As pointed out, could easily be a price error, but worth a shot

EDIT: Just got off the phone with DSE online and they can't say if its an error or not. Might be worth a punt but remember, if it seems too good to be true…

  • A little disappointing that i'm not getting the cheap speaker. But happy with free headphones! Will be keeping an eye on things here and facebook though to see if anyone complains and gets the speaker for the cheap price.

    Looks like their eBay account might be in a bit of trouble, eBay don't take non-delivery lightly. They're always drilling in that every sale a binding contract.

    So I think eBay will be on our side with this one..

    The DS eBay Store terms of sale are blank, so we are operating under the eBay terms of sale.

    eBay terms of sale for a seller say they MUST post the item if it sells. No exceptions.
    This covers Buy It Now and auction items.
    Suppose you sell an item worth $500 and it sells for $20 after not many bids, you have to post it, the sale is legit.

    We are made to confirm our order before buying noting that we are entering into a legally binding contract of sale, if we can't pull out of it later, nor should they be able to?

    Also when they said they would not be fulfilling my order, and I never got an offer of free headphones, why the lack of consistency?

      The more people write in to eBay to complain about this item, the more they'll be pressured into doing something rather than reply with the typical canned response. So c'mon everyone who's been shafted by Dick Smith, get going and write that letter of complaint now!

      They have been previously on sale for $47.07 so I wouldn't say it looked too good to be true especially considering it was marked as a MEGA DEAL this time around.

      I think that is a buyer warning against possible dodgy/scam stock.
      Doesn't apply to a store who is legitimately selling an item, not trying to scam us.

      My sister was scammed by a Go Pro new for $199 Buy it now.. Thankfully Paypal refunded her, but not sure if the guy on the other end was held accountable or Paypal's insurance covered the loss.

      We know that DickSmith's intention wasn't to scam us all out of $26. It was a legitimate item.

    I found a display model at a dick smith store but they refused to price match

    If anyone is able to help me out, using their order number, and ill be able to pick one up from that store , pm me please. Ill be around here for the next 2 hours

      Dickie wont price match with their own online store, I tried that already, dunno why. I reckon they should just shut all their retail shops, coz I can buy it cheaper on their online shop or somewhere else. No point having a store that can't sells nothing.

    Just got off the phone with dicksmith rep who said they just received an order from Head Office, and that my order might not be cancelled, she took down my email and phone number and said that we should be receiving an e-mail soon with an update.
    So not all hope is lost i guess?

    Just got my money refunded via PayPal…even after sending an email in no uncertain terms that I would not accept a refund and wanted the items as advertised.

    Will be escalating the matter further.

      I also replied to the eBay store telling them under no circumstances should they cancel my order, they do not have my consent, its a breach of eBay's terms blah blah

      Then they refunded me against my instruction. I'm not sure that's permitted

      On the phone to the Online help number now… Have been put on hold for the 2nd time. Their warehouse is 100% out of stock, which I can understand, but they have more on order, I will be requesting to re-instate my order and wait.

      • I also messaged them via eBay but they still went ahead and refunded me, without responding to my complaint. They way they have handled this debacle has been just appalling and unprofessional.

        Don't worry mate, little do they know about the power of Consumer Law and of social media. If they think that refunding an order will somehow absolve them of their responsibility to deliver the items then they're in for a rude shock ;)

        By the way,how did you discover that they have more items on order?

    Dunno bout anyone else but I purchased from the ebay store and before I did I linked in via the Velocity site to purchase. Velocity have listed it as a pending purchase, so I'm sure I'll get around 150 Velocity points for trying this knowing it was full well a pricing error (I had ordered 3 boom boxes).

    No headphones for me, but me care. Will still score the points for nothing I suppose!

      I'm curious about this too.

      They don't know their arse from a hole in the ground. Was sent an email and told refund, than another saying it is ready for dispatch later on, and just now a reply from a 2 day old FB PM saying refund. So useless.

      At this point is Dick Smith and the way they have handled this that had annoyed me, more so than not receiving my order.

    • I got this email too. If you look at it clearly it says -ve dollars, implying a refund. I do, however, agree that the situation and their handling of it is absurd beyond belief

  • I just received an update from DSE - they are trying to refund the order.

    They provided a different reason to the email though - they are claiming and I quote "the item was set up incorrectly and should not have been sold online".

    Whilst this is unfortunate, it does not excuse the attempt to pass this off as a 'price error' like they were trying to claim in the first email.

    As I have stated before, this speaker was legitimately on clearance and the price advertised was not an error.

    Just because something probably "shouldn't have been sold online" does not make it ok for them to dishonour any purchases. Our contracts with DSE are legally binding under ACL, and I have informed them I intend to press until I receive the entire order.

    As such, I have informed DSE that I am rejecting their refund and was given the following email address to file a complaint.

    I hope this can help anyone in a similar boat to me who wishes to take this fiasco up further with DSE.

    On a more positive side note, I have been impressed with Kristina's prompt responses and updates via DSE's Facebook page. I feel for the poor woman - she is doing a great job personally but her management team are not supporting her through their belief that false/misleading advertising is ok.

          i am , but time to sink into reality that we are never going to see them. I asked a sales person to look into the inventory of Boomboxes in Australia and he could only see 1 in each store ( which he said is display models) and nothing in the warehouses. Logitech is no longer selling them (cant see them anymore on their website) so its safe to assume that they are EOL and what you find in stores are the last of the stock available locally. Even if they try to source them from the distributor, i doubt that would have any.

          The old boombox UE looks like its been replaced with UE Boom Wireless Speaker which retails at $199. Maybe best bet s to demand one of these as a replacement but good luck with them agreeing on that

        For the umpteenth time, this was NOT a price error.

        Any claim that it was is baloney.

        This UE BoomBox was already on genuine clearance, and I've explained earlier in this thread how the so-called 'too-good-to-be-true" pricing could easily be achieved through vendor rebates.
        (FYI - Retail markups need to be seen to be believed sometimes…!)

        It looks to me like DSE miscalculated the amount of BoomBoxes they had left on hand, but unfortunately this does not excuse them from honouring the deal they advertised.

        (A deal which drew many, many people to their website and eBay stores. A deal which probably netted them extra sales whilst people were browsing online with them too…)

        Advertising stock/deals on sale that you intentionally or unintentionally can't fulfill (let alone accepting orders and charging credit cards) is a clear breach of ACL guidelines.

        I am not taking a chance here mate, I am simply enforcing my rights under ACL.
        These are your rights too.

        DSE have stuffed up big time here. They know it, and they know they've breached the ACL guidelines through false/misleading advertising. As such, they are hoping their offer of a refund plus 'keep the headphones' will be enough for most people to walk away and stay quiet.

        I on the other hand, don't really give two hoots about the free headphones. I wanted the BoomBox that was going EOL. I waited for this particular model to go on clearance and I don't intend to stop until my contract with DSE is honoured and my entire order is fulfilled.

        If DSE genuinely don't have the stock anymore and want to offer me a wireless speaker of similar make, model and specs as the UE BoomBox I purchased, I am listening.

        But I will not accept a refund.
        That is my right under ACL, and it is yours too if you purchased this deal.

          What I meant to say was "it does not excuse them from honouring orders they took whilst the deal was still being actively advertised."

          Under ACL, if DSE had limited stock and advertised it as such, they are free to stop honouring the deal when they run out of stock.

          I placed my order whilst the deal was still advertised, and was active on both the DSE Website and the DSE eBay store. There were plenty of units remaining on the DSE eBay store too, so my order is valid and DSE are legally bound to fulfill it under ACL.

          Hypothetically, say there were 100 advertised on eBay, but they only had 10 in stock (the error was someone putting an extra 0 on the end of the quantity) and the manufacturer no longer produced them, how would you expect the "DSE are legally bound to fulfill it under ACL" to apply?

      Also, the reason they gave in my e-mail was because it was a "price error". It certainly doesn't inspire much confidence when they're giving different reasons for cancelling the order to different people.

    My headphones arrived last week and i just got the email Friday afternoon that Boombox has just shipped! I am pretty happy my one got honoured! Thanks whoever works at Dick Smith and shipped my order!

    Order 2 through the website, Headphones arrived, no cancellation email, they have refunded 1 with shipping.

  • I got the headphones delivered but no boombox, and hadn't heard anything from DSE, so I emailed them on Friday asking about the boombox delivery and got a full refund this morning.

    Pretty happy with that, as I had no use for the boombox, but my niece will love the headphones :)

      Take a close look at the invoice. You may notice the - symbol to the right of the number. If so that means they are processing your refund. Unless you look closely it appears as if they are invoicing to send the item.

  • Weirdly they delivered the headphones to my billing address, not the shipping address on my order. And left at a post office several suburbs away from my house.

    Seems like there is a certain startrack courier in my area who only takes stuff back to one post office (that isn't open on weekends) regardless of where it gets delivered to, which is a complete PITA. My local one is 2km away and open on Saturdays which works perfectly with any other deliveries.

  • Well it seems DSE refunded the money back to my Paypal Account, but the money went missing somewhere between Paypal and my Bank Account…

    This has been a huge headache from the start..

    Finally, after four calls and an email which no-one bothered to respond to, I managed to get through to the most senior supervisor available at the online sales support centre (Joyce). Apparently there is no longer any stock of the item available in their physical or online store warehouses.

    I have advised them that they are under contractual obligation to provide the goods as per Australian Consumer Law, but if the items are not available then they are obligated to provide an item of equivalent value, that I will be escalating the matter to ACCC and VCAT if a satisfactory outcome isn't acheived, and also that I would be advising other customers who have been affected to do the same. She was very understanding and said that she would be passing a memo on to senior management and they will be getting back to me.

    I would advise other customers who have been caught in the same situation to get in touch with Joyce as the more complaints there are there more likely Dick Smith are to take this matter seriously, rather than hoping to fob people off with a pair of cheap headphones.

        • Bought an item that was advertised at a cheap price. Got an email later that it was out of stock. Advised them of contractual obligation of ACL. They refused to replace the item of an equivalent value. Took it to ACCC but they were in favor of the online shop and basically said that a refund is a satisfactory resolution even though i expressed that i would be happy with an equivalent item of same value.

          Seriously don't bother as its a waste of time

  • Yeah, I called today and a rep told me that they've all been advised to say " theres nothing they can do other than refund and let us keep the headphones " to anyone that calls regarding this deal. In other words, they've basically told all the support team to repeat " There was a system error , we refund and you get headphones" to customers.

    My e-mail didn't even get a personalised reply. They just forwarded the previous " price error " email as a reply. Going to call again to complain and at least get a speaker of equal value.

  • I'm yet to hear from Penis Smith, so I think it's time to escalate the matter to VCAT and ACCC. I don't care if they rule in their favour, at least it'll establish a record of unconscionable behaviour if ever this kind of things happens again in the future…
