I have received the following email:

An error on the www.dell.com.au online store on 27 March 2009 saw Dell offer the Logitech MX Revolution Rechargeble Cordless Laser Mouse for $34.10

Dell would like to advise you that this was a genuine mistake; Dell has not accepted your order or gone into contract with you. If you have paid by direct deposit (e.g. Internet Banking) or by credit card we will decline your payment and return the payment to you. If you have not yet made payment, please do not proceed to pay Dell this incorrect amount, as your payment will be returned.

Dell offers to either cancel your order or if you would like to proceed to purchase the product at $119.00 including GST, please respond via email, and we will get a Dell representative to call you at the earliest and take you through the ordering process. If we do not hear back from you within next two business days by 3 April 2009, we will consider the order cancelled by you.

The standard terms and conditions listed on Dell's on-line store state that while all efforts are made to check pricing and other errors, inadvertent errors do occur from time to time and Dell reserves the right to decline orders arising from such errors.

We would like to apologise for any inconvenience caused.

We recently sent you an email apologizing for our recent online pricing mistake that related to a Logitech MX Revolution Rechargeable Cordless Laser Mouse that Dell Australia incorrectly published at the discounted price of $34.10. The correct discounted price should have been $99.00. This discounted price is based on a $20 cash off discount from Dell’s RRP, which is $119.00 inclusive of GST and delivery.

We understand this error may have inconvenienced you. As a gesture of goodwill, we would like to offer you the Logitech MX Revolution Rechargeable Cordless Laser Mouse for $90.00 inclusive of GST and delivery, up to the same number of items as your original order. We understand you may have already made your purchase elsewhere and you are under no obligation to take up this offer.

If you have any questions regarding this error, or if you are still interested in purchasing the mouse, please respond to this email within the next 14 days so that we can arrange for a Dell representative to contact you.

    my email to dell expalins the issue: Dear Sir / Madam As per the attached email sent on your behalf the mouse was advertised for $34 and it was available for purchase at that price, and even was available for sale for $33 at the small business division. so your claim that this was a genuine mistake is not valid by any means. as both the advertisement and the shopping cart had the price of $34.10 and your small business division had it on offer for 33$ and a typing mistake would only apply to the advertising and not the shopping carts!!!!! The link below still have the mouse advertised, even that the product is no longer available. http://au.dell.com/PS!fHWUfqwpMisFBgIAAAAGCgFICgcxNDkyNjQ1Cg… Furthermore customers were able to price match the mouse at Officeworks upon Officeworks staff calling Dell Sales and confirming that the offer was valid. how can you explain that? How do you explain confirming to another retailer that the price was correct on the first day of the advertisement? and what about the losses cause to Officeworks based on the claim of genuine mistake!!!!!! Based on the above, I reserve my right getting the Logitech MX Revolution Rechargeable Cordless Laser Mouse at the advertised price of $34.10 Upon failure to confirm so within 2 days, I am afraid I will to take further action with the ACCC, the Fair Trade Office and the small claims tribunal.     Whirlpoolers Formal Complaints lodged to ACCC
    on Dell MX Revolution Easter sale: 0001

    I just called described it all to ACCC officer and she said it "most likely" appears to be an example of bait & switch. She advised me that she would very much like to hear from other people in the same situation.

    She advised on further action that can taken:

    • Letter of demand to Dell to honour the original price
    • Failing that Office of Fair Trading (Sydney) 133220, or Small Claims Tribunal
  • I believed most of us are not actually need the mouse, but this kind of 'mistake' from DELL is definitely not acceptable!

    I’d be very surprised if you guys got anywhere with this. Yes, it's unacceptable but they've covered themselves in their terms and conditions of the online store.

    • Hehe but my expectation is that we won't get anywhere - so anything above that (inc slap on the wrist by ACCC/FTNSW) is just a bonus.

      Plus, writing to ACCC is limited to 1500 characters, so maximum 10 minutes of my time wasted…

    • I would argue that the error was not inadvertently done. Admittedly, an error in the website could be made without anyone's intervention, the deal was actually published in an email, as a JPEG. Which means, somebody actually crafted that JPEG manually, actively enterring the amount into that email. That could not be constituted as an inadvertent mistake. There was clearly intent to mislead.

    The error was linked in an email you sent me regarding your online specials. Seems a little strange that it was incorrect both in the email and the online store. Someone had to create that image (for the email) and surely you would check emails before they are sent out to your existing customers. Seems like bait and switch advertising (after now asking $119 for the same product), and subsequently I will be submitting a complaint to the ACCC.

    I really hope Dell cop a massive fine. It's like sending someone an email offering a product at a set price. Then you purchasing it, only to be told that they didn't agree to sell it to you at that price. Very professional!

    Thank you for your email. I do not wish to accept your offer to cancel my order, nor do I accept your offer to proceed with the purcahse of the item at a higher price.

    Section 56 Part 2 of the Trade Practices Act requires corporations to not use Bait Advertising and specifically says: "A corporation that has, in trade or commerce, advertised goods or services for supply at a specified price shall offer such goods or services for supply at that price for a period that is, and in quantities that are, reasonable having regard to the nature of the market in which the corporation carries on business and the nature of the advertisement".

    You'll note that this section of the Trade Practices Act does not reference a contract, so whether or not we've entered into a contract is irrelevant.

    As well as advertising this offer on your website you emailed the offer diretly to me, inclding a description of the item and the price embedded within an image in that email. This indicates that it was your intent to advertise this offer in this way. Regardless of whether it was an error, Section 56 Part 2 of the Trade Practices Act requires you to supply my order.

    I would also note that my last 3 orders with Dell have resulted in you refusing to supply my order and instead offering to sell me the same goods at a higher price (refer order numbers AUxxxx, AUxxxx, AUxxxx) as well.

    Please respond indicating when I can expect supply of my order. If you do not supply then I will lodge a complaint with the ACCC over your breach of the Trade Practices Act.

  • I received the same email as others and I really found it annoying excuses of a cheap advertising method. All evidence shows that DELL did this intentionally and it really pisses me off. I don't care that I won't receive that particular product but I cant stand this kind of marketing and business.

    Here is My response to DELL and I have nothing to do with them any more. The fact is ACCC won't do anything too! (you know that, I know that). We are the one who can show them the real price of their practice. For me I will not go near them let alone buying from them.


    Dear DELL,

    Although, I understand what is a "GENUINE MISTAKE" and that it is part of every business specially those with online nature I can't justify this issue as a "GENUINE MISTAKE" considering how you advertised it and how long it took to bring the deal down. Instead I found it to be a cheap failed advertising method that eventually would backlash in shape of losing customers.

    As I'm sure that a multi million dollar company like you has done all measures to protect itself and probably spent more money on lawyers and their advices and services instead of honoring the business and its customers and being responsible (something that we see in successful businesses) and it doesn't care about customers with its "LOWER PRICE ALWAYS SELL" policy and also because I'm to busy to follow your cheap game, I will not going to complain and waste my time on this issue.

    As a long time DELL customer, because in my "STANDARD TERMS AND CONDITIONS" there is no place to tolerate any dishonest and shenanigan businesses, specially in this competent market, I "RESERVE THE RIGHT" to not to buy any product from the DELL in future and neither advice them to others but telling them how irresponsible this company is and how it makes money.

  • Dell error, email as others had received. I tried to call Dell to at least discuss my displeasure in having the option of buying the same product for $119, but after speaking to 4 different non english speaking consultants I was told the lines were all busy and I would have to accept a return call.

    • Mate if a vendor has a history of making mistakes "inverted commas" ..law of averages should see right through it ..if anything this warrants an investigation, if not then expect more of this type of behaviour from desperate reatilers getting hit by sales that have fallen of the cliff

  • Guys I don't like our chances. I already complained to the ACCC about CD WOW! and NFS Undercover - CDWOW charged our Credit Cards and then refused to fulfill the order (even though they had stock). Complained to the ACCC and they said there was nothing they could do. The only thing I could do would be to take CDWOW to the Small Claims Tribunal.

    I bought three of these mice so I can complain but honestly NOTHING WILL HAPPEN. As above, ACCC will do shit all these days.

    PS - Just because they have a clause in their terms and conditions, it doesn't protect them if they are in breach of legislation.

      The law should be changed, its not a fair and level playing field, they should be made accountable for their 'mistakes'

  • I'm annoyed as the next person here, at the very least I feel Dell should grant 1 concessional mouse to each person who bothers to lodge an email or phone complaint about this debacle. I cannot accept the email I received which states this was a "genuine error" as there is NO WAY this product would have been included on the front page of the EASTER SPECIAL e-brochure, if in some way (even if only a small way) it was discounted to attract attention.

    I'm not so sure the ACCC will do much either, I'm putting my weight behind logical and persistent complaint to Dell direct.

    Submitted a complaint to the ACCC a few minutes ago, screw Dell, lets use people power and teach them they cannot screw with us. Come on people it doesn't take more then 15 mins to type out whats happened and submit a complaint. Even if we don't get our mice at least Dell might get a kick in the butt or better yet get taken to court again like they did in 2001 for dodgy behavior. I like most got burned on the Vostro machines, these mice and a number of other scams they have been doing. All companies make mistakes, but only Dell does it once every few months, during peak times of business like Easter. They are getting more and more comfortable with this behavior, they aren't even calling us this time as why bother, they can get away with it as they have in the past.

    Unless I email them they won't proceed with my order, but they are saying its $119.00 per mouse.

    seeing as how Dell has already committed to preventing the deal. I say we should also hound the press to run a story on this and have some negative media on them. That's the only way that i can see how Dell will crack under the pressure and turn around on what they said and offer us the mouse.

    I already took the liberty of emailing Sydney Morning Herald on running the story of 'Dell "genuine mistakes" strikes again and gets away with it'.

    I began going into this deal thinking if it's a mistake, might as well try and see if i can get it or not and it won't matter if i don't. But after reading articles on how Dell has done this many times before and getting away with it. I'm really fired up on having some action taken against them.

    It's not so much the mouse cause it's just $100 … but the principal.

    • I completely agree. The mouse isn't important or issue in this case. Problem is how they get use to do anything they like to advertise a product then refuse to provide it and at the end use the whole thing as a marketing tool to offer the product at the even higher price than market!
      When someone who wants to sell you something tries to remind you that you have no right to complain it means that there is something wrong with their business.
      For me DELL is finished and I will never have business with them.
      I think that's the only way they will learn a lesson.

  • I got the same email as previous people with Dell saying it was a 'printing mistake' I ordered one mouse was not trying to hog. This is very misleading, where Dell has taken our contact information and wasted our time in actually signing up for an account and ordering a mouse that they are unwilling to deliver. Disappointing to order from Dell if they are not to resolve this.

  • as people said…acc does jack all….BUT department of fair trading on the other hand…just depends how far you guys are willing to go. Funny note, a friend who saw the mouse when it was released, paid for it and got it sent…so it definitely was a legit deal in the beginning.

    Seems rather apt in the case of Dell. I'm pretty confident that this is simple corporate incompetence at work rather than malice.

    • You can't reverse your votes after a certain period of time (72hrs i think)

      • I think this rule should be changed so in extraordinary (but maybe ordinary for dell) circumstances like this one we can change our votes long afterwards.

  • Call me naive, but I chose to pay for these mice instead of another bill (couldn't afford both on Sunday when I placed my order) as I didn't want to miss out on the great price. And now with the cancellation of the order, I have no mice and a $50 late payment fee to fork out for. I have advised Dell of this and now waiting for their response.

    My decision to pay for my Dell order was made on the basis of them honouring my order, so I believe the $50 fee should be their responsibility at the very least to compensate for their incompetence.

      Don't for a moment think I'm in ANY way defending Dell on this one. I also received the original Easter promo' e-mail from Dell and I'd been looking for a good deal on a w'less mouse, so was very interested in the Logitech mouse. Yes, it's hard to swallow this one a yet another Dell clerical error.

      • No mate thats alright. You're allowed to have an opinion and your view is one way to look at it, but faced with such a bargain I did what I had to to take advantage of it. If they honoured the deal I would be ok with it as I was willing to wear it, but now I got nothing but $50 less because of the 'pricing error'. Imade my decision based on good faith that Dell were genuinely offering cheap mice. If it wasn't for the email being sent with the price then I would have been totally sceptical.

    Got my first email from dell saying it was a mistake and offering more expensive price. I replied back telling them Ihave made a complaint to ACCC and to keep the order open until they contact me, but I just got a second email back from Dell thanking me for canceling my order, are they insane???

    This smells like a major scam to me. Here's what I think is going on:

    1. Dell advertises it for $34.10 and lures everyone into buying it
    2. Dell sends a scripted email to everyone telling us it was a 'mistake' and asks if we want to buy it for $119
    3. After they've sold as many as they can at that $119 price, they reduce the price to $79.20
    4. Plus meanwhile they get to hold on to all of our money to gain some interest (?) until ???? (I paid by bank deposited and the money still has not been refunded)
    • Ummmm, wouldn't that be an additional $79.20 above the included cost of the standard Dell Laser Mouse???
      I don't think you can figure the $79.20 as an outright purchase cost.

        It states 'Free upgrade to Dell™ Laser Mouse (USB)' in that customized laptop, so the Laser Mouse doesn't cost anything.

    Dell gets a double neg from me.

    After calling an leaving a message for customer support to call me back - THEY DON'T (2 days later)

    Then they reply to my email (the one were I advised them I would not accept the cancellation of my order) with a reply thanking me for cancelling my order.

    Go figure…

    Oh 2nd phone call to Dell, informs me my order (which they canceled) and my standing account have now both disappeared from their systems, I no longer exist.

    After buying 7 Dell systems in the past 12 months I'm slightly annoyed.

    I would call this a rare case where we did not meet our customer?s expectations. We, at Dell, firmly believe that we have reached such heights only because of customers like you. It is our endeavor not only to just fix the customer?s problem but also to make him happy during the interaction. I assure you that such a mistake will not be repeated and all steps would be made to make improvements. On behalf of Dell, I apologize to you.

    As I said before the only one who can protect us against this companies are ourselves. If we had some kind of union then they couldn't get away with this kind of BS.
    ACCC or any other governmental organization can't act fast or strong in cases like this.
    How many people bought this deal? 5000, 10000,…? If we had them to boycott DELL then you will see how they would back pedal and fulfill the deal.
    Until then for me DELL is finished.
