    Well it's past 4pm and I've escalated to a PayPal claim.

    Until dispute was filed, seller was generally uncommunicative and unresponsive. After some back and forth, the seller posted a response coercing me to drop the dispute, then they no longer responded to any further communication.

    The seller indicates that they have stock in their eBay listings, and they have been shipping out stock to other customers, but refuse to ship mine until the dispute is dropped. This is a clear violation of PayPal terms and regulations, as the seller is bullying a buyer into dropping a dispute, withholding shipping of stock until it is done.

    OFT hasn't gotten back to me since I filed a claim earlier this week…any one have any ideas?

    • OFT contacted a few people about this case, and I don't think they'll contact every single individual. From what I read here, OFT had also contacted SS.
      if you do need to talk to OFT, give them a ring would be your best option.

    I am hoping to receive my phone tomorrow. Also hope that no issue with the phone as I really don't want to deal with SS anymore.

    This is my first android phone. Can you please recommend some good android applications that you like?

    • Just browse the top free/paid apps in every category, and gradually dig down into that list in your spare time.

      There are also some gems to be caught by occasionally browsing the just in list. ;)

    I'm sticking to my guns.
    I refuse to drop any complaint. What they are doing is wrong on so many levels. Not only is it morally wrong but illegal too. I want my phone but i am not letting them get away with it at the same time.

    I contacted the OFT today, i wanted to tell them about the "Close Paypal dispute and we will send your phone" comment SS made. Was told the guy handling my case will get back to me.

    • You know you don't need a 'PayPal claim' to pursue legal action on an Australian Business right?

      What are they 'getting away with' anyway? ($3 of interest?)

        I'm not trying to sue them. I just want it known that SS cannot treat customers this way.
        If they sent my phone and i recived it. I would just let everyone know (OFT, PayPal) and be done with it.

        I refuse to submit to their bullying tactics. As i said a while back i was happy to wait. Once they started shipping phones to eBay customers and maintained that they didn't have stock. Shipped out the phones randomly, now refusing to ship my phone unless i close my dispute. It's ridiculous.

        I don't think i have ever been treated this poorly as a customer.

  • If SS is trying to get you to close the paypal dispute before they send the phone, cant you tell them on the phone that this is bullying tactics? Just a question out of curiosity.

      So, anyone who still hasn't gotten a dispatch message, go bug SS! Don't just sit on your hands, they clearly have stock. Those who have already raised a dispute via PayPal, you can either drop the dispute like chylld and get a dispatch, or escalate to a claim and try and get PayPal staff involved. AFAIK, only chylld, cittris and I have actually raised a dispute with PayPal.

      I still recommend people to raise a dispute with PayPal, if only after you get shipping confirmation so SS can't hold your phone hostage like with myself and cittris. SS have jerked us around plenty, it's only fair that they get a taste of their own medicine. Of course, that could just be the bitter side of me talking here. Remember, PayPal freezes the money in a seller's account when a buyer raises a dispute until it's resolved, so SS will be forced to talk to you, something they've been so reluctant to do the past month.

      • They aren't bluffing, I'm fairly sure they have 90% of the stock in by now, all the people I know that ordered one have been sent tracking details.

        Why would you want your money back now? :\

        If you wanted to win you would either take the phone at cost price or refund a month ago. (Best you can do now is demand some form of compensation.)

        • We are all aware SS has stock by now. It's that they want ppl to close the dispute before sending the phone, because by doing that it saves their face from Paypal, cos dispute like this will be recorded by Paypal and it may give SS problems in future.

          SS is really holding their goods as hostage, and in real life holding something/someone as hostage is a no no with law =)

          We're not looking for our money back, that's what SS want us to do. We want the right thing to be done.
          I think the both of us want our phones quite badly, but we want SS to know they can't bully their customers even more. Taking actual legal action will take a bit too much effort (and time…and maybe money), while lodging claims at the OFT and with PayPal is something that has actual repercussions for SS while minimising effort on our part, aside from playing the waiting game.
          In my PoV, absolute worst case scenario, I get my money back. Not what I wanted, but at least PayPal can do that. But if that's what happens, I assume SS will take a hit from PayPal for abusing the customer and violating T&Cs. When PayPal looks at my claim, I'm going to tell them to look at other disputes in the SS account, hopefully they'll see more cases like chylld where the buyer ended up closing their dispute instead of escalating.

      • I gave them until this afternoon 5pm in my letter of demand. If they don't deliver by then I'll be raising a Paypal dispute too.

      You really should contact the OFT even by phone (NSW Fair trading enquiries and complaints - phone: 13 32 20).
      These bullying tactics with holding the goods until you remove your Paypal dispute are illegal and the OFT would like to know about these. These would really get SS into trouble.

    It sucks how SS is treating customers but hey I guess you get what you paid for. I think if they initially went and refunded everyone and say it was a misprice it would be alot better looking on their part. Instead they honoured the deal but then screw around with us will cause more harm than good for their reputation. Especially when ebay customers getting it way ahead of us.

    I hope SS learn their lesson, cos this had cause quite a bad rep for their brand.

    Anyway my phone's arrived in brissy and should be delivered today (YAY!, it's still cheaper than what we can get currently)

    • Don't know DHL does that. I always get a call from them before delivery.
      In my case, the courier rang me before trying to deliver to home, told him no one's home and gave him an alternative address, my work address. Another driver delivered yesterday afternoon to my work place.

      • DHL should be the express transportation… Yes, they don't work on Sat.
        Actually my place is close to the Brisbane (20 minutes) airport without a traffic light. Now I have to wait again. Waste my time.

    I've been following the thread since the deal came out. I already bought a phone before this deal, just 2 weeks before, otherwise might've tried my luck with this deal. A friend also wanted in on this deal, however he missed out by a few hours.
    At first I laughed at him for missing out, but after following this thread for a month i can see he probably made a wise decision.

    To the guys willing to stand up and not be bullied to close the paypal claim, I salute you. Whenever I buy online as a matter of habit i just wait for the goods to arrive without complaint, even if the shipping takes an inordinate amount of time. For you to escalate the claims is something i probably wouldn't have the guts to do, unless it was something extremely important.

    Anyway this thread seems to be winding down since most people have now received their phones. Good luck with the claims, it's been an entertaining month, to say the least. I definitely enjoyed the drama, better than any soap on TV.

    but still box was in UNSEALED condition. box abit dirty too.

    • because a majority of the buyers here all received sealed boxes, sounds like customs to me.

      my package from US got opened before, but there was no customs note, kinda pissy.

    • if a custom opened your box, you would get a "Opened by Australia Custom" seal/tape!

      contact the seller/sender in this case!

  • Could have been opened by Customs but they usually put a note in there to say it has been opened.

    Was the phone is brand new condition? (Ie Showing any signs of being out of the box?)

        I would personally just let it slide, you have the phone, it is brand new and looks like it was opened in Customs. But thats easy for me to say as mine was sealed, but I would prefer not having to deal with SS anymore but it depends on how much you love beating your head against a brick wall.

  • My phone arrived today! Exactly 1 month later.

    Emailed Shopping Square about the warranty. Their reply was that our warranties started on the day of dispatch as recorded by DHL. Thank god not from date of purchase!!

    Umm, you guys who are raising your paypal disputes to a claim are just kissing your cheap phones goodbye.

    Raising to a claim immediately gives SS a big fat REFUND button, which closes the claim automatically and PayPal doesn't even look at it.

    Its all totally automated, just like the dispute process. Its only if the seller disagrees with the claim that someone at paypal actually has a quick glance at it after its been open for several days.

    A better way would be to report their extortion tactics to PayPal by other means, so that PayPal can still ignore it, and continue to sit back and watch the dollars roll in.

    • had to +1 this for the fact that I just discovered that today from another ebay transaction. So yes, SS could have automatically refunded you and close it immediately without much hassle but they did want to ship the phone anyways so I would suggest to just enjoy the damn phone and troll SS deals later lol.

    Just wondering, if any one got the samsung reader hub working ?

    • It's broken for me as well. Can't update the software. I don't really intend on using this feature.

      I think it's due to a missing csc file (whatever that is). Google it for a way to fix it.

      • Thanks for your reply Annoynimous. I installed Samsung Kies on my laptop, checked for firmware and KIES said firmware was up to date, no new firmware available. did you update to kg5? was the original firmware version on your phone same as mine?

        • yes, we all start with the same firmware 2.3.3 xxkg1

          the new xxkg5 was released in Poland for now. It was officially distributed by KIES and was extracted for every other i9100 owners to use.

          whether you want to move to this update IS UP TO YOU. But it is easily done by using this guide,

          THIS DOES NOT VOID YOUR WARRANTY AS IT IS AN OFFICIAL STOCK ROM BY SAMSUNG

          if you do install custom roms and kernels, there will be a yellow triangle with an exclamation mark during boot up. This ROM does not show the yellow triangle hence it is verified.

          Dialling [asterisk]2767[asterisk]3855# on your sgs 2 will give a factory reset plus full wipe on the internal SD storage, please be careful with that.
