    I got a call from the OFT today.
    S/t Peter and he said he will follow up with SS and advise when there is an up.

    He said in the mean time i need to open a dispute with Paypal in case i do not get a response in time.

    Which i am doing now.

          HAH Jonathan is me. I just got the exact same message which they just copy/pasted to you!

          I replied saying that I will close the dispute, ONLY WHEN they reply to the paypal dispute saying they will ship my phone TODAY. This way there'll be an official record on Paypal's system.

        • You need to report this to Paypal. This is a bullying tactic and Paypal should contact them on your behalf.

          "Thanks for finally responding to my support request with the following statement:

          "Unfortunately we can not dispatch your order unless you close your dispute."

          Given that you have stock, I assume you are ready to ship my order out immediately. Please confirm that my order will be shipped today (10 August 2011) and I will happily close this dispute.

          If you do not send my order out today, then I will assume you do not have stock and will lodge a fradulent listing complaint with eBay, as well as update my case with the Department of Fair Trading."

        • Good, so a dispute makes them sweat. I'lll file one AFTER they ship the phones and they can have fun dealing with it.

          Actually it has forced them to respond, they didn't reply to any of my 3 previous emails but as soon as I lodged the Paypal dispute, BAM! result.

    For those who are just getting their dispatched letters today, once DHL physically gets ahold of your package then its only a matter of days (or in my case, just over 24hours) til you get your package. Dw, guys its almost over.

      • Mine is the same as dahurldog, but then I'm in Melbourne. If dahurldog is in Melb, I assume Melbourne is coming via SG, where as DHL has a straight flight to Sydney.

    Still no shipping notification here, still at "paid"……. :(

    • Ditto, been sitting at paid since 11th last month. Trying to force their hand with PayPal/OFT, see above posts with me and chylld.

          OFT & PayPal. I didn't ask for a refund, I want my phone. I stated it quite clearly, and laid down all the facts about them trying to manipulate buyers to drop disputes with PayPal. Even if OFT doesn't do anything, it's pretty clear they're breeching T&C with PayPal as a seller, trying to get around PayPal's buyer protection.

        • BTW, I lodged a non-receipt of item dispute with PayPal, not a request for a refund.

    If I don't receive a tracking number by 7pm AEST today (10/08/2011), I will file a dispute with Paypal. I will make sure all the information will be passed onto Paypal and Department of Fair Trading. "

    • Thanks tulip for this, I sent a similar email to this effect, and within 20 minutes my order was "dispatching".
      Within a few hours, it was dispatched with a tracking number (although the number doesn't work)
      At least its some progress.

  • OFT just contacted me that they gave their online store manager a call earlier this week. My order was changed to ""Order sent to HK warehouse"" and dispatched within 4 hours after that.

    If your order is still in paid status, I don't think it is queued for dispatching. They are just lying and not trying to dispatch it for you anytime sooner(They told me mine was being dispatched two weeks ago but until this order was sent to HK warehouse, nothing happened). Thinking about it, how would HK warehouse know to dispatch it if they havne't sent the order to their HK warehouse?

    Lodge your complaint to OFT if you haven't got a ""Order sent to HK warehouse" status yet.

      • Nah, that's a load of shit. DHL doesn't take that long. When you get your tracking ID, you'll be able to see when DHL first receives the package, and I think you'll find its a few hours after its marked as 'dispatching'.

        I have doubts you'll receive it today, but good luck to you either way.

    • its a legitimate deal and everyone who bought it will get the phone eventually, there was no part in the description that says customer service/waiting time will be awful, just take it as an experience and neg any future SS deals

    SS are being stubborn, insisting that they can't ship out the phone until the dispute is dropped. At this point in time, this is more a matter of principal, than just trying to get my phone any quicker. A month has already past, I don't care about another week or two as long as the right thing is done.

    The dispute will be closed when you ship out the phone and give me confirmation of shipping with a working tracking number, not a fake one which I know you have done to several others who have also ordered the phone. If the dispute is closed, I as the buyer can't bring it up again, and I'll have no financial avenue to protect myself. Send out the phone, and I'll close the dispute. This problem is entirely on your end, and has nothing to do with PayPal. The only reason I raised this dispute is because you have been uncommunicative and unresponsive, and PayPal disputes are provided by PayPal to protect buyers from sellers such as yourself.

    It is unethical that my order has been put on hold while new orders on eBay have been going forward. I have been keeping track of all communication and information, and have already lodged a complaint with the Office of Fair Trading.

    Please just do the right thing and send out my phone which I had paid for a month ago. Once I have confirmed that you really have shipped the phone out, I will drop the dispute.

    This is pretty clear to me that they are at least in breech of PayPal T&Cs, coercing a buyer to close a dispute in order to get a product they had already paid for. If this keeps up, I'm going to raise it to a claim, hopefully kick up some fuss and PayPal can give them some trouble.

    • You should report them to PayPal immediately. Withholding shipping of the product further as a result of the dispute is clear violation of the T&C as you've noted. Let them know about this, I'd love to see what they have to say.

      At first I was happy to wait 3-4 weeks to get the phone cause it was such a good deal but reading through here and seeing that they're shipping orders at full price from eBay (and most likely their website as well) has pissed me off.

  • I'm a little disappointed. Firstly i am super happy for everyone who has recieved their phone or has theirs on the way.

    I have:
    *Contacted the ACCC
    *Sent a letter of Demand
    *Logged a complaint with the OFT
    *Opened a Paypal dispute.

    My phone is still at paid… Aside from the paypal dispute, all this was done last week. :(

      • Yeah, looks like a copypasta response, same as what chylld and I got. What's the best way of contacting OFT when I've already lodged an initial complaint?
        Probably worth escalating the dispute to a claim, just so PayPal can see the dodgy stuff SS is trying to pull.

  • mine said dispatched and I was given a tracking number. Tracking status said 'shipment information received'. I am sure my phone has not left the warehouse. SS only sent the information electronically and DHL have not picked up the shipment yet.

    If you received a tracking number, did DHL pick up your phone today?

    • Mine was dispatched yesterday at 3pm based on SS status. DHL tracking number shows they picked it up around 4pm same day.

      Week 1:

      The modem cost is around 150$. I do not want to call their support again – as I get the same reply over and over again "the transfer will happen today, sorry for the inconvenience". The transfer hasnt happened in the last month and a half !

      Could anyone here please advise on what I should do?

  • Left positive feedback on product review. (But mentioned the very slow and misleading service).
    I'm happy, it may have taken a month but it is the cheapest price ever, the phone was in a sealed box and 100% new.
    This was a fantastic deal for those who got theirs delivered and were willing to wait a month. If they had told us that up front it would take 3-4 weeks and we will screw you around and service the ebay higher price payers first etc etc a la your order will be very low priority, then a lot of the anger could have been avoided.
    Great deal for me, sad it turned out to be a bad deal for others.

      well the basic truth is that this was a pricing error that SS were good to honour at all… you can understand why they'd prolong orders since a few angry customers is better than making a loss. not ethical, but from a balance sheet perspective it's the right decision.

      the productreview.com.au entry for SS though is for the shop and not the deal, and the shop handled its customers badly. couple that with all the negative feedback on whirlpool, and even my 1 star rating is generous!

  • I finally got my shipment notification. My order was on the 11th 22:10..

    • the order date and time doesn't mean anything to SS, they said "orders are randomly dispatched". A few people ordered on the 12th have already received their phone last Friday.

  • No response or updates to my case since yesterday, sending another message:

    You have 4pm AEST today to ship out my phone and send me a working tracking number. I'm not putting up with this rubbish any longer. I know many others have had their phones shipped out already, and that you have current stock in your eBay store.

    If you do not actually have available stock, I will lodge a fradulent listing complaint with eBay. If you insist that the PayPal case is the reason for non-shipment of my phone, I will escalate this dispute to a claim and report to PayPal that you are employing bullying tactics on customers, as it is clear that you are trying to coerce the buyer to forfeit their PayPal buyer's protection, and then I will update my case with Office of Fair Trading.

    Again, I will wait till 4pm AEST today before taking further action. Please to not make this harder than it should be for the both of us. I look forward to your response.

      I'm sorry you're still left out and I appreciate that you're sticking up for the rest of us. I understand that you're angry, but I think you'll be better off just dropping the Paypal dispute. You still can turn to the OFT if they don't dispatch for you.

      • Hm…I'm thinking I'll take my chances with PayPal. It's pretty clear that they're doing something very wrong here, and someone needs to know. PayPal probably has the largest immediate affect on them, seeing as it's one of their major methods of payment. Both OFT and PayPal might only give them a slap on the wrist, but at least PayPal's one has an immediate consequence (no payment)

        • Concur.
          They do not have a right to bully you into removing the dispute with Paypal. When the dispute is resolved they'll get their money. That's part of what Paypal is there for.

  • So yesterday I got thinking about how they said "Unfortunately we can not dispatch your order unless you close your dispute." and I wondered if, especially given the recent frequency of fulfilments, they weren't actually bluffing. So I called it:

    "I have closed the Paypal dispute as requested. Please ship my order immediately"

    "Thank you, your order will be dispatched ASAP."

    Last night I got an email with a tracking number… which didn't work. Checking again now though:

    • Did you actually drop the dispute, or just say you did?

      • actually dropped it… after copy/pasting all their support ticket replies into it for Paypal's records

        • PayPal don't actually look at their tickets unless a dispute is raised to a claim, it would take too much manpower. That's why I'm thinking I'll sacrifice a delay in receiving the phone so PayPal can take notice of this case with SS.

          I'm a man of my word, I'll wait until 4pm. Very tempting to raise to a claim right now though.

    • ours have exact same dispatch notes? are you based in sydney?

      i'm rather hopeful of it arriving into customers during the early evening and being delivered tomorrow mid morning

        darque (also syd) had his in hand 27 hours after the first event… which is 1am tonight for us. meaning we should get it tomorrow morning?
