    So when they tell you to return the item at the sellers expense, do you just tell them that you can't because it's illegal and PayPal/ebay isn't above the law?

      Yeah sure, Paypal has your back, not. It's written in the Paypal terms and conditions that if Paypal can't recover the money back from the seller, then it's not a guarantee that you'll even get your money back, it's upto Paypal's discretion (goodwill) in that case whether they will give your money back or not. It's written there in the Paypal buyers protection policy. And you have no automatic entitlement for a refund. Paypal is not a payment money insurance company.

      S9.5 Where we are unable to recover the whole or part of your payment from the seller we may, in our absolute and sole discretion, decide to make a payment as a gesture of goodwill.

      S9.6 You have no automatic entitlement to receive any payments under the PayPal Buyer Protection Policy.

      It amazes me the people who buy things thinking that it's a sure bet that they'd automatically get the money back through Paypal any way, treating them like a payment insurance company. These people have never read the Paypal terms and conditions.

    It's quite clear from the pictures provided that it is branded. It has Bose written on both cups.

    • So does this 1:1 copy counterfeit have Bose written on both cups. That's why they are called counterfeits, exact looking copy. They are made to look just like the real thing.

        A fake is intended to trick you into thinking it's real. Why would you make it obvious that it's a fake? Honesty and fake don't go hand in hand. To clearly leave hints that it's fake defeats the purpose of fakes.

        I'm not saying it's real. It might be fake. If it's fake you wouldn't admit that it's fake though, or who would buy it? If it's fake, it isn't fake because it says unbranded. It's fake because it's too cheap.

          "Oh, BOSE QC35 is just the name of the product, not the brand - the brand is actually generic!"

          Selling fakes is illegal. If they're caught out they're done.

          Bose QC35 is not a generic item like a sponge or soap where anyone can make their own brand of it. It's a brand and a model in itself. If they just titled it generic 'headphones', that would work. They'll still get in trouble for showing Bose logos on the cups though.

    • Gee some thing seems strange there, price of $299.99 with a $99.99 Economy delivery. That delivery price alone is a scam on that sale considering that the seller was supposedly yesterday able to get them here for $228.88 delivered on the same Economy delivery.

      I hope this isn't a case of a power seller got his eBay account hijacked by a scammer who is doing over heaps of peoples. Most of the stuff the seller had been selling previously has been $1-15 junk and suddenly starts selling Bose QC35 headphones for a hundred dollars?. Yeah sure sounds suss.

      Has any one though that it could be a case of a hijacked Powerseller eBay account and you have been scammed?.

      It would be funny if peoples starting receiving parcel boxes filled with $1 junk in them and they got scammed big time.

  • I also purchased these after receiving an email from eBay advising of a price drop. I have contacted the seller and he has responded stating he will issue a full refund immediately and cancel the order. If anyone's on the fence about these it might be worth doing the same thing.

        • That wasn't an email come through right?. And are you sure that it actually originated from Paypal itself?.

          Log into your Paypal account and check whether a Paypal refund has actually been lodged through there, if not then you've received a fraud email.

      • No, well I'm not sure, however I had the QC35's in my cart prior to yesterday so when this guy uploaded his item, eBay sent me an email advising I should know about it. That's how I found it, then after seeing this post on OZB I thought it would be best to cancel. The transactions been cancelled via ebay, have to wait for the paypal refund now.

    As for the BOSE QC35, they all seem to have disappeared from sale. Maybe a bit suss that is after it suddenly sky rocketed the other day to $299.99 AUD, perhaps to try make it look like a genuine with the pricing.

          By the way i told you would all be disappointed. This deal was not legit, plus you would have received a counterfeit any how. Also for what i can tell, all this sellers traces of prior listening have been removed from eBay and looks like may have been banned. Will probably resurrect under some other name to scam more peoples.

  • I have a tracking number now.
    It was sent via china post, who's tracking isn't showing much information but when I put the tracking number into the iOS tracking app Parcel it says.
    It was sent on the 22/8 and current status is 'Dispatch from Sorting Centre, AUSYDA'

      This deal thread was made on the 1/8/17. Why did it take them 3 weeks to ship it?. Maybe they were manufacturing more counterfeits in China?. That's dodgy.

      Don't be surprised that it's a counterfeit. It was cheap for a reason because it's not a legit.

      And also. This eBay item page for this deal has completely disappeared even although it was only made a few weeks ago, no trace on it. I click on the link in this deal description and it comes up as 0 results. I think this seller on eBay may have been banned or done a complete runner. All the sale listings from this seller that was posted on this thread is saying that the listing has been removed. Which is only supposed to happen after 90 days or more after the listing has ended.

      So in my suspicion, these are definitely fake counterfeits and this seller has been banned and done a runner.

      Even this sellers feedback link has been completely removed. He's been completely banned. Maybe a heap of peoples around the world started receiving counterfeits and was reported to eBay?.

    Item arrived today and I’m sorry to say I have checked with Bose and they are indeed fake. You wouldn’t know however. They are amazing, sound quality and NC are off the charts. However they will not pair with the Bose Connect app or show up via USB on a PC or MAC.

    I’ll start the PayPal process.

      Funny how the seller seemed to had packed up shop and disappeared shortly after selling all these fake QC35. Even all the previous listings disappeared from eBay. He must have thought he had won the lottery when there was a sudden surge in sales of these fakes. Seller/scammer has probably gone on a luxury holiday.
