Hit by a Bus Leaving a Bus Stop. I Was Overtaking. Who Is at Fault?

Dear all

The bus was stopped.

I was overtaking the bus, but it starting moving (i.e. left the bus stop) when at the same level.

I was trying to turn left, I had my blinker on. The bus hit me at the rear.

The video shows that the bus was stopped and put its blinker just before I was about to pass it.

So am I at fault or not?

    Looks like the busdriver is at fault.
    You appear to have driven reasonably. There was nothing you could do to avoid an erroneous driver turning into your path.

    If a bus is stopped waitin/picking up, we can and need to pass it. So why do so many here think the driver is at fault?

    • because A) the Bus Driver did NOT turn into his path, the car turned into the Buses Path. b) he was driving without his lights and without indicating his turn. c) the Bus driver had clearly indicated prior to him trying to overtake and cut in.

      Yes you can, IF the bus is not in motion nor signalling to motion. The bus didn't change lanes at any time.

    • Cos the bus was indicating to merge back out onto the road…Which by law (in VIC) you have to give way to buses.

      And this is why we have so many more accidents in Australia on the roads. Cos when going for your license, testers are only looking to see if drivers can 'drive' safely, instead of understanding the many rules / laws we learn over the years living in Australia.

    Lol op forgot turn light plus over tacking turning vehicle and blaming bus. Bus driver could not see you when your light was not on. I think op deserve pay insurance access plus fine too if take this case vicroad 😂.

    Also, ever consider how much buses and trucks weigh compared to a car. Don't dodge in front of them and expect them to 'stop on a dime' because you're in a rush to get in front of it. Buses carry unrestrained passengers who may be standing which is unsafe for emergency braking situations, so they Need to have other traffic Give Way for them.

    Pro-tip: blinkers let others know of your intentions, don't be a cheapskate trying to prolong the life of your lights by not using them.

    You should forfeit your license before you get yourself and others into more road trouble in the future

    • there was only about a bus length from where the bus is and where you tried to turn left.

    There is no way in hell that was a safe merge.

    OP can't drive and your footage contradicts your whole description.

    There is clear signage on the back of all buses which state you need to give way to merging buses, you stated the bus DID have his blinker on which tells me you didn’t give way. Case closed.

      What's scary is their are 20 people that looked at that and came to the conclusion the bus was at fault. Those are people to stay well clear of on the road.

        That's the one haha! Thats a 450 line bus, and their drivers are crazy stubborn too, I can almost assure you he saw the car coming in and just didn't give a toss. It's weird how so many accidents happen on this stretch of road.
