I contacted the customer support, who seems to indicate that they may be putting the sale back up in a few days.

They offered me the 21 day refund after I enquired if it was being offered (guy was nice but didn't know about it). But it doesn't help my situation as I need the item is over $1k without the discount.

  • Contacted eBay via chat after purchase and was offered a 15% refund via PayPal on any purchase where the payment is made before 11:59PM. Lady typed that if there was anything else I needed to go ahead and pay then contact eBay again before 11:59 tonight.

    • Sorry - can you please clarify… You only added to your cart and purchased AFTER the code expired - couldn't enter the code - went ahead and made the purchase anyway - then contacted them via livechat - and got the discount anyway? Is that correct??

      • I don't think having it in your cart is necessary to get the 15% discount, but you will only receive it in 21 days. But no idea how they're actually going to track it. Unless they just go all purchases on the 31 st get the discount.

      • +1

To clarify I spoke to them on livechat and mentioned I was frustrated that I spent 2 days researching products that I want to purchase thinking it would end at 11:59PM tonight. The lady then said they would honour the discount and to complete the purchase as normal (don't forget cashrewards) and let her know the item number, PayPal address and transaction number. Pretty painless, plus the conversation is logged and forwarded to my email.

  • Well, they're not giving it to me. Excuses galore. Saying the items are listed on the USA site; that it was pulled yesterday at 1pm, etc. Now going to try livechat.

  • And their phone number is now closed.

  • +1

    [Sigh!]

Well, as you've all read I've been told no dice. Every excuse he could think of was mentioned. Even down to saying I didn't meet the terms and conditions because one of my two orders were all items listed ebay USA! I said I did meet the conditions, it doesn't matter what country the item is located, as long as the item is available to ship to Australia and shows up on the Australian .au site.

Anyway… He was prepared to contact the sellers and cancel every item, rather than grant the discount.

Therefore, could I ask anyone that had success with ebay reps after the code expired, a big favour?

I happened to mention to him that dozens of other people were still getting the discount - only minutes earlier (he had said it was cancelled 1pm yesterday!). He then demanded I provide him with ebay usernames so he could lookup email/chat to see if what I was saying was true. I said that was unacceptable… to be asking me for other people's private details!

Anyway… Would anyone here please consider sending me your chat record via PM, so I can rip into them tomorrow? I don't wish private names, etc. but either the transcripts with those details removed would be good - or a couple of usernames (with anything else removed) would be even better, if anyone feels to help.

No. Build a bridge and get over it.

      • +1

No I won't. Why should I accept a loss of over $150 because I got a lying ebay rep that wanted to fob me off so he could get home early. I was far from unpleasant, so it wasn't due to any attitude (not that it should matter). At least not until he started accusing me of not complying with the promotion by buying items on ebay USA - when I made the purchases through ebay.au - like people have on here before me - and when it was ebay that isn't complying with their own promotion.

        • +1

Thats your problem. EBay does not care about your problems. You have no legal recourse despite all the ACCC hysterics from people who dont understand the ACCC. And no one cares about your personal communication with an ebay rep who no doubt does not care about your problems. Again, build a bridge.

  • Has anyone who purchased via CashRewards after the Ebay code expired received their notification email from CashRewards?

    • Placed my ebay order at 2:28 yesterday, and recieved by cashrewards confirmation at 12:30 today.

  • So annoyed, was about to make all my purchases, and now find the offer has finished early. Don't remember this ever happening on their other deals.

Oh well, such is life. I'm sure there will be another one soon - I just hope it is for anything on ebay & not just at specific stores.

    • I'm genuinely concerned for the sellers of the items I bought. i.e. It's daytime in the US. As far as they know they've received their payments and will start shipping to the Australian with over a decade-old, 100% glowing feedback, mostly made up of international transactions.

One item was a laptop. So the guy ships it, only for ebay to cancel the transaction (which is what the rep that I spoke to planned to do - like sellers are garbage). And because it's all done by shopping cart now, instead of individual items… How do I protect just him!? (And just accept the loss on the smaller items.) Thinking of messaging him, but what do I say, plus it has to go through ebay's system because they're so paranoid about losing a few dollars in side deals - which often has delays (when it works). What if he doesn't read it in time before leaving home. And if I try to cancel just that one, will ebay cancel them all. Unlikely all sellers will get or read the messages before they head off to USPS… Argh - what a mess ebay has made here.

Need to think about this more.

      • It wouldn't surprise me if they refund the 15% to everyone anyway. I doubt they have the spare resources to go through every call log to see who they promised what.

Try Ebay again, maybe get someone else.
Maybe you could say you spoke to someone on the phone who already said it was OK.
You made the purchase like they told you on the phone, and then went back to report it like the person on the phone told you to.
You went to the chat this time because you wanted to get the confirmation in writing and now you are getting told no.
Tell them you don't want to have the sale cancelled because you need it in this tax year but don't believe it's fair to pay more because
a/ Ebay made an offer which you accepted by making the purchase
b/ Count up the users here who reported being told they would get the 15%. Make a list of the times they reported it and just label as user 1 user 2 etc. Say they were getting told they would get the discount after threatening to go to ACCC.
This is just to give them the impression you won't just wander off cause they want you to.

The first bit is pretty much what they have been telling people who got it approved and my impression was it was scripted.
I got the first response which was no
Then after a wee little prod, sure no worries make the purchase the marketing teams gonna refund the 15%
I didn't get told to call back after purchase or asked the item numbers that some people have reported.

(AGENT)Please be informed that the promotion has been expired on 30th Dec. 2015, 13:00 AEDT and cannot be used any more.
(MEMBER)Thanks, I also know that most everyone that has contacted to complain has been told they will get the 15% credited to them. Do I have to complain?
(AGENT) If you still want the item you will have to pay the full amount and once you complete the payment we'll escalate the transaction details to our Marketing and Promotion team for a manual refund of the discounted amount.
(AGENT): Please go through the T&C and make sure that you fulfil all of them before purchasing the item.

        • Thank you. I have emailed a little while ago, outlining a lot of that. Try again tomorrow on the phone I guess. Wish there was a way to get the same rep crazycs had. ;-)

  • Did anyone happen to get a screenshot of the Ebay T&C page and could post a link.

    Cheers

    • +1

Someone posted a screenshot of it yesterday but since this post is 20 pages long, good luck finding it. But having said that, it won't make any difference, mate. I don't know why people keep complaining over here for more than a day now. This ship has sailed and people need to make up their minds whether they'll boycott eBay for good (saw some people saying silly stuff like that) or whether they'll wait for the next deal and hope to not miss out again.

It's not like eBay is some amateur corporation who doesn't know how protect their backside legally in situations like this. I've got this clause from a comment I made yesterday and the same clause was present in both T&Cs (the original one and the revised version):

      18. eBay reserves the right to vary the terms and conditions of the offer at its reasonable discretion by publishing revised terms on ebay.com.au.

ACCC or not ACCC, I don't see anyone succeeding in getting anything out of eBay in this deal. Yes, I wish it expired on the original due time as I've only managed to make one quick, unplanned purchase when the first news of the expiry was mentioned just 20 minutes before 1 pm yesterday. Deals like this one and others are on OzB all the time so good luck next time, I guess.

      • +2

It's not just about waiting for the next 15% sale. People are also annoyed because it's an opportunity cost - they could have saved time or bought at another retailer during this sale period if the 15% wasn't offered and pulled. 15% off at another period is very different from 15% off during end of year sales.

T&Cs are meaningless if they are determined to be misleading in intention. If enough people do complain, that is evidence of people being misled.

I think eBay will pay everyone promised the 15% if they pursue it. Withdrawing the offer was damage control for the masses, although it's arguable whether PR damage is worse than monetary.

  • On a more positive note, and my sympathies to those who missed out or got screwed around, it sounds like eBay is possibly going to relaunch the deal shortly. Which is good news for those who already got their 2 transactions in. Another bite of the cherry, hopefully!

    • Another bite of the cherry, hopefully!

Nope, too full now to take another bite. My wallet can't handle it.

  • @Sweet3st, that'd be awesome if they do do the same deal (or better) again but where'd you get this info?

    • Read through the thread. Lots of people who rang customer service were told something like this… no idea if it will happen, but that's the story anyway :)

  • +1

I have actually ended up benefiting from this. After the promo officially expired early, Kogan reduced their promo-jacked-up prices by 10-12% (at least for the item I was interested in) and E-bay are still going to give me discount. Double win :-)

    • +2

Same here. Item has shipped. Cashrewards tracked. All good.

  • +2

Well, I just phoned them again - and what a different experience!

Spoke to a lady this time with an asian accent. She confirmed they were receiving a high volume of related calls about the promotion. And because I paid during the promotion period (as long as the terms & conditions are met), I do qualify for the refund.

I asked her HOW does anyone in ebay know that, over say, someone else who hasn't asked about the 15%? (How do they even become aware of it.) A: She has made some kind of notification to their marketing team; that the credit should take place within 15 working days AFTER their marketing team actually gets to that notification. She also said she'd contact me in about 3 working days. (She probably meant ebay will contact me, not her personally. But we'll see.) And, if I don't receive any communcation from ebay after 10-15 days, to contact them again.

Then she did a bit of ego-stroking… "I can see you've been a good ebay customer and for quite a long time, haven't received a discount before…" (I know it's just ego-stroking, because I did receive a discount a few months ago.) But even so, an entirely different attitude to the first arrogant so-and-so who was just in a hurry to get home to his cheetos and sat-tv (he said he wouldn't pass me to someone higher because it was closing time and they'd gone home).

    So good luck folks.

  • +1

I sent them a very brief, simple email and received a speedy reply informing me that will credit me 15%. Ebay may have done the wrong thing but 5 stars to their customers service team.

  • For those that bought, but haven't phoned ebay about the code being pulled…

    tonka said above:

It wouldn't surprise me if they refund the 15% to everyone anyway.

This would certainly be easier for them, but then I connected some dots.

The info the woman I spoke to indicates - only those that ask for it - will receive the credit. Because notification had to be sent to the marketing team, and them confirm the terms & conditions were met by me - for that to occur.

  • +2

I read and understand the fine prints. It is correct that that they can change the offer. HOWEVER…

However, a contract should have been formed at the time that I placed a bid. i.e. I agreed to pay $x should I be the highest bidder.

In other words, by the time I placed the bid, I have already accepted ebay's original offer expiring 31st Dec, not the later revised version of the offer.

Would any more qualified legal expert disagree with that here?

    ACCC Consumer Complaint Form here.

    • Just received an email. Thought it may interest others…

Thanks for contacting eBay about availing the 15% promotion.

I do apologise again for the inconvenience that this has caused you. I will send a credit request to our promotions team and there will be an amount of $X that will be credited back to your PayPal account.

Please bear in mind that our credit processing will take 15 – 20 business days. Don’t worry, I will update you time to time as soon as I got an update from our promotions team.

Thanks for choosing eBay. Have a great day.

      • I sent messages to ebay on facebook and got the same answers as yours. So we should get the credit soon.

  • It's been two days, haven't received any notificiation from cashrewards. Is it too early?

    • Took 2 days for one and 3 days for the other so I think you should get a notification today

    • One of the terms for Ebay on the Cashrewards site is the item needs to be marked as sent, so something to check.
I assume the process is automated anyway but possible the public holiday and weekend held things up.

I'm hoping one of these is right as I have a multi-part order from the 31st that has some items not sent yet and I've yet
      to receive my notification.

      • Funny you mention that. It popped into my mind the items being marked as sent (or Paypal payment received) could be it. I ordered 1 item each, from 4 different sellers. And I received an ebay message on 5pm Sunday, the last item had now been sent. So now I wait 3 days from Sunday I guess.
