illegal? How did you come up with this legislation?

      • +2

illegal? (sic) How did you come up with this legislation?

A quick search will reveal that these devices can only be used 'off road' so to speak. That is on private land and in some parks etc.

Road Safety Road Rules 2009 - Victoria

          RR242
Travelling in or on a wheeled recreational device or toy on a footpath or shared path
          (1) A person travelling in or on a wheeled recreational device or wheeled toy on a footpath or shared path must—
          (a) keep to the left of the footpath or shared path unless it is impracticable to do so; and
          (b) give way to any pedestrian (except a person travelling in or on a wheeled recreational device or wheeled toy) who is on the footpath or shared path.

        • Illegal is a typo? Also "illegal product" probably isn't a fair term if it can be used without issue in certain contexts in Aus

          Illegal is a typo?

"illegal" was a typo by the OP, yes. Still worthy of a 'sic', because I wanted to show that I was quoting correctly.

Also "illegal product" probably isn't a fair term if it can be used without issue in certain contexts in Aus

Yes, correct. However, I guess that tuzii did not really mean to state that the device itself was an illegal product. I suppose that this seller has had it (and its charger) tested and certified to be electrically safe.

Reg Price is $675 for the base model and $785 for NextGen.

Oh, OK. Please provide proof that you have regularly sold these two devices for $675 and $785.

Have you noticed that this post has already been reported by two members?

Did you read the Posting Rules?

        • I agree with you in this.. but how come presales from say gearbest are allowed when they have never sold the item at the regular price.

        • +1

          @PVA:

I agree with you in this..

          Thank you.

but how come presales from say gearbest are allowed when they have never sold the item at the regular price.

I suppose because the same item (or a very, very similar item?) is being sold for more elsewhere AND because the GearBest price is the lowest at the time.

        • @A3Australia: I see, I assumed pre-sale meant no-one else had it as well - that manufacturer hasnt actually released it, s'pose I dont really look into too much.

    What is your returns policy?

We only accepts returns for faulty goods (Dead on Arrival) within 3 days of receiving the item. All fautly products after this date will be handled via the 1 year manufactures warranty. You must notify us via email.

Illegal return policy that is in contravention of consumer laws. NO contact or business details can be found anywhere. Not even a cheap price. Stay well clear of this rubbish.

    Neg from me due to:-

OP disappearing and not showing any proof that these prices are bargains (previous sales at "regular prices")

    Illegal warranty terms.

    Unspecified "manufacturers warrantee".

    Overall bad business.

    • +3

      OP disappearing

Probably fell off the scooter and wasn't wearing a helmet…

    • -5

Didn't neg anybody. Illegal warranty terms? Warranty is direct from manufacture. Refunds/Returns are for DOA. It is the merchants discretion to accept returns for no reason or change of mind.

Well A3Australia.. How do I prove regular price if I specifically put down its an Opening Special - opening means just that.

The name did get registered today - congratulations. New laws are in place that trading names are no longer accepted and now you require to apply to register a business name via ASIC.

By the way.. If you don't like - don't buy.

It's quite simple. I don't go thumbing down people's businesses/products just because I'm not interested in it.

      However, thanks for your participation.

      • +4

Illegal warranty terms? Warranty is direct from manufacture.

That doesn't mean it is legal in Australia.

        • @jv: the deal posting rules - I am obviously guilty of.

      • +3

Well A3Australia.. How do I prove regular price if I specifically put down its an Opening Special - opening means just that.

so in fact… this current price is the only price you have sold at? this is actually the "regular" price?

you know claiming your regular price as being higher than you usually sell it for is kinda a bit illegal right?

      • +4

        Warranty is direct from manufacture.

You're the retailer. The warranty is from you.

        • -3

warranty is from Manufacture - not retailer. Read up on consumer law.

        • +3

          @HoverSqoot: Wrong.

        • +2

          @HoverSqoot:

warranty is from Manufacture - not retailer.

Not in this country… Warranty is from the supplier…

The supplier has to provide the remedy when goods:

          are not fit for purpose
          do not have clear title
          do not have undisturbed possession
do not have any undisclosed securities
do not match a sample demonstration model.

The supplier is the person or business who sold, leased or hired the goods – for example, a retailer or a trader.

        • -2

          @pmupsinep:
Generally, it is the store or seller’s responsibility to return products to the manufacturer for repair. This may include products that are under warranty.

If the store cannot arrange repairs (for example, because the manufacturer does not have the necessary parts) or cannot do so within a reasonable time, you can:

get someone else to repair the product and ask the store to pay reasonable costs
ask for a refund or replacement.
          http://www.consumer.vic.gov.au/shopping/refunds-and-returns/…

        • +2

@HoverSqoot: do you realise that as the seller by quoting that you have basically admitted you would be responsible for the warranty? And at the least liable for repair costs, replacement and/or full refund if it isn't repairable?

By the way, Welcome to OzBargain…

where you cant just get away with the same, in this case illegal, sales pitch bullshit you might get away with anywhere else…

      • +1

well…. i think the main reason for all the hostility is that your price is not competitive …. most of the other issues normally does't matter that much to us OzBargainers but if your price is not even close to the cheapest which can be easily found with a google search then your post seems like SPAM as the deal is a bad deal even if it is 1000% discount from YOUR original price…..

        • +1

@HoverSqoot: i understand where you are coming from but again this is OzBargains which means that if getting it overseas or via eBay and the price can be halved, being an Australian website doesn't hold much value… if you are only 10% or so over, then some people might say this is a good deal for Aussie stock…. I personally almost bought one via Aust eBay group deals for $320 and therefore agree with most that unless you are close to that mark, it's hard to get others excited on OzBargains

Mind you if the AUD keep going down, then your price might be quite good in a few months :)

      • +1

        Didn't neg anybody.

        Who said that you did?

        Illegal warranty terms?

        Yes, please read the legislation.

        Warranty is direct from manufacture.

The actual manufacturer is not in Australia. Who is the importer? In Australia the importer is deemed to be the manufacturer.

Refunds/Returns are for DOA. It is the merchants discretion to accept returns for no reason or change of mind.

Uh, huh. However, no one mentioned the DOA policy.

Well A3Australia.. How do I prove regular price if I specifically put down its an Opening Special - opening means just that.

So, they have never sold at your inflated "regular prices". So, there is no bargain.

The name did get registered today - congratulations.

        Thank you.

New laws are in place that trading names are no longer accepted and now you require to apply to register a business name via ASIC.

        Uh huh.

By the way.. If you don't like - don't buy.

Ok. However, you should not be telling people what they should do.

It's quite simple. I don't go thumbing down people's businesses/products just because I'm not interested in it.

        No one did that.

        However, thanks for your participation.

        You are welcome.

By the way. Is the device compliant with Australian Electrical Safety regulations? Do you supply a battery charger? Is the battery charger compliant?

Bottom line is these types of "hoverboard" are crap, check this out:

    http://rideonewheel.com/

There's another one on Kickstarter actually called Hoverboard, but it doesn't look like it will get funded (despite having a range of 22 miles!).

More expensive yes but obviously a superior product in terms of on & offroad use, speed & range.
