    Got a phone call from a manager very nice guy and said he appreciated me being nice about what happened coz other people had been very rude. Anyway moral of the story is if you ordered a reasonable amount of games and chose shipping you are more likely to get the games. He said the sale is real the stock showing at the stores is an error

  • I placed an order for 16 different games late last night. None have been cancelled. None have been shipped. All still read "in progress."

    I had a Witcher 2 CE order cancelled unceremoniously by JB a few years back, so I'm expecting the same here.

  • You can get all the $1 games that was on sale online in store. Just went and bought the games and then cancelled my order. Hope they haven't sent my order yet.

    At the risk of upsetting a lot of people:

    If you have ordered, received a confirmation e-mail and JB has taken payment there is a legally binding contract. even if they do not have stock, they must get new stock for you, even if they make a loss doing so. They only way to get out of it if the item does not physically exist anymore, for example a painting which obviously cannot be reordered or remade or bought elsewhere.
    With the items JB sells this is never the case.

    To enforce such a contract, you need not go to court, depending on what state you are in. In Queensland for example, you can go the Queensland Civil and Administrative Tribunal (QCAT).
    It will cost about $23 to file a claim, no lawyers allowed which means there is no costs risk.

    In my experience, retailers settle claims in the compulsory mediation beforehand as they do not want to risk an official proceeding and a judgment against them as that sets a precedent which others can rely on.

    Easy to do and for those of you that ordered several games, it is definitely worthwhile. They either have to supply the games or pay the differences between what you would have paid had they been able to supply the items and the price you must pay to obtain the games from other shops.
    Most likely they will order the stock and supply themselves to keep you as potential customer.

    Personally, every time I have used QCAT in these circumstances, the claim got settled, I got my items and the retailer had to pay the filing fee of $23. Takes about 15 to prepare the claim, and then the conference takes an hour or so (can be done by telephone).

        I work in the legal profession so that is not really a bother for me.
        I also don't like it when stores claim a mistake happened but then the same mistake happens every time. See Dick Smith.
        If people do not hold them accountable what incentive is there for them to be better and stop their shady business practices.

        And yes, if I order 20 games for 20 dollars but have to spend 200 to get the same games elsewhere, then my rate for 75 minutes work is $180 (net) which is not bad.
        So it can be worth it too.

          Thank you. I am not sure why helpful info would upset people but from experience it does on this website. It seems some people are never happy. Not happy if their order is cancelled and they get nothing but also not happy if being given info on how to get their bargains.
          No win situation with this kind of people.

        The real question is: why do people neg me for providing advice on how to get their bargains?

        If retailers cancel the orders, people here are angry. I provide useful, accurate and hones info on how they can get their bargains and I get negged. But see I anticipated that hence I put "At the risk of upsetting people" - this was based purely on my experience here, not because it makes sense to me that people would be upset about this.

        What a beautiful website. Thankfully people are nice in real life when you provide free advice to them (pro bono and community service).

          contract law do indeed state that if they have taken ur mony, they have accepted your offer and taken the money as consideration and thus the contract is valid. both parties at that point have to carry out their obligations.

        Also, just FYI: retailers can write whatever they like in their terms and conditions. Just because they write it in there does not mean it is valid. Law trumps any terms and conditions.

        I do this for a living and have never come across a case or court where the basic principles of contract law where not adhered to but of course you are entitled to your opinion.

          I am sorry but I prefer to rely on the hundreds of court cases I have done where the court held every time that taking of payment constitutes an acceptance of the offer and a contract comes into existence.

          Again, I am happy to accept your opinion and your strong belief in what is written on websites. But if you have five minutes maybe pick up a contract law book and look it up. You will then find out the truth.

          I'm not sure why you keep referring to my statements as an opinion. I took a quote from Australian Consumer Law which has nothing to do with my own views. That law - indeed it only took me a few minutes to look it up - completely contradicts your assertions.

          In fact, it appears the ACCC has already made a statement in regards to these matters. The seller is within their contractual rights to cancel any online pricing errors. They MAY choose to fulfil the orders based on goodwill.

          "While a 'mistake' may raise concerns under the Australian Consumer Law, the ACCC's general advice is that if a business becomes aware of a genuine mistake in pricing and immediately rectifies it, the ACCC is unlikely to pursue it further."

          The key word here is immediately. Taking payment rebuts that immediacy. If a business send a confirmation e-mail, reviews the order and then takes payment, any later claim of mistake is merely a change of mind which is not permitted if a valid contract exists unless both parties agree to a revocation or alteration of the contract. Taking payment is CLEARLY acceptance by conduct.

          Look, as I am qualified in this field and have worked in it for a "while" now. I do not care what a website states, especially one that carries a disclaimer that the info does not constitute legal advice. There is a reason for that - the people writing the info are NOT lawyers and hence cannot provide legal advice.
          I am happy to ask a judge in that area to talk to you (provided you are in an area where I know a judge) and then you can tell the judge he or she is wrong and the website is right. Would that tickle your fancy?

          Anyway, I am happy if you believe the webpage and do not pursue these things further. Increases the chance for me to get my items without too much resistance and the willingness of the company to deliver if not too many people insist on their rights.

  • Worth checking out your local store. They may have other games at discounted prices that weren't originally seen online (before they were removed). For example, I got PS3 GRID 2 for $1 in store, and I am sure that wasn't available online when this deal was posted . The staff were all shocked - one said "but if it scanned at $1, then it's a $1".

      • Staff told me they had a bunch of games reduced this morning and I tried asking the staff for a list. He said he couldn't give it to me but that he is happy to scan any games for a price check.

    My local JB told me they oversold by about 600 units per title (I'm guessing it's the $1 ones). Guess I'll just have to make peace with it!

  • I would recommend going in store, while everyone is squabbling over the orders being cancelled. I just walked into my local JB and picked up Tales of Symphonia, Tales of Xillia 2 and Naruto Shippuden as those were the only games I was interested in and they still had plenty of stock. I did see Dark souls 2, Darksiders 2, MG:Rising, and a few other $1 dollar games. This was JB at Carindale btw around 1pm.

    • My store has nothing mate, and squabbling over orders being cancelled is fine especially when they cancelled my order due to no stock and gave me an explanation that it was due to technical errors. Unless you are in my shoes I don't think you quite understand the situation.

        My comment wasn't directed at you mate and I meant squabbling over orders in a "general" sense as some people are up in arms over the situation and honestly is it really worth your time taking action and complaining, as I have found in the past, sometimes it's not even worth it as sometimes they can't do anything about it and you just end up more frustrated ( I know I do) but It's good some people can make peace with it like yourself.

        Also I can understand the frustration in regards to your orders being cancelled but all I meant was going in to your local JB if you can (I guess in your case you already have), I am lucky enough to have about 5 JB's in my area and just check what's there. I was annoyed last night that I didn't place an order and just strolled through 3 Jb's today and found what I was looking for, so yeah that's all.

        Just check your local JB's if you can :)

      If the orders do get processed, that $1 delivery on each game is worth it.

      The hassle of driving, finding car park, putting up with traffic during peak hours, walking in and potentially get disappointed (possible JB staff doing underhand stuff like DSE?) is not worth the effort. It certainly costs more than $1 per game, unless you really that keen

      If I don't get the games that is fine, Paypal dispute if no refund. Plenty of others would be in the same boat as me.

      We, as ozbargainers, can all sit and wait and HOPE the ship doesn't SINK. If so we all sink together, and so be it! At least we will be called PROFESSIONALS!

      • I saw it there but I think I got the game mixed up with Darksiders 2 which is selling for $1, so most likely not, but I think it may have been going for $5-$10 as other have mentioned before.

    A heads up that Ni No Kuni for PS3 is also $10 in-store (I checked today, and that's what it scanned as). It's a beautiful game, and a great price for a brand-new physical copy.

  • Worth checking in store. I had a look at lunch time and there were staff in the process of stickering 360 games. There were a number of games with $5/10/20 red stickers, and a few with hand-written yellow tags on the front saying "Buy me for $1" or something. Nothing looked too appealing to me, but didn't have time to linger. $1 games were the Fable Journey (Kinect game), Fantasia, possibly something else. Other discounted games included Darksiders II, and some old sports games (e.g. PES 2012). I might have another look later, will report back if I do.

    I ordered Tales of Symphonia Chronicles and Tales of Xillia 2 with click and collect from JB Pitt St Mall in Sydney. My gf ordered ToX2 and her order was approved early this morning (even though she ordered after me) while mine remained at "in progress" all day. I called JB and asked them what the status of my order was. Apparently they had 37 orders with only 11 in stock. They offered to refund my money for that game but instead I asked them to get stock from another store. They're sourcing it from Penrith.

    If your click and collect orders are listed as "in progress" I'd call them up and see what the go is. If they're under supplied then maybe you'll be able to get it from another store. Better than finding out in a few days that stock is unavailable everywhere.

          @Carydadon: Kotara Homemaker had a ton of great games for $1 and the girl managing the clearance and long cardboard boxes was hella nice. Picked up around 20 different games around 1:30.

  • Made 2 orders yesterday: 1 with 2 $1 games (Borderlands 2, Metal Gear Solid) and then 1 with 3 $10 games (Disgaea D2, Tales of Xillia2, Tales of symphonia). The one with the $10 games has now been marked as complete / shipped whereas the other order is still "In progress". Honestly not too fussed if it ends up being cancelled, don't really see myself playing them anyway. Very happy the jrpgs got shipped though :D Good luck to everyone else!
