-ve vote for illegal and misleading statements by store…

    • -1

Your misunderstanding of the ACL is not a valid reason for a neg vote.

"returns" are NOT COVERED by ACL - that's the law!

Damage in transit or incomplete product on delivery (described in Deal Description) are matters to be dealt with quickly under the policy of the business, as they need to lodge a complaint against the transport provider. Those usually must be lodged quickly to process any compensation from the delivery business.

Manufacturing faults (misrepresntation, etc) are covered by the ACL, so covered under a WARRANTY CLAIM.

So those are NOT illegal and misleading statements by store!

Just because you choose to continue to misunderstand the ACL, and not learn about the actual ACL rather than your misreading of it, does not make you right.

You just mislead others through your ignorance of the law while making out you know it & criticise businesses who also are applying the ACL!

Link to your previous intransigence on this important issue of the law below.

-ve vote for continued misleading statements by jv on the ACL 'according to jv'😠

Too many people misunderstand the consumer law because people keep misquoting it - as they think it should be written.

Always act on legal matters after seeking advice from those with expert knowledge, ACL factsheets, etc - not opinions of amateurs misunderstanding the law.

Up or Down Votes on comments don't change the law. Popular misconceptions gain upvotes, while dry quoting of the law gets Downvoted😕

Not according to Australian Consumer Law

If it's faulty, you may not find out until you actually use it…

    • I'd like to see someone try rolling through one of these in a car and then returning it because the car failed to stop fully. I'd definitely get a chuckle from that.

    • Again this misunderstanding of Australian Consumer Law, jv😱

Please stop making false claims like this, misleading others of their rights under ACL.

As I explained - "returns" are NOT COVERED by ACL.
A "return" is for change of mind & not covered by the ACL, but store policy.

What you are talking about is taking back a (faulty, misleadingly described, etc) product (as set out under ACL) - which is termed a "WARRANTY CLAIM". Only those are covered by the ACL.

An item that has been appropriately used (which falls under the strict limits of the ACL) can of course be sent back - it's covered by law.

Time to learn about consumer rights under the ACL rather than make false claims of what the law covers.
Returns (because you made a mistake or changed your mind) are not covered by ACL. Shoddy or misrepresented merchandise is - as a WARRANTY CLAIM under ACL. And that covers merchandise after it's been used.

Just because people upvote your lack of knowledge does not change the ACL!

Misunderstanding the ACL is not a valid reason for a neg vote.

Judging by the company displaying price in EX. GST and not being aware of consumer laws, I suspect they are a B2B operation rather than B2C. However if I was a business customer of theirs, I would be annoyed that they show the pricing to the world which would allow my customers to see what margins I'd be sticking on.

    "End of line" bollards. Lol.

A wooden post does the same trick - don't cost 77 bucks exc GST and delivery either

And can kill vampires. Try doing that with these.

  • Your item must be in the original packaging.

You do not have to return products in the original packaging in order to get a refund.

Only if the product is faulty. For change of mind it's at their discretion.

      • That quoted line came after discrepancies or damages in the deal description so yes I was not referring to change of mind.

        • Under ACL, what you describe is a WARRANTY CLAIM under ACL (faulty or misrepresented, etc merchandise), not a "return" - which is a change of mind & not covered by the ACL, but store policy.

Unfortunately the commonly used term "returns" is applied to merchandise merchants have to take back under ACL (defined as a "WARRANTY CLAIM"), and change of mind, which they don't have to take back.
Both cases should be shown listed separately by businesses, with what the business will do in those separate cases..

Damage in transit or incomplete product on delivery (described in Deal Description) are matters to be dealt with quickly under the policy of the business, as they need to lodge a complaint against the transport provider. That's what was presented in Deal Description.

Im sure my missus has the opposite shape of a pole like that in the back of her car. It even has yellow paint just like it around the dent too.
