.

          I think in true Ozbargain spirit of things, if a deal is posted it should be allowed but people specially those not aware of it should be warned. More importantly those terms and conditions need to go, not just in this case but in other cases as well. You think you have paid for something and you have got it, but actually you have not.

          Simple example the Lg tv on sale at The Good Guys and HN with a dollar difference, now if some one gets it online from HN they may actually miss out on the tv as HN can refuse the order and TGG may no longer have any stock.

          (and trust me there are ppl even on OZbargain who are not aware of the Asus tablet being Harvey Normaned).

          It is our "Professional" duty.

          I hate Harvey Norman, I buy most of my stuff from Amazon and use mail forwarding from the US. It doesn't matter whether I like or hate HN and I don't really agree with you. The terms and conditions matter IF they don't contravene the Competition and Consumer Act 2010, which is what Australian Consumer Law is derived from.

          The only point I'm arguing is no one is entitled to a tablet, period. I definitely don't agree with how people have been treated after the fact, that's a different matter altogether.

          There is nothing for me to be biased about, I have no vested interest apart from what is legally correct. Seeing as you don't believe me I'll present a hypothetical, if I was right, how do I argue the point without being biased?

          Maybe you can start with which section of the act of ACL that stating acceptance of offer doesn't exist when consideration is received by the vendor but only until goods or tax invoices are received by the buyer.     Anybody that ordered this item has done absolutely nothing wrong whatsoever.

    We are normal Aussie consumers, the supplier is very rich and not in business to help us.

    So basically….

    Your out shopping and see a Sale sign of $122 on it so you go in and give them $122, they take it and then turn around and say the sign is wrong so you wont get the item you will now have to ask for a refund as we wont give you the goods….

      They'll make you wait in the store for days waiting for the item to get given to you before telling you they're not going to accept the sale, even though the cash is already in the till days ago or credit card already swiped and you're paying interest for it. And you'll have to go home and you might get your money back in a week.

        You're also made to pay an adjustment fee of $1.25 for his troubles. Seeing that supposedly 1600 tablets were purchased, that makes a tidy sum of exactly $2000 for dear Gerry in just a night's work.

    Ok, it was a pricing error, fair enough. Most of us would have probably assumed as much but has taken our chances, afterall, it was in the early hours of boxing day. Instead of apologising for the pricing error that has occurred on their part, HN has made it sound like pricing error is an everyday thing and not once did they admit that it was their fault in the first place. Above all that, they've accused us of the exploit that we are blissfully unaware of, "It was obviously a mistake and they knew it".
    A simple apology and admitting to their fault would've earned the respect of most of us.
    Harvey Norman has lost the plot.

    • They did apologise for any inconvenience the pricing error caused the buyers. And that seems about as close to a full blown apology we'll get for it.

      • I was talking more about the HS article rather than the unapologetic automated email they sent everyone, well, most of us.

      Make sure you or anyone for that matter does not let go of the 1.25 adjustment fee. Your money should be refunded in total.

    A lawyer is familiar with commerce law can represents us to bring HN to court if its T & C is in breach of any section of the act and charge us % of the proceeds from compensation we are going to receive from HN?

I am happy to pay $244 for the tablet if we win and whoever represents us will get $122x1600 as legal fees.
